I am writing today to address the heavy trucks that travel Illegally on the Racquet Club Rd/Farrel curve (from RC & Sunrise to the curve and over to Farrell & Vista Chino). Palm Springs muni codes 12.56.010, 12.56.020, and 12.56.030 are designed to restrict heavy trucks to the designated truck route with exceptions and exemptions. The police department is responsible for enforcing these muni codes. However, I have correspondence with the city from the last 4 years demonstrating a gross indifference and ultimately a dereliction of duty with respect to enforcing these muni codes. The result has continued to negatively affect quality of life. Heavy trucks use the curve at all hours of day and night causing rumbling felt throughout properties, excessive noise pollution, and excessive west on the roads not built to withstand the excessive weights and usage. There may also be damage to the foundation of homes. As I said, this has all been brought up in the past to the city manager, city council, city attorney and police chief. I was told the code was unenforceable as the required signage was absent - this response came 6 weeks after my inquiry during in which time the signage was removed by the city. I was told the muni code needs to be updated as the weight required to be considered to be a heavy truck, would make many regular pickup trucks be considered heavy trucks. However, the same weight limit also made 1971 quadcab pickup trucks be considered heavy trucks - at which time the muni codes were less than 10 years old. When I inquired with the police, I was told that the officers are not qualified to differentiate a heavy trucks from others. Ultimately, I was told the police would 3/10/2022 Public Comment Item Non Agenda retrain and start enforcing the codes. That was years ago now, and recently, as per the police department, no training has occurred. To be frank, the city has not acted to revise the applicable muni codes, has not enforced the truck routes, allows city property (roadways) to be misused causing premature failure of roads, has allowed resident's quality of life to be negatively affected, and has allowed private property damage to occur. Yet, I imagine that if these same heavy trucks were driving downtown in the same illegal volume, that there would be an immediate outcry and solution. Suffice it to say that the city and politicians have ignored the issue because it is perceived as having very little financial impact to the city. Regardless, the muni codes were established for many reasons including protecting private property and protecting quality of life. I've yet to review the state/city relationship, however a financial arrangement/agreement must exist as the state does maintain the truck routes' roadways. As with any agreement, the city has certain obligations. I am but one person, a good neighbor, not a council member, not a politician, and I only speak for myself. You represent all of zone 2 and this is a very real issue. I would appreciate if you would advocate for your constituents and raise this issue anew, so that it can be addressed and resolved. I previously proposed a revenue idea that would cover costs of police training, police enforcement, and additional police salaries to enforce the codes. Additionally, the revenue would exceed enforcement related costs and would bring in additional income to the general fund it to the police dept budget. My idea was completely ignored previously. I hope to hear from you directly, and/or see it properly addressed by the city. Failing any support from you or any resolve to problem, I will see that it gets addressed. I have my previous communications with the city, it's employees, and politicians, which I will use as needed for future legal purposes and for any publicity campaign to raise awareness of the city's past negligence. Greetings Council and Mayor! I'm writing in regard for your consideration of amending our current Short Term Rental Ordinance. I'm in favor of a controlled STR marketplace for Palm Springs. Along with the current (successful) guidelines, it is time to add a capon the amount of STR's in our city limits. 10% is too high a mark as that would add another 1,300 rentals, gutting our neighborhoods. A logical cap, that would still provide a robust TOT would be around 5% or 2,000 homes. It's time to offer homes to buyers that actually want to live in our city full or part-time. This solution is the perfect compromise, over an outright ban that we have seen from other valley cities. In addition, we need to seek developers with strong financing that can complete hotel projects in our city to add to our TOT coffers. Thank you for your consideration. Dear friends, I made this comment on Hank Plante's Facebook post this morning (Sunday, March 6), and to be sure you recognize one more concern, I am copying my comment to you for serious consideration. I said: Having said previously that my neighborhood is pretty good in regard to STRs, I take back every word. A few days ago, our NORG sent the usual welcome letter to the new owner of the home next door to me, alluding to the fact that we are a "family friendly" neighborhood, about our schools, etc etc. Well - we then found out it's NOT a family, but someone who looks to make big bucks renting it out. I then spoke with Patrick in the Vacation Rental Office at City Hall - - he told me that new owner has applied for a permit. He and I spoke at length, and in addition to several concerns, I brought up the topic of CRIME - and I urged that limits to the #a of STRs MUST BE SET. Where is the safety factor when 12 out of 14 homes on (my) cul de sac are turning into STRs? Renters have no stake in what happens on the block. Crime escalates as STR properties, when they are not occupied, can be and have been targets for thieves, putting those of us full time home owners at risk. It's not just noise and party houses. It's crime. Crime rates go up while the city benefits from the fees and taxes and the owner pockets the rental money. Whereas, with full time, or even part time home owners, neighbors look out for one another. [The home to which I refer above is 504 Laurel Circle. It was owned and just sold by my friends from San Francisco (SFUSD school superintendent Myong Leigh and his partner Mark, a SFUSD school psychologist). These actions terrorized and evoked a historical trauma response in already marginalized citizens. The community needs the City Counsel and City Manager Justin Clifton to understand that they are not culturally equipped to handle the unhoused due to the current handling of our Section 14 community. The community would like written, documented impact studies examining long- term effects on the community. Historically, cities like Palm Springs, have disregarded marginalized communities in order to push one-sided cultural biases. As a Public Arts Commissioner, I took an oath to protect our city from foreign and domestic terrorism. I literally had to yell at the City Manager not to terrorize a community with the way he was conducting the meeting. This is very reminiscent of the way the city is currently dealing with Section 14. “Our hands are tied and there’s nothing they could do about it” is not what I expected nor deserved to hear, especially when the city flyers invited people to get involved. For years, the community has asked for symbols of trauma to be removed and now the city has ruled in a way that inflicts more trauma with a transitional homeless navigation center; making it harder for the community to trust the city’s judgment. The actions of buying land for a transitional homeless navigation center in our community feels very punitive and deliberate, and nothing the city has done or said so far has shown otherwise. It is my understanding this wall was requested by the treatment plant, not the Commission. It would be a dangerously unintended consequence to assume the wall would be sufficient as a wind screen. I am asking Council to ensure that there is a flexible barrier of some kind between the wall and the courts. It is not unusual for players to run into the chain link fences currently in place in pursuit of a ball. They are rough, but forgiving. A solid wall surface would pose an unnecessary hazard. Hello Mr. Mejia, Would you please share this email and it’s attachment with the City Council prior to their March 24 meeting? I have been very pleased and grateful for the support of the Parks & Recreation Commission regarding the much needed improvements and stepped-up maintenance at Demuth Park, especially in relation to the pickleball courts there. One of those improvements is the placement of wind screens around the courts. However, I am deeply concerned about the planned placement of a block wall on the south side of the courts along the boundary with the water treatment facility. It is my understanding this wall was requested by the treatment plant, not the Commission. It would be a dangerously unintended consequence to assume the wall would be sufficient as a wind screen. I am asking Council to ensure that there is a flexible barrier of some kind between the wall and the courts. It is not unusual for players to run into the chain link fences currently in place in pursuit of a ball. They are rough, but forgiving. A solid wall surface would pose an unnecessary hazard. This danger is real.
