FROM: Justin Clifton, City Manager BY: Planning Services Department SUMMARY Wolfgang "Rob" Giesecke, co-owner of Secondary Source Productions, dba Reforma Palm Springs has applied for a California Department of Alcoholic Beverage Control (ABC) Type 48 (On Sale General Public Premises) alcohol license for a proposed nightclub / bar / restaurant use located at 333 South Palm Canyon Drive. The subject property is located within a Census tract area which is identified by the ABC as an area with an over-concentration of alcohol licenses. The applicant is requesting the City Council to make a determination of public convenience or necessity for the proposed license. Palm Canyon Drive PRIOR ACTIONS/EVENTS: -···--. - - .. --Date Actions/Events Page 2 of 6 . --~ -,. . - 2-1-21 HSPB granted a certificate of appropriateness for exterior alterations to Class 1 historic site #84, the Robinson's Department Store Building to create outdoor dining terraces for Reforma. 4-5-21 AAC recommended architectural approval for the exterior alterations for Reforma. 4-28-21 Issuance of a Land Use Permit for a restaurant use with outdoor dining (LUP 21-004) for Reforma is anticipated in conjunction with the Planning Commission's consideration of a Conditional Use Permit for the proposed nightclub and cocktail lounge use. BACKGROUND AND PROJECT DESCRIPTION: The number of alcohol licenses is regulated by the ABC based on census tracts and county population. For this census tract, two on-sale licenses and 1 off-sale license are the quantity allowed without a Resolution of Public Convenience or Necessity ("PCN"). The census tract in which the applicants' business is proposed is Census Tract 446.06. This .tract encompasses 15.8 square miles (see attached Census Tract Map) and generally includes the entire commercial area along Palm Canyon Drive from Interstate 1 O to Ramon Road, the entire commercial area along Indian Canyon Drive from Vista Chino Road to Ramon Road and all hotels and other commercial uses in the Tennis Club, Old Las Palmas and Racquet Club West neighborhoods. This tract currently has 149 on-sale alcohol licenses and 13 off-sale licenses. The California Department of Alcoholic Beverage Control (ABC) requires a Type 48 alcohol license for the on-site consumption of beer, wine and distilled spirits. The applicant is requesting a Resolution of Public Convenience or Necessity in accordance with Division 9. ALCOHOLIC BEVERAGES [23000-25762] of the State of California Business and Professions Code. About the Applicant. Reforma Palm Springs is a restaurant / nightclub / cocktail lounge use proposed in a 9,000 square foot tenant space located at 333 South Palm Canyon Drive (the former Robinson's Department Store building, a Class 1 historic site). As described in their justification letter dated January 13, 2021, Reforma will provide full-service dining, with alcoholic and other beverage service, dancing and entertainment. The venue will be divided into three sections: • A casual bar offering bar seating, table seating and standing room appropriate for lunch and dinner or simply beverages and snacks. The use will occupy both indoor space and an outdoor dining area on a raised terrace area fronting Palm Canyon Drive. 2 City Council Staff Report April 22, 2021 Case 5.1524 PCN -Type 48 Alcohol License -333 S. Palm Canyon Drive • A dining room serving more formal, full service, sit-down meals. Page 3 of 6 • A dance floor providing room for dancing and occasional live performances, including vocalists, comedy and drag performers. Hours of operation are proposed as follows: • Bar: 11 am to 2 am every day serving lunch, after work happy hour, dinner and late-night dining. • Dining room: 5 pm to 12 am Wednesday to Saturday for dinner and 11 am to 6pm Sunday for brunch. • Dance floor: 8 pm to 2 am Friday and Saturday, initially. Adding Thursday and Sunday when appropriate. The applicant currently owns and operates Chill Bar Palm Springs ("Chill Bar'') at 217 East Arenas Road. Chill Bar has received an "A" rating from the Riverside County Department of Environmental Health and has received no disciplinary actions from the ABC. The ABC describes the Type 48 license as follows: • On Sale General -Public Premises -(Bar, Night Club) Authorizes the sale of beer, wine and distilled spirits for consumption on the premises where sold. Authorizes the sale of beer and wine for consumption off the premises where sold. Minors are not allowed to enter and remain (see Section 25663.4 for exception, musicians). Food service is not required. Pursuant to Section 23958 of the State of California Business and Professions Code, the California Department of Alcoholic Beverage Control (ABC) is required to " ... deny an application for a license if issuance of that license would tend to create a law enforcement problem, or if issuance would result in or add to an undue concentration of licenses, except as provided in Section 23958.4." Sections 23958.4(a)(2) and (3) of the Code defines the term, undue concentration, as follows: • As to on-sale retail license applications, the ratio of on-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of on-sale retail licenses to population in the county in which the applicant premises are located. [State of California Business and Professions Sections 23958.4(a)(2)] • As to off-sale retail license applications, the ratio of off-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of off-sale retail licenses to population in the county in which the applicant premises are located. [State of California Business and Professions Sections 23958.4(a)(3)] The Section further states that an alcohol license may nevertheless be issued in an area of undue overconcentration when " ... the local governing body of the area in which the applicant premises are located, or its designated subordinate officer or body, 4 City Council Staff Report April 22, 2021 Case 5.1524 PCN -Type 48 Alcohol License -333 S. Palm Canyon Drive Page 5 of 6 determines within 90 days of notification of a completed application that public convenience or necessity would be served by the issuance ... " [State of California Business and Professions Code, Section 23958.4(b)(2)]. The subject property is located within Census tract number 446.06, which encompasses the Uptown and Downtown neighborhoods. According to the applicant's ABC applications, there are 149 on-sale liquor licenses issued within this Census tract. The number of alcohol licenses based on county population would be two (2). Hence, the applicant is requesting a determination of public convenience or necessity for the alcohol licenses that are necessary for the proposed restaurant / nightclub / cocktail lounge uses. The General Plan land use designation of the subject property is Central Business District (CBD). The General Plan describes the intended uses for this land use designation area as " ... the main activity center and cultural core of the community and, as such, ... entertainment venues are encouraged here. (Palm Springs 2007 General Plan Land Use Element, page 2-7). Page 2-39 of the General Plan states, "It is envisioned that Downtown will become a high-intensity, mixed-use area characterized by residential, office, commercial and entertainment uses." The proposed restaurant / nightclub / cocktail lounge use is harmonious and consistent with the goals and vision of the General Plan as follows: Policy 7. 1: "Encourage a diversity of high-quality commercial uses, attractive to both the resident and the visitor, including retail, entertainment cultural and food sales, in appropriate areas of the City." Policy LU10.4: "Accommodate a borage range of uses Downtown to meet the needs of both residents and visitors and to stimulate both daytime and evening activity." Policy 28. 7: "Encourage developers of sites containing a significant architectural, historical or cultural structure to adaptively reuse and expand it... " Policy CD30.3: "Encourage retail uses that maintain extended evening hours and support nighttime activity." The project site is located within the Central Business District ("CBD") zone in a historic multi-tenant building with frontages on South Palm Canyon Drive to the east, Baristo Road to the north, and Belardo Road to the west. Palm Canyon Drive is the primary commercial corridor in Census tract 446.06. The site has ample off-street parking on the west side of the parcel which takes access from Belardo Road and Baristo Road. The sale and consumption of alcoholic beverages is complementary to the proposed restaurant I nightclub / cocktail lounge uses. Palm Canyon Drive Code. Staff finds that the issuance of the requested alcohol license is appropriate for the area in which the use is proposed and will serve the public convenience. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC CONVENIENCE WOULD BE SERVED BY THE ISSUANCE OF A TYPE 48 ALCOHOLIC BEVERAGE CONTROL LICENSE FOR "REFORMA PALM SPRINGS" A RESTAURANT, NIGHCLUB AND COCKTAIL LOUNGE LOCATED AT 333 SOUTH PALM CANYON DRIVE, WITHIN CENSUS TRACT NUMBER 446.06, ZONE CBD. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. WHEREAS, Wolfgang "Rob" Giesecke, co-owner of Secondary Source Productions, dba Reforma Palm Springs has submitted an application to the California Department of Alcoholic Beverage Control (ABC) for issuance of a Type 48 (On Sale General Public Premises) alcohol license. In conjunction with the operation of a restaurant, nightclub and cocktail lounge use located at 333 South Palm Canyon Drive, Census Tract No. 446.06, Zone CBD; and B. WHEREAS, the California Department of Alcoholic Beverage Control (ABC) has determined that there are 149 existing on-sale alcohol licenses issued within Census tract number 446.06 while only two (2) such permits would be allowed based on population in the County and the census tract in which the applicant's premise is located; and C. WHEREAS, the California Department of Alcoholic Beverage Control (ABC) has determined that there is an "undue concentration" of alcohol-related licenses in the Census tract number 446.06; and D. WHEREAS, pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license; and E. WHEREAS, The General Plan land use designation of the subject property is Central Business District (CBD). A Letter of Public Convenience or Necessity is required due to the concentration of licenses in this census tract (446.06). A review of the existing licenses in the census tract shows that Reforma would be a unique operator in this area. Our focus on high-end entertainment, including dancing and events combined with quality dining restricted to an over-21 demographic is not currently available in Palm Springs. Of the six (6) existing Type-48 on-sale licensees, only Village Pub offers a combination of entertainment and dining. It's target demographic entirely different than Refoma's. Furthermore, it offers a very focused rnenu of bar bites, as opposed to Reforma's proposed comprehensive menu (enclosed) of pan-Latin cuisine. It is not apparent that any of the Type-47 licensees offer regular entertainment. Attached to this request, please find the justification letter that was included with our application for conditional use permit. The justification letter lays out our plans for the venue in detail, but we wanted to call your attention to a few items that are germane to this request. • The owners of Reforma already operate a Type 48-Licensee in Palm Springs. Chill Bar Palm Springs has operated safely and without incident since October 2017, when Mr. Giesecke and Mr. Vastardis assumed control. • Chill Bar maintains a rigorous compliance program to ensure minors are not allowed entry and patrons are served in a safe manner. Staff is required to undergo California LEADS training and empowered to refuse service when they feel it is warranted. This successful program will be implemented at Reforma. • Chill Bar maintains a security system comprised of trained individuals and technology to keep patrons and staff safe. A restaurant was proposed at the North end, however that project has stalled. Reforma will occupy 9,000sf in the center section of the building, and add much-needed life to it. Proposed alterations to the building are minimal, and sensitive. A new planter to mirror an existing one will define a new outdoor patio, and a replaced section of storefront will allow a larger opening between inside and outside at the Bar area facing S Palm Canyon. The building sits at a transition between higher density retail and restaurants to the North, and less dense, larger structures to the South. Fuzion Five restaurant and Sammy G's Tuscan Grill are across Baristo Road to the North. The Palm Springs Art & Architecture museum is directly across the street to the East, as is Grocery Outlet. The yvestern half of the site consists of an onsite parking lot, which acts as a buffer between the building and two hotels to the West on S Belardo Road. Reforma's Contribution to Palm Springs By focusing on providing quality food, beverages, entertainment and physical surroundings to a diverse clientele, we believe that Reforma can become a reason for people to visit Palm Springs. The Destination Next study prepared for the Greater Palm Springs Convention & Visitors Bureau in June 2019 found that visitors rate attractions and entertainment most important. Ratings for Greater Palm Springs on that metric did not match its importance. The study went on to suggest that attractions and entertainment, including nightlife, were one of thr~e things the area could focus on to burnish its image. Warm weather vacation destinations have long held claim to some of the most well-known nightlife. Fire Island Pines, Ibiza, Mykonos, as well as South Beach, Key West and Provincetown are prominent examples. When these communities deliver a quality nightlife experience to travelers ready to enjoy themselves the result can be nothing short of magical. The nightlife of these communities helps to define and enhances their culture. We believe that Reforma's combination of quality food and beverage along with dancing and entertainment will be unique to Palm Springs and enhance events such as Modernism Week, Palm Springs International Film Festival and Greater Palm Springs Pride. Quality restaurants and nightlife are often a deciding factor for many visitors when choosing a destination, especially among LGBTQ visitors. The enduring popularity of Arenas Road, along with that of venues such as The Village and Copa, shows that visitors to Palm Springs are looking for quality nightlife options. In addition to becoming a destination within Palm Springs, we intend to continue contributing to our community. Community-focused events will be on the schedule at Reforma, just as they are Chill Bar. We expect to create over 65 full-and part-time positions, including many within the management ranks. The job impact will equate to approximately 50 full time equivalents. We also believe a late-night dining and entertainment option at 333 S Palm Canyon will create a bridge of activity between the lively area north of Baristo and businesses north of Ramon. Adding evening activity to this area will increase overall safety and enhance those business south of Baristo. 26 [E[F Mitigating Measures Parking: There are 69 spaces in the existing onsite parking area. While we are aware that 333 S Palm Canyon lies in the "D" Downtown Combining Zone and the Downtown Parking Garage is less than a block away, we believe it is best for the community that we provide for adequate parking based on our business. First, it is important to consider that our hours of peak traffic (weekend evenings and nights) complement those of our neighboring tenants. When we are busiest, they will generally be closed or welcoming few customers. As a venue serving alcoholic beverages, we will continually encourage our customers to use ride-share, public transit or designate a driver. While this reduces the need for parking, it is also a major initiative to keeping our customers safe. Noise Abatement: We plan to offer dancing and occasional live vocal performances using amplified music. We understand that it will be our responsibility to ensure that our venue is integrated within the surrounding community by proactively implementing noise abatement measures. Currently we plan to implement the following: • Noise dampening walls between our premises and our neighbors • Placing the main entrance to the venue on S Palm Canyon, opposite the Art Museum • Constructing a stage, green room and DJ booth on the west end of the venue, thereby creating a double wall to reduce noise emanating from the back of building facing the hotels on Belardo • Placing the dining room with its windows on the east side of the venue, thereby reducing the amount of noise created and directing it to a commercial city block • Working with a reputable sound engineer to ensure the sound system is properly tuned, thereby reducing unnecessary noise • Deliveries and refuse pickup are scheduled during daytime business hours Public Safety: We believe that our record at Chill Bar is our best example of the strategies we employ to operate a safe business.
