IN THE AMOUNT OF $82,315 FOR DESIGN OF A BLOCK WALL AND ELECTRICAL RELOCATION SERVICES FOR THE VWvTP BLOCK WALL, CITY PROJECT NO. 21-11. FROM: BY: SUMMARY: David H. Ready, City Manager Development Services Department Approval of this item will authorize Veolia Water West Operating Services, Inc. ("Veolia") to proceed with design and electrical relocation services to upgrade the chain link fence shared between the Wastewater Treatment Plant ("VWvTP") and Demuth Park to a block wall. This item is being presented at this time as it is entirely funded by the Wastewater Fund. RECOMMENDATION: 1. Authorize the City Engineer to issue a Notice to Proceed to Veolia Water West Operating Services Inc. in an amount not to exceed $82,315 for the design of a block wall and electrical relocation services for the VWvTP Block Wall, City Project No. 21- 11; and, 2. Authorize the City Manager to execute all necessary documents. BUSINESS PRINCIPAL DISCLOSURE: Veolia Water West Operating Services, Inc. is a Delaware Corporation. The Public Integrity Disclosure Form from Veolia Water West Operating Services, Inc. is included as Attachment 1. BACKGROUND: On November 4, 2015, the City Council approved a Wastewater Services Agreement with Veolia for operation and maintenance of the City's sewer collection system and the VWvTP. \ / ITEM NO.__:.\_\" __ _ 1 City Council Staff Report April 8, 2021 --Page 2 Approve Notice to Proceed to Veolia for WNTP Block Wall Design and Electrical Relocation Services Veolia and City Staff identified the W\/\/TP Block Wall project to help mitigate W\/\/TP odors and noise impacting Demuth Park patrons. The W\/\/TP shares a chain link fence with the pickleball and tennis courts at Demuth Park. The W\/\/TP Block Wall project will replace the existing chain link fence with a 10-foot-high by 235-foot-long block wall to help reduce W\/\/TP odors and noise which will reduce disruption and enhance the park patron's experience. Preparation for construction of the block wall will require a design package for future bidding, and conflicting electrical to be relocated. STAFF ANALYSIS: On December 3, 2020, Veolia and City Staff met with local design engineer, Randy Purnel Landscape Architect (RPLA), to review the scope of work for preparation of a design package for construction of the block wall. Electrical components that power the Demuth Park pickleball and tennis court lighting are located on the W\/\/TP side of the fence and will need to be relocated prior to construction of the new block wall. In accordance with Section 5.3, "Capital Projects" of the Veolia Wastewater Services Agreement, Veolia recommended the City authorize an "Agreed Capital Project", and the City authorized Veolia to proceed with the preparation of a request for proposals for relocation of existing electrical in conflict with construction of a new block wall. On December 17, 2020, Veolia issued a request for proposals to the following five local electrical contractors for relocation of the existing electrical in conflict with construction of a new block wall: 1. Bradley Electric Inc, Palm Desert, CA 2. Critical Electric Systems Group, Palm Springs, CA 3. Cove Electric Inc., Palm Desert, CA 4. Davis Electric, Yucaipa, CA 5. Hale Electric, Yucca Valley, CA On January 15, 2021, two proposals were received from the following electrical contractors: 1. Cove Electric -$46,913 2. Hale Electric -$56,236 On February 8, 2021, Veolia received a proposal from RPLA for design of a new block wall and associated design services for irrigation and landscaping in the amount of $15,200. Staff reviewed the proposal from Veolia encompassing project development services, and block wall and electrical relocation management and coordination in the amount of $20,202, the proposal from Cove Electric for electrical relocation in the amount of $46,913, and the proposal from RPLA for the design of the block wall in the amount of $15,200 for a total proposal cost of $82,315. Staff found Veolia's proposal to be qualified 2 City Council Staff Report April 8, 2021 --Page 3 Approve Notice to Proceed to Veolia for \/\/WTP Block Wall Design and Electrical Relocation Services and complete and, therefore, recommends approval of the Notice to Proceed. A copy of Veolia's proposal is included as Attachment 2. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities", Class 1 (b) projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing facilities of both investor and publicly-owned utilities used to provide electric power, natural gas, sewerage, or other public utility services; therefore, the WWTP Block Wall Project at the Wastewater Treatment Plant is categorically exempt from CEQA, and a Notice of Exemption will be prepared and filed with the Riverside County Clerk. FISCAL IMPACT: Sufficient funds are budgeted and available in the Wastewater Fund. General Fund and Measure J Funds will not be required for this project. APPENDIX II -VENDOR QUOTATIONS Page No. 3 4 5 5 6 7 2 9 SECTION 1-SCOPE OF WORK Veolia Water West Operating Services, Inc. is pleased to submit the following proposal for a "Desirable Capital Project" to facilitate the design of a 10-ft high by 235-ft long block wall within the Wastewater Treatment Plant, along with relocating an existing Demuth Park electrical panel that lights the pickle ball courts. Background: The WWTP shares a fence with the city's largest park, Demuth Park. The park's pickle ball courts are near the entrance of the wastewater treatment plant (WWTP) off of Vella Road. The intent of this project is to build a large block wall to replace the existing chain link fence in the area, to mitigate complaints of smell, noise and disruption from the pickle ball court players regarding the Wastewater Treatment plant activities. Project Details: The approach to this project includes engaging local design engineer, Randy Purnel Landscape Architect (RPLA), to complete a small design package for bidding out the construction of the block wall. Additionally, the existing electrical panel that provides light to the pickleball courts is located within the WWTP facility and needs to be relocated, per an onsite planning meeting with the City on December 3, 2020. On December 17, 2020, Veolia reached out to (5) local electrical contractors to solicit bids for the electrical work and conducted a subsequent pre bid job walk on December 21, 2021. Two quotes for the electrical relocation were received and evaluated on January 15, 2021. After review of the electrical quotations, Cove Electric has been selected to complete the work. Cove Electric is also a local City vendor. The electrical contractor will begin the work upon Notice to Proceed from the City and a fully executed subcontract agreement with Veolia. The first part of the work is estimated to be completed within one week of start, with the Electrical Contractor having to return to complete the work once the block wall is built. SECTION 4 -CONCWSION AND RECOMMENDATION There is a significant level of design coordination, field construction management, inspection and safety oversight-required to successfully execute this project and we look forward to partnering with the City of Palm Springs to deliver a successful project. Description of Services: 1) Preliminary Design Documents: Randy Purnel Landscape Architects will develop preliminary landscape design for consulting collaboration and City of Palm Springs review. a) Onsite observation necessary to photograph, verify, survey and document necessary existing site conditions. b) Develop a Site Plan of all areas associated with the landscape improvements, utilizing facility 'As Built' plans and or any available data. c) Conduct ample discussions with facility management, city and/or consultants to program, design, review and coordinate the project. d) Develop plans, sketches, images and/or exhibits in order to present and characterize various landscape solutions to the site improvements. e) Present proposed landscape alterations/ improvements for discussion and determination of subsequential procedures. 2) Construction Documents: Following preliminary design approval, Randy Purnel Landscape Architects will develop detailed construction documents depicting all elements of the wall development and landscape for the use of accurate competitive bidding and construction: a) Site demolition plan, limited to elements directly associated to new wall, planting and or irrigation development. b) Site wall plan, including layout dimension, details, specifications and material finishes. c) Landscape planting plan indicating limited planting additions in botanical and common names, sizes, quantities, locations, and special comments. d) Landscape Irrigation plan indicating the use of water conservation efforts. e) Project specific planting and irrigation details and specifications. f) Project coordination with all consultants as needed to achieve a unified set of drawings. g) Project meetings as needed with project staff, engineers, contractors and/or consultants to design, review, and coordinate project. h) Submit landscape document set to city for review and comment. i) Address and correct all project review comments and or concerns and re-submit as needed to achieve approval. 3) Construction Administration: Randy Purnel Landscape Architects will provide onsite services per project managements requests: a) Meeting with contractors/consultants to review and coordinate overall site improvements. b} Review and or coordinate layout, detailing and or alterations to the wall, drainage, grading, etc. c) Review planting and or irrigation installation as designed and or as needed to address retrofitting/modifications. d) Development of any requested ;As Built' plan development necessary for final project approval. 4) Revisions/Miscellaneous Items: (Based on the approved Construction Documents) Randy Purnel Landscape Architects will provide additional services requested by the client with prior written approval, such as: 1. RPLA will notify and obtain written approval prior to commencement of any of the following services, but services are not limited to: • Revisions and or changes to the plans that are not part of Section II. Description of Services. • Revisions as a result of the error of other consultants. • Changes in the City policies during the term of this agreement. • Changes in the original description of design work. • Modifications to the drawings after the approval. The following are in addition to the fees described above and will be billed at cost plus 15% for bookkeeping and handling. Reimbursable expenses include but are not limited to: • Reproduction of drawings and specifications for any purpose, including reproducible and preparation of CAD files for submission to the owner, contractor or government agency. • Postage costs for distribution of drawings and specifications: (Express Mail, UPS, Federal Express, etc.) • Government plan review fees (if applicable). • City and water district plan check fees. 20 2.08.21 PSWWTF _park Wa ll Page 4 of 4 VII. Payment: ALL FEES ARE DUE UPON RECEIPT OF INVOICE • RPLA will invoice on a progressive/ percentage of project completion basis. Percentage of the project invoiced will be based upon project size and number of phases. These percentages will include one or more of the following 25%, 50%, 75%, and/or 100% • If we have not received payment within 45 days from the date on the invoice for progressive billing, RPLA has the option to stop all work on the project, until payment is received. • Invoices that remain unpaid after 60 days of job/phase completion, will be considered delinquent and will be turned over for collections, unless prior arrangements have been made. The Terms and Conditions below are included within this contract. TERMS AND CONDmoNS 1. Arbitration: Any controversy or claim arising out of or relating to this contract or the breach thereof shall be settled by arbitration administration by the American Arbitration Association in accordance with its applicable rules, and judgment upon the award rendered by the arbitrator(s) may be entered in the court having jurisdiction thereof. Arbitrator shall be a California licensed landscape architect. 2. Attorney's Fees and Limitation of Uabillty: In the event either party is required to bring an action to enforce or interpret any provision herein, the prevailing party shall be entitled to reasonable attorney's fees, as determined by an arbitrator or, if applicable, a court of appropriate jurisdiction, as well as costs, expenses and damages to which said party may be entitled. In no case shall landscape Architect be liable for more than the total amount of his fees. The Owner agrees to indemnify the Landscape Architect from any and all legal actions relating to the services provided in this agreement brought by persons of entities not a party to this agreement. 3. Incorporation of Plans and Specifications: The terms and conditions of the specifications set forth in the specification manual and/or plans are hereby incorporated by reference in this Agreement. Owner and Landscape Architect agree to be bound by said terms and conditions. Wherever there is a conflict between this Agreement and the plans and specifications, the terms and specifications on the plans shall prevail. 4. owner's responsibilities: shall include, but are not be limited to: Owner shall be responsiblefor delivery of an accurate site plan, on electronic media, to the landscape architect; Owner is responsible for accuracy of property lines; and Owner is responsible for proper maintenance of the project after completion of construction. 5. Termination of Aareement: This agreement will automatically be terminated upon receipt by the Landscape Architect of the final payment from the Owner. Either party may terminate this agreement upon seven (7) days written notice. If the Owner should elect to terminate this agreement, then all fees and expenses accrued but unbilled to that date, plus all outstanding invoices, are immediately due and payable. 6. We will begin by demoing the existing sub-panel & neighboring contactor & pull boxes. Once the distribution boxes have been removed, we will begin the process of relocating the sub-feed conduit & conductors. We will trench down to the sub-feed conduit depth extend the conduit so it will be outside the footing of the new wall to be built. Once outside of the footing area, we will 90 up the existing conduit & sub-feed wire into an underground pull box. Once in the pull box we will trench to the new panel location near the entrance of the complex & run new conduit & sub-feed wire. Once the conduit has been ran we will backfill the trench & install the new 200amp sub-panel. We will only reconfigure conduits that are currently sitting on top of the fence where the new wall is to be built. We will disconnect the conduits that are on the proposed new wall area, wait until the new wall is built then re run them so that they go down the new wall into the ground where the conduit will change from EMT conduit to PVC. Once in the ground we will extend the conduits to the new panel locations & reconnect them in the same manner as the existing. 1. Prevailing Wages have been included in this bid proposal 2.
