HomeMy WebLinkAbout2AIICITY COUNCIL STAFF REPORT DATE: MARCH 25, 2021 PUBLIC HEARING SUBJECT: CITY COUNCIL REVIEW OF THE CONDITIONAL USE PERMIT ISSUED FOR WELL IN THE DESERT, LOCATED AT 441 SOUTH CALLE ENCILIA, LSC ZONE (CASE 5.1419 CUP). Ready, City Manager BY: Development Services Department SUMMARY This is a request for City Council review of the Conditional Use Permit (CUP) that was issued for the Well in the Desert (WITD) facility at 441 S. Calle Encilia in June 2017. As a condition of approval of the amended CUP, the City Council is required to provide a review of the facility at a public hearing in March 2021 ... As a function of this review, the City Council may allow the operation to continue under the current conditions of approval, modify the conditions of approval to address impacts or concerns, or consider other options for the facility. RECOMMENDATION: Conduct the 18-month review of the Conditional Use Permit for the Well in the Desert facility, modify any conditions of approval as may be warranted, and set a date for the next review; or, as an alternative, direct staff to pursue alternate locations for the Well in the Desert facility. BACKGROUND INFORMATION: 06/07/17 06/14/17 The City Council approved a fee waiver for the Conditional Use Permit a lication filed b Well in the Desert Case 5.1419 CUP . The Planning Commission held a public hearing on a Conditional Use Permit for the Well in the Desert Facility, and voted 6 to O to recommend approval of the application to the City Council subject to conditions. '2...A J:. r.. 2City Council Staff Report March 25, 2021 --Page 2 Case 5.1419 , __ Related Relevant Citv Actions 06/21/17 The City Council held a public hearing on the application and voted 3 to 2 to approve the Conditional Use Permit, subiect to conditions. The City Council conducted a six-month review of the Conditional Use Permit at a public hearing, and voted 5 to Oto review the permit again 02/07/18 in 18 months. In reviewing the item, the Council recommended that Well in the Desert consider extending its service hours, conduct a patron education program addressing trespassing and loitering, improve the landscape, and fully comply with securitv reauirements. The City Council conducted a 24-month review of the Conditional Use 09/18/19 Permit at a public hearing, and voted to 5 to O to modify the conditions of approval to include additional conditions relative to security, hours of operation, and neighborhood outreach. The City conducted a community meeting at the Police Training Center 2/11/20 to discuss the Well in the Desert operations and take input from community residents and businesses relative to any issues associated with the facility. The City Council approved an amendment to the conditions of approval 06/11/20 for the Well in the Desert facility to allow the applicant to construct an outdoor shade structure behind the buildinq. The City conducted a virtual community meeting to discuss the Well in 09/30/20 the ·Desert operations and take input from community residents and businesses relative to issues associated with the facilitv. The City Council review of the Conditional Use Permit for Well in the 03/11/21 Desert was continued to a date certain of March 25, 2021, due to an error in the mailed notices for the public hearina. ------Neiqhborhood Notice -Public hearing notices were mailed to all residents and tenants within 03/11/21 650 feet of the subject site. Electronic notices were sent to all registered neighborhood organizations within one-half mile of the subject site. Field Check -. >; 11/05/20 -Code Compliance staff inspected the site on a weekly basis to review 02/28/21 conformance to conditions of approval; reports from the inspections are included as Attachment #4 to this staff report. The WITD organization moved into its current facility at 441 S. Calle Encilia on July 1, 2017, following approval of a CUP for the use. The WITD facility serves as a cooling center during the summer months, as a warming center during the winter months, and as a year-round drop-in center for homeless individuals. WITD also provides space for counseling and employment services, case worker services, and general administrative functions. 311, City Council Staff Report March 25, 2021 --Page 3 Case 5.1419 As a condition of approval, the City Council has required periodic reviews of the CUP at noticed public hearings. The purpose of these reviews is to assess conformance to the conditions of approval and review any impacts of the operations. Pursuant to the City's Zoning Code and in accordance with the testimony provided at the public hearings, the City Council has the option of allowing the operation to continue, modify the conditions of approval to address impacts or concerns, or begin proceedings to revoke the CUP. At the September 2019 review of the operation, the City Council amended the conditions of approval based upon the reports and testimony that was provided at the public hearing. The following conditions were amended or added: • The hours of operation were amended to allow extended hours during periods of extreme cold or precipitation (Condition #PLN 1 ). • The hours for having security personnel on site were modified to 1-1/2 hours prior to opening and 1-1/2 hours after closing (Condition #PLN 7). • A review date of March 2021 was scheduled (Condition #PLN 17). • The requirement to maintain a daily register of transportation of individuals was eliminated (Condition #PLN 18). • A requirement for the establishment of a security plan, subject to review and approval by the Police Department, was added (Condition #PLN 22). • Standards for on-site security personnel were established, including the requirement for certification of security personnel (Condition #PLN 23). • A requirement for the applicant and the Police Department to hold quarterly meetings was residents was added (Condition #PLN 24). The applicant requested an amendment to the CUP in May 2020 to allow the construction of an outdoor shade structure as a means to address social-distancing requirements during the COVID pandemic. The amendment to the CUP was approved by the City Council on June 11, 2020, with a condition that the outdoor shade structure only be used while mandatory social-distancing protocols were in place or during extreme weather events. The City Council further directed the applicant to ensure compliance with the CUP and provided staff with discretion to determine the appropriate signage to address loitering. In regards to its operations, WITD has provided statistics on the number of patrons served and the types of services provided at the facility during 2020. The Code Compliance Division has been performing weekly property inspections since March 2020 to identify any property violations generally; copies of the inspection reports for the last four months are included as Attachment #4 to this staff report. While the facility is generally in conformance to the adopted conditions of approval, there have been compliance issues with several of the conditions as listed below: • Condition ADM 6: The condition requires that the property be properly maintained and free of trash and debris. While maintenance of the property has been a ongoing issue, efforts by the organization over the last several months have resulted in improved conformance to this condition of approval. New landscape plantings have been added to the property by volunteer labor, and Code Compliance reports that WITD staff has been observed collecting trash and cleaning the outdoor areas after hours. • Condition PLN 7: The condition requires that on-site security be provided 1-1/2 hours prior to opening and 1-1/2 hours after closing. Reports from Code Compliance staff indicate that security personnel are not always on site for the required timeframe before and after the hours of operation. However, it must be noted that inspections by Code Compliance are periodic and staff has not been on site on a daily basis to observe the presence of security personnel. • Condition PLN 8/ADM 1 O: These conditions prohibit patrons from loitering on the subject site or on adjacent parcels while the facility is closed, or from creating any disturbance while on site. Code Compliance staff has occasionally observed individuals loitering on the subject site after the facility is closed, and the issue of 5City Council Staff Report March 25, 2021 -Page 5 Case 5.1419 loitering continues to be an ongoing concern. As has been stated at previous hearings, the applicant does not have the authority to enforce loitering issues on the adjacent parcels, and reports from the Police Department indicate that the issue of loitering has significantly increased in the area over the last several months. • Condition PLN 9: The condition request the applicant to maintain adequate lighting at building entrances and stairwells between sunset and sunrise. A violation of this condition was reported in September 2020; Code Compliance issued a notice of violation, and the issue was resolved in December 2020. • Condition PLN 14: The condition prohibits any outside storage on the subject site. Code Compliance staff has noted that clothing, chairs, and tables have been observed outside behind the facility. The applicant has requested a modification to the conditions of approval to allow the use of clothing racks outside the facility, so that patrons may have access to clean clothing; City Council would need to modify this condition of approval to allow the use. • Condition PLN 19: This condition limits outside seating areas to the new shade structure (approved by City Council on June 11, 2020). WITD has set up chairs in the parking lot at the rear of the property for an outdoor smoking area, which is in violation of the condition. The applicant has also requested that this condition be modified to allow an on-site area for patrons to smoke. • Condition PLN 23: The condition requires that each WITD security person be certified through the State, and that security personnel wear uniforms. While WITD has provided copies of certification for staff members, the security staff has not always been observed wearing uniforms as required when Code Compliance staff has inspected the site. While new conditions of approval could be added to address these continued issues with maintenance and operations, monitoring the operation for conformance to the conditions requires a significant commitment of staff time and resources. Police Report Another purpose of this review is to assess the secondary impacts of WITD operations to adjacent properties. The Police Department has performed an analysis of its calls for service in the area for the period covering June 2018 to March 2021; the accompanying statistics are included as Attachment #3 to this report. The statistics show a continued increase in the calls for service within the expanded service area around the WITD. It should be noted that calls for service do not directly translate to citations or arrests, and in some cases a reported call for service is self-initiated by the Police Department when doing individual property checks. The Police Department has provided the following analysis of the calls for service: • Overall calls for service within the area have increased significantly in 2020 when compared to the statistics from 2019. Part of this increase can be attributed to the 6City Council Staff Report March 25, 2021 -Page 6 Case 5.1419 fact Police staff have initiated more frequent patrols and property inspections in the area. However, there has been an increase in the number of homeless individuals in the area over the last 12 months, which may in part be attributed to conditions related to the pandemic, as well as the availability of services such as Project RoomKey and WIT•. • The number of calls for service that may be directly attributable to homeless individuals also increased significantly in 2020, when compared to statistics from previous years. There were 575 calls for service related to homeless individuals in the period from June 2019 to November 2019; this number increased to 794 calls for service between December 2019 and May 2020, and increased again to 924 calls for service between June 2020 and November 2020. • The number of arrests related to homeless individuals has generally held steady during the reporting period, with the exception of the period between June 2020 and November 2020, where the number of arrests within the area dropped significantly. The number of arrests for the first half of the new reporting period are tracking slightly less than the number of arrests for 2019 and the first half of 2020. Since the previous review of the Conditional Use Permit in September 2019, the Police Department has developed a security plan for the WIT• facility, maintained a list of the certified security personnel that are responsible for patrolling the subject site, and increased the frequency of inspections at the property. While conditions on the WIT• site have generally improved, the secondary impacts of the facility and the general increase in the homeless population in the area have resulted in challenging conditions for area residents and businesses. Request to Modify Conditions The applicant submitted a letter to the City, dated March 1, 2021, requesting to amend the conditions of approval as part of this required review. The applicant's requested amendments are as follows: • Allow the use of clothing racks in the courtyard area behind the tenant space; • Allow an outside smoking section at the rear of the property in the back parking lot; • Allow a tent on the property for outside gatherings or activities; • Discontinue the quarterly meetings with area residents; and • Request that reviews of the Conditional Use Permit occur every two years, or that the reviews be discontinued. The City Council may consider these requests to modify the conditions of approval as part of this review, or may maintain the conditions of approval as currently adopted. 7City Council Staff Report March 25, 2021 -Page 7 Case 5.1419 CONCLUSION: While WITD continues to provide a necessary service for homeless individuals in the community, the secondary impacts of the facility to surrounding properties continues to be a concern. The City Council may allocate additional resources to address issues of general welfare in the area, or direct staff to evaluate alternate locations for the WITD facility. Thank you very much . . 1. Request for the Council to sanction use of clothing racks outside, by our courtyard, so that our clients may have access to clean clothing. I spoke with you about that months ago, and we have been doing it without their approval. Were It not for the Well our clients would not have access to clothing. 2. Request for Council to sanction use of the smoking section out in back of property. We put 4 chairs out there and people take smoking breaks of 15 minutes. Keeps them from congregating out In front. we had complaints months ago and after speaking with then Mayor Geoff Kors, who liked the idea, set it up, It has definitely kept our clients from loitering in front or on sides of building. 3. Request to CouncU to allow us the possibility of putting up a no-sided tent In the back if and when a group wishes to present an activity, like bingo, poetry readings, art, etc. Covid standards would prevail. Not sure this would be necessary but want to be within the CUP if we did do it. 4. Do away with the quarterly meeting of neighbors and Well. These have not been positive, or effective in bringing good change; they have basically been gripe sessions of some neighbors who hate us, and will continue doing so forever. S. If a CUP is considered something necessary in the future, then we suggest it be yearly, every two years, or not at all. Let the standards set forth in the CUP, the one to come, be our guide. We have fulfilled all of its requirements and have no plans to change how we comport ourselves there. Captain Mike Kovaleff Analysis of The Well in the Desert The Police Department has completed an analysis of The Well in the Desert utilizing the boundary map below. The analysis included all of the addresses between Arenas Road, South Calle El Segundo, South Cahuilla Road, and the Tahquitz Creek Channel. 263/16/2021 Page 2 of 2 PSPD compiled statistics for the total calls for service within the designated boundaries that were analyzed in six-month time frames with the exception of the past three months. The calls for service were also analyzed by narrowing the search to calls for service known to be involving a member of the homeless community. Arrest related statistics have been fairly consistent during the time frames analyzed and did not reveal anything significant. The nature of the complaints include the report of verbal and physical disturbances, check the welfare calls, public intoxication, mental health calls, medical assistance calls, drug use in public, drug sales in public, trespassing, thefts, burglaries, vandalisms, disturbances, trespassing, littering, urinating and defecating in public, and park curfew violations. We also receive complaints about public camping in many of these areas, including bus stops and sidewalks. Over the past year, PSPD has frequently received complaints regarding homeless issues at Baristo Park, the Downtown Parking Structure, the parking and/or vacant lots surrounding the Well in the Desert, nearby businesses, nearby residential areas, the majority of commercial properties between Baristo Road, Belardo Road, South Indian Canyon Drive, and Sunny Dunes Road. As a result, PSPD has had to direct resources to these areas throughout each day and night in an_ attempt to resolve the nature of these complaints. Unfortunately, the issues generally move to new or past locations which generate new complaints, leading to additional resources being directed to the area. Upon arrival on 11/05/20 Code Supervisor David Recio and myself observed two people out front on the sidewalk of the property that seemed to be hanging around. Being that the Well was closing the tents along with the clothing racks were not set up. The clothing racks however were back up today(l 1/6/20); since this issue is currently known to the city and further guidance on the issue has been requested no pictures of this were taken. We asked to speak with Ms. Rosenthal on 11/5/20 however we were informed that she had left for the day and were advised by Tim who identified himself as a security guard to return between 1 :30pm -3:30pm on 11/06/20. We went back out to the Well later that night (11/05/20) to check on the lighting and found that the entrance of the building that faces Calle Encilia remains with out lighting. The entrance at the back of the building remains with motion activated lighting. Upon arrival today 11/06/2020 Code Officer Mitch Nabhan and I made contact with Ms. Rosenthal and informed her of our findings with regards to the lighting and the fact that the entrances/exits to their main building remain with out steady illumination. Ms. Rosenthal was visibly upset and interjected that maybe I should put up the missing lights; she then proceeded to inquire as to what specific location needed lighting I informed her that the entrance facing Calle Encilia had no lighting and that the back entrance also needed steady illumination not motion activated lighting. Ms. Rosenthal stated that rear entrance (which is located on the west side of the building) already had lights she then mentioned the front would be taken care of. I also talked with Ms. Rosenthal about the need to have security; she stated there was security on site as required. I asked if her security wore clothes that identified them as security she then stated that they did some of the time but not always. She proceeded to state that all of the people that frequent the Well know who the security members are, she also mentioned that they did not need to use identifying clothing since this was something that the people who frequent the Well did not really like or felt comfortable around. Ms. Rosenthal then proceeded to state that she had sent the pertinent information of their security personnel to all the people at the city that needed to know this information; finally she stated that all security guards had their guard cards. Arlene Rosenthal, on behalf of the Well in the Desert organization, has filed an application to amend the conditions of approval for the Conditional Use Permit to allow the installation of a shade structure and misting system on the property; and C. The project shall conform to the conditions contained herein, all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, and any other City County, State and Federal Codes, ordinances, resolutions and laws that may apply. ADM 4. Minor Deviations. The Director of Planning or designee may approve minor deviations to the project description and approved plans in accordance with the provisions of the Palm Springs Zoning Code. ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 120Resolution No. 24766 conditions of Approval 5.1419 CUP -Well in the Desert at 441 s Calle Enema Page2 of7 June 11, 2020 5.1419 CUP. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. ADM 6. Maintenance and Repair. The property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation all structures, sidewalks, bikeways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all -applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner's sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. ADM 7. Time Limit on Commencement of Use. The time limit for commencement of the operation authorized by this conditional use permit shall be prior to the term limit imposed in Condition of Approval No. PLN 1 below. ADM 8. Revocation or Voiding of Conditional Use Permit. Approval of this Conditional Use Permit is subject to all terms and conditions outlined herein and pursuant to Zoning Code Section 94.02.00(1). ADM 9. Public Art Fees. This project is excepted from paying public art fees as a nonprofit social service, pursuant to Section 3.37.050(b)(4) Palm Springs Municipal Code. ADM 10. Cause No Disturbance. The owner shall monitor outdoor parking areas, walkways, and adjoining properties and shall take all necessary measures to ensure that customers do not loiter, create noise, litter, or cause any disturbances while on-site. The owner and operator shall ensure that at closing time, all customers leave the property promptly and that the property is clean and secure before the owner/operator leaves the premises. The Police Chief, based upon complaints and/or other cause, may require on-site security officers to ensure compliance with all City, State, and Federal laws and 121Resolution No. 24768 Conditions of Approval 5.1419 CUP -Well In the Desert at 441 S Calle Enema Page3 of7 June 11, 2020 conditions of approval. Failure to comply with these conditions may result in revocation of this permit, temporary business closure or criminal prosecution. ADM 11. Grounds for Revocation. Non-compliance with any of the conditions of this approval or with City codes and ordinances, State laws; any valid citizen complaints or policing and safety problems (not limited to excessive alcohol consumption, noise, disturbances, signs, etc) regarding the operation of the establishment; as determined by the Chief of Police or the Director of Building and Safety, may result in proceedings to revoke the Conditional Use Permit. In addition, violations of the City Codes and Ordinances will result in enforcement actions which may include citations, arrest, temporary business closure, or revocation of this permit in accordance with law. ADM 12. Comply with City Noise Ordinance. This use shall comply with the provisions of Section 11.74 Noise Ordinance of the Palm Springs Municipal Code. Violations may result in revocation of this Conditional Use Permit. ENVIRONMENTAL ASSESSMENT CONDITIONS ENV 1. Notice of Exemption. The project is exempt from the California Environmental Quality Act (CEQA); therefore, an administrative fee of $64 shall be submitted by the applicant in the form of a money order or a cashier's check payable to the Riverside County Clerk within two business days of the City Council's decision on the project. This fee shall be submitted by the City to the County Clerk with the Notice of Exemption. Action on this application shall not be considered final until such fee is paid. PLANNING DEPARTMENT CONDITIONS PLN 1. Hours of Operation. The operating hours shall be limited to 7:30 A.M. until 6:00 P.M. daily. The hours of operation may be extended to 8:00 p.m. during periods of extreme weather, including the following: • Extreme heat (defined as temperatures in excess of the average dally high temperature); • Extreme cold (defined as temperatures below the average daily low temperature); or • Excessive precipitation (defined as rain or other precipitation in excess of daily norms). No overnight occupancy shall be permitted. Any modifications to the hours of operation shall require an amendment to this Conditional Use Permit. PLN 2. Changes in Operation. Any transference of this Conditional Use Permit upon change of ownership is subject to review and approval by the City. PLN 3. Maximum Number of Occupants. Occupancy of the tenant spaces shall not exceed the following limits: • Suite #3: 19 persons • Suite #4: 6 persons • Suite #5: 17 persons The occupancy limits listed above include both patrons and staff members, and shall remain as listed unless otherwise amended by the Director of the Building & Safety Department. PLN 4. Permitted Services. The applicant shall be permitted to maintain a cooling center (seasonal) and drop-in center (year round) with associated activities for homeless individuals, offer counseling services, offer employment services, offer case worker support, and maintain general administrative office functions. No other services shall be offered, unless an amendment to this Conditional Use Permit is approved pursuant to the procedures identified in PSZC Chapter 94. PLN 5. Food Service. The applicant is prohibited from providing meal service to patrons at the facility. Meal service may be provided at approved off-site locations. While meal service is prohibited, water, soft drinks, and pre-packaged food items may be provided to patrons while using the facility. PLN 6. Distribution of Food and Other Commodities. No mass distribution of food, clothing or other similar commodities is permitted at the subject site. PLN 7. On-site Security. The applicant shall be required to provide private on-site security personnel a minimum of one and one-half (1-1/2) hours prior to opening hours and for one and one-half (1-1/2) hours after closing hours. PLN 8. Loitering. Patrons of the facility shall not be permitted to loiter on the subject site or on adjacent parcels. On-site security shall be responsible for monitoring and reporting incidents of loitering. PLN 9. Lighting. The applicant shall be required to provide and maintain adequate lighting at all entrances and stairwells in the office complex. Building entrances and stairwells shall remain illuminated between sunset and sunrise. PLN 10. 24-Hour Contact Number. The applicant shall be required to maintain a 24-hour contact number visible and available to the public to report any disturbances or issues related to the facility. PLN 11. Additional Maintenance Requirements. No signs are approved by this action. Separate approval and permits shall be required for all signs in accordance with Zoning Ordinance Section 93.20.00. PLN 13. Exterior Alarms & Audio Systems. No sirens, outside paging or any type of signalization will be permitted, except approved alarm systems. PLN 14. Outside Storage Prohibited. I see there is a Council meeting on March 25th to review the Well of the Desert. I am one of the residents in a neighborhood within a mile of that location. I fully understand the compassion and inclusive point of view in offering services to the homeless. However---at some point, adjoining resident's quality of life issues have to be taken into consideration. I live adjacent to the intersection of South Belardo and Mesquite, with extensive undeveloped tribal land. This area has become one of the more popular areas for "camps", with the associated trash and filth from lack of sanitation. This is the intersection heavily used by people walking up Mesquite to hike the Lykken Trail, plus many ofus residents who walk and walk our dogs here, and countless tourists walking and bicycling along south Belardo. 1 133Two weeks ago I watched the PSPD come into this area and tell all camped homeless to leave. I also watched the very next day as the homeless came right back and set up camps. Arguably this is a rediculous waste of police resources and solves not a single problem. I am aware of the Boise court ruling regarding homeless use of public property when shelter space is not available. I had a rather lenghty conversation with the tribal "acting liaison" on Palm Springs homeless. He expressed (their) frustration with lack of enforcement by the City in removing homeless camps from tribal land. Although, comically, as he pointed out, between their Dinah Shore office building and Walmart the (PSPD) has moved homeless off of tribal land and now they to camp in the street---1 did notice this myself. An attempt, I guess, to mollify the tribe. I am asking you all to consider the damaging impact of the homeless on our (immediate) surrounding neighborhoods----! think it's fair to say we cannot even quantify the negative impact. But it is endless theft, vandalism, encroachment, loitering, and a constant feeling of insecurity not to mention degradation of property values. And I do understand that not all crime is committed by homeless. I understand the issue of NIMBY. But how, year after year can you say to the residents in this area, 'too bad, tough luck', we are going to extend the use permit for the Well with the consequent impact on the same neighborhoods? The epicenter of homeless presence next to Castaneda's and across from IHOP is a complete emabarrassment to this City. Better that you (the tribe) should put a construction-type curtain around that block to, at the very least, not expose the tourists to that awful scene, whose monetary spending gives so many of us here a comfortable way of life. That Indian Canyon Sunline stop often looks like something out of a dystopian furturistic disaster movie. 2 134Last week I watched a homeless man peeing on the south Palm Canyon Rite Aid building not ten feet, literally, from the front door. Councilmembers and mayor, when is enough enough? I am in the dark, like most residents I talk to, as to the plans for the $10 million state grant. I understand nothing at City Hall happens overnight, but I hope some sort of very positive resolution of this issue is as imminently forthcoming as possible. We all hear and read of motel conversions for homeless housing. Are you aware of just how frightening a scenario that picture paints? Every week we supervise 8 to 10 nursing students two days per week to provide healthcare to the homeless and housing unstable people who come to the Well in the Desert sponsored free lunch program at Our Lady of Guadalupe Church in Palm Springs or on Saturdays at the Well. The students also spend time talking to and educating the people at the Well. We could never have developed the Nursing Street Medicine Program in Palm Springs without Arlene and the Well. They help us put up the canopies, set up tables and chairs and encourage people to have their vital signs, blood glucose, wound care, medication and chronic disease management, health teaching and promotion. When the pandemic hit the Valley, most hospitals stopped allowing student nurses to do their clinical experiences there. Without the Program and the Well support, our psych mental health and community health nursing students would not have had a clinical experience and might have been delayed in their graduation date. My grandmother is an elderly woman that has lived in this community for various years. The community is aware that on March 11, 2021 you plan to discuss the topic of "Well in the Desert" on March 11111, 2021. We are also aware that the City Council and City Manager have already given the green light for business to continue in its current location. Despite ongoing communication from the community which have raised serious concerns, the City Council and City Manager do not care about the safety and well-being of its community members. We strongly feel that the purpose of this meeting should emphasize on revoking the current permit that has been granted. The following are severe occurrences that have taken place that have severely disrupted the quality of life and safety of our community: 1. Increase in crime 2. Drug trafficking 3. Increase in drug use/abuse 4. Public sex 5. Public nudity 6. Urinating and defecating on private property 7. Using private pools to bathe 8. Creating an unsafe environment especially for children and seniors 9. Disrupting the peace I share the same frustration and concerns that various of the community members hold. Our frustration stems from the ability to destroy community through the abuse of power by the City Council and City Manager. They have enabled this business operator to continuously interrupt 151and abuse the quality of life for the members of our neighborhood by turning a blind eye to serious concerns. We are aware that Ms. Rosenthal has read emails which address our concerns and her response has been to make false accusations such as "they hate homeless people" and they are anti-semitic." Aside from these being false accusations, these accusations are a defamation of character in order to avoid taking responsibility. These responses have shown to be irresponsible and unprofessional. The sever occurrences listed above shows behavior that is not only criminal, but should not be tolerated regardless of who is committing it or where it is being committed. At a council meeting, former Mayor Moon shared that Ms. Rosenthal has been removed from 5 other locations and that he doesn't have the heart to remove her from another location. He did not mention the reasons but it is apparent that there must have been severe concerns as in this case. "Well in the Desert" should close its doors in our community and be relocated to a more appropriate area that does not endanger or expose citizens to inappropriate and illegal activities. Please let this notice serve as a formal documentation that raises serious health and safety concerns to our community. You the Council And City Manager have had a major role in allowing this business to operate violating rules and regulations for years. After the stabbing of the young person on Wednesday morning, who we hope recovers, I am going to reach out to those businesses and relay what our Council and City Manager have done to create this situation . After listening to the news they too have been victims of the location of the Well. The quality of life has been shattered for a long long time because of the location of this business. And because of the lack of accountability and oversight of this business crime is out of control and our community is now a dangerous place to live. Where were the security on July 1,2017 where it called for in the CUP. Not one day or even one minute for the first 2 years, and then our city leaders changed it to her employees to take on this job, with complete failure. This is truly a fire code violation and a CUP violation, along with many more. Is there any leadership in this city who has the integrity to stand up to Ms Rosenthal. After talking to the Assistant City Manager he informed me of the upcoming City Council meeting in March where you are planning to address this business and weather to revoke the CUP or extend it. Being with the council's present and past experience with your hearings where the residents and businesses get there 2 minutes and Ms Rosenthal is allowed to speak beyond her time limit. A definite and unfair process. Your practice of hiring YES MEN, I am referring to the Police Chief, City Manager, and City Planning Director, who at these hearings delete facts, and distort the truth so the city council feels better when they vote against the residents and businesses is outrageous. We are not stupid or dumb we know one of the reasons this business has been allowed to operate at this location is because the council controls this location. The residents and businesses even with there creditable complaints of crime, chaos and continued CUP Violations at every council meeting and community meetings nothing changes.Being this is the 6th location for this business and her unwillingness to comply with the CUP since July 1,2017 to present it's time to start doing your job and revoke this CUP. I am going equate what this council, past and present has done to our community and businesses for nearly 4 years what Donald Trump did to our nation for 4 years. As Trump surrounded himself with yes men you the council have done the same. You have lied and cheated our community and businesses for nearly 4 years now, as Trump did to our nation. You have cheated out our community and businesses our quality of life. You lied to the community by telling us Ms Rosenthal is a woman of integrity, she knows what she is doing and will make it work. You should have been honest and tell the community up front, the Well has been removed from 5 other locations, and expect a large increase of crime. The city leaders in there attempts to mitigate the anticipated impacts this business was to bring to the community drew up a CUP to counter what was and now has come to be, crime, drugs and complete chaos. Because of years of no accountability or oversight of this business owner Ms Rosenthal new she did not have to comply with this city document, there would be no repercussions. She has continued to get her yes votes from the council. Also I was called out yesterday afternoon for work as I was leaving my home two of the Wells clients are on our property smoking a crack pipe and I called the police and waited. White I was waiting another client from the Well comes over for a puff then goes back. As I am still waiting a white Honda Civic is driving around and stopping at all of the Wells clients to sell drugs. This is now a daily activity in this community. If you need Heroin, cocaine, meth, or any illegal drug come to the Well. Also the Well is supposed to have there security on duty for 3 hours after they close to prevent these situations, no one present. See ADM 10 , PLN 7, PLN 8, these are the continued CUP violations that this business continues to violate and many more. If none of you have a copy of the CUP you need to have one and read this city document. Very important that you read ADM 11, ADM 8 and ADM 10. An elderly woman who owns a condo here comes to enjoy her weekend in Palm Springs with her pet. As she goes to the elevator to take her dog for a walk she encountered a individual laying in the elevator, a client of Well In The Desert, she proceeds to call another homeowner who then calls the police at the same time another owner confronted the individual and told him to leave. At that point I came across the individual and called the police. I continued following this individual where he returned back to the Well. The point I am trying to make is you can't even walk a pet in this community without issues. It's outrageous that not one city leader including our district representative Geoff Kors has come to the aid of the residents and businesses with what this business has done In our community. We understand Christy Holstege is a board member of the Well, it's no excuse for her to sit back and do nothing for fear of loosing her position in that organization, it's time for her and all the city leaders to stand up for our community and businesses that have been plagued by this business for 3 years 6 months and 3 day's, at least you go down fighting for the people instead of Ms Rosenthal. This is also a good time to remind you all that the CUP was prepared to mitigate and I repeat mitigate the affects this business was going to have in the community. Upon my arrival home I observed 2 men in our community passing back and forth to each other a crack pipe. I immediately called the police department and as I was on the phone with the dispatcher one of the men entered the property and started to go through the parking garage, another resident approached the man and told him to leave the property, at which time I started to follow him. As he was leaving the property he attempted to burglarize a vehicle in the parking lot, I told the man to get out of the car and he did, at which time the police officer arrived. This man was arrested and taken away. The other man who was in a wheelchair smoking his drugs left and don't know the outcome. The incident is a continual problem that has been going on in our community since the arrival of the business Well In The Desert, July 1,2017. The reason for zoning laws is to locate businesses in areas of the city so as not to impact residents and businesses. By the council's approval to allow this business to operate in an area it is not zoned for has created significant crime increases. Our community is tired of the crime and chaos this one business has brought to this community. The incident is not the first or last, it is a continuation of what your yes votes have done to residents and businesses, a loss of quality of life. The business is still not in compliance of the Conditional Use Permit. There has not been 1 day since opening that this business has been in compliance of the CUP. Your city documents state that violations of the CUP are grounds for revocation of the permit, start doing your job, and return this community back to some sort of normalcy. I will remind you all of the purpose of this document: That the conditions to be imposed and shown on the approved site plan are deemed necessary to protect the public health, safety and general welfare and may include minor modification of the zones property development standards. As there are Concerns about the secondary Impacts of the proposed use, conditions of approval are Necessary to Mitigate those impacts and protect the public health, safety and general welfare. Conditions of approval are included as an attachment to the CUP, and are intended to address the anticipated impacts. The following are the violations that have been going on for Years and are continuing as you read this, with All city leader's having full knowledge of this, and taking NO action either with fines, citations or revoking of the CUP. ADM 3-Conform to All codes and regulations, the project shall Conform to the CUP. ADM 5-Indemnification-Because of no action by City leaders to enforce the CUP and continued knowledge of violations with no action, the city is now liable for damages. The full City Council, City Attorney, City Manager, Planning Director, Police Chief. ADM 10-Cause no disturbance, there are constant fights that constantly disturbs the community. Planning Department Conditions; PLN-1-Hours of operations, the CUP states opening hour is 7:30am, this business opens up at 7:00am and sometimes earlier. Ms Rosenthal's representative at the community meeting stated they open daily at 7:00am, a clear violation. PLN -7-Security, violated this for the first 2 years with no onsite private security, the full 2 years. 2 years later the council voted to take away private security, that Ms Rosenthal never provided, and have her employees take on this responsibility with little accountability. They are to be on duty 2 hours before opening and 3 hours after closing to prevent loitering, not being done. PLN -8-Loitering, Patrons routinely are allowed to loiter adjacent parcels and security does nothing. PLN-9-lighting, there has been no adequate lighting since opening July 1,2017. Even with a change to the CUP at the June council meeting where all members again gave yes votes to allow a structure with a misting system and to have adequate lighting to help prevent overnight loitering, no lights PLN-11-Additional Maintenance Requirements, the applicant has removed boarded and secured units within the subject office complex for there use, without council approval. PLN -14-Outside storage prohibited, business continues to store items outside after closing. Recently there clients have removed chairs from this business to use at the lot to the south, thus the reason for this item. PLN-20-Fire Prevention, with the business using space not approved in the CUP, they have not been inspected by the Fire Department. PLN -21-Expansion of tenant space, no expansion of tenant space without council approval, business is using a room at back of property and a space just west of there approved area. Fire Department Conditions FID-1-because the business is using space not approved in the CUP, this is a clear violation. Because of Ms Rosenthal's continued violations and her unwillingness to comply for 3 years, 3 months, and 3 weeks, we are demanding the following. 1 172ADM-8-Revocation or Voiding of Conditional Use Permit. Approval of this CUP ls subject to All Terms and Conditions outlined herein and pursuant to Zoning Code Section 94.02.00(1). ADM-11-Grounds For Revocation. NON-COMPLIANCE with ANY of the CONDITIONS of this approval or with city codes and ordinances, state laws; any valid citizen complaints or policing and safety problems( not limited to excessive alcohol consumption, noise, disturbances, signs, etc.) regarding the operation of the establishment; as determined by the Chief of Police or the Director of Building and Safety, may result in proceedings to revoke the CUP . In addition, VIOLATIONS of city codes and ordinances will result in enforcement action which may include citations, arrest, temporary business closure, or revocation of this CUP in accordance with law. Our residents and businesses and community are tired of the Chaos, the Crime, and this situation is now and has been affecting the quality of life of residents and businesses. The residents and businesses were told back in 2017 that Ms Rosenthal is a woman of integrity and she would make this work it will get better. Problem was it was good already until she opened her business at this location. It's been going downhill ever since. Our community has been lied to and cheated by our city leaders. We are tired of a city council that sits back and does nothing, with the exception of granting yes votes, and giving this business taxpayer dollars with NO ACCOUNTABILITY. The council has tied the hands of Code Enforcement, there inability to cite and fine this business has allowed Ms Rosenthal to do just what she wants. Ms Rosenthal has been removed from 5 previous locations with this being the 6th , all because of a city council that does not make her accountable for the taxpayer dollars she receives and the CUP she is required to follow every day she is opened. Ms Rosenthal's representative at the community meeting stated, they are tired of the constant harassment of code enforcement of there business, and not one city leader challenged that statement, it's no wonder Ms Rosenthal does not follow rules and regulations. Another disturbing item of interest, upon looking at Christy Holstege's bio on the internet it seems she was once on the Board Of Directors for Well In The Desert, explains all of her yes votes. I will be looking forward to find out more of what we citizens and businesses can do legally to address this conflict of interest. Also on Monday I check up on some senior citizens that live in our community and as I got to her condo there was a suspicious person at her door and she informed me that this was the 2nd time at her door, he seemed high on something and did not know where he was, I called police and after watching him for SO minutes he left the property and area, no police showed up. The picture is of Wednesday after I got home from work a renter came to me and said a person went to our trash enclosure and defecated there. It seems after the community meeting with Well In The Desert and the community concerns about this business there seems to be a lack ofresponse now. You also need to know that at that community meeting the representative of Well In The Desert made a statement that this business is tired of the constant harassment of code enforcement, are you kidding me!, the men and women of the the police department are the only people out there trying to get this business in compliance with NO help from City leaders. What is most disturbing about the comment is that not one person in our city, the Mayor, Ms Holstege, the Police Chief, Police Captain , City Manager did not challenge that statement, they just let it go, I far as I am concerned they are not city leaders.
