Formal City Council acceptance of the Digester No. 2 Cleaning Project, City Project No.
20-23, is required to document the completion of the public works improvements and to
allow the City's filing of a Notice of Completion with the Riverside County Recorder in
accordance with Section 9200 of the California Civil Code.
RECOMMENDATION:
1. Accept the public works improvements identified in the Digester No. 2 Cleaning
Project, City Project No. 20-23, as completed in accordance with the plans and
specifications; and,
2. Authorize the City Engineer to execute and file for recordation with the Riverside
County Recorder a Notice of Completion for the Digester No. 2 Cleaning Project, City
Project No. 20-23.
BACKGROUND:
On September 10, 2020, the City Council authorized issuance of a Notice to Proceed to
Veolia Water West Operating Services, Inc., a Delaware corporation, for the Digester No.
2 Cleaning Project, City Project No. 20-23, (the "Project"); a copy of the staff report is
included as Attachment 1.
STAFF ANALYSIS:
Construction of the Project began on September 10, 2020 and was accepted and
substantially completed on November 30, 2020. Throughout the construction of the
Project, there was one contract change order in the amount of $9,833 and it is generally
described below.
• Construction Contract Change Order 1 (CCO1) in the amount of $9,833, was
added for rental of blowers to ventilate.

The final construction cost of the Project increased by $9,833 from the original awarded contract amount of $87,985, for a final contract price of $97,818. This represents a net increase to the contract of approximately 11.2%. As determined by City Staff, Veolia satisfactorily completed the Project on November 30, 2020. Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the City Engineer to file and record a Notice of Completion to be submitted to the County, is included as Attachment 3. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," the requested action is considered a Class 1 project consisting of the minor alteration of existing public structures or topographical features involving negligible or no expansion of use beyond that existing at the time of the City Council's determination. Therefore, in accordance with Section 15301, Staff has determined that approval of the requested action is considered categorically exempt from CEQA. FISCAL IMPACT: Allocate $9,833 from the Wastewater Fund-Unscheduled Capital Projects (420-6800-50000) to the Project's account (420-6800-57048) to cover additional cost of CCO1. The Project budget, incurred expenditures, and other associated costs are identified in Table 1 below. IN THE AMOUNT OF $87,985 FOR THE DIGESTER NO. 2 CLEANING PROJECT AT THE WASTEWATER TREATMENT PLANT, CITY PROJECT NO. 20-23 FROM: BY: SUMMARY: David H. Ready, City Manager Development Services Department Approval of this item will authorize Veolia Water West Operating Services, Inc. ("Veolia") to proceed with the cleaning of Digester No. 2 at the City's Wastewater Treatment Plant ("WWTP"). This action is a normal maintenance function coordinated by Veolia at the City's WWTP and is entirely funded by the Wastewater Fund. RECOMMENDATION: 1. Authorize the City Engineer to issue a Notice to Proceed to Veolia Water West Operating Services, Inc. in the amount of $87,985 for the Digester No. 2 Cleaning Project, City Project No. 20-23; and 2. Authorize the City Manager to execute all necessary documents. BUSINESS PRINCIPAL DISCLOSURE: Veolia Water West Operating Services, Inc. is a Delaware Corporation and Wastewater Solids Management Company is a Nevada Corporation. Public Integrity Disclosure Forms are included as Attachment 1. BACKGROUND: On November 4, 2015, the City Council approved a Wastewater Services Agreement with Veolia for operation and maintenance of the City's sewer collection system and the WWTP, (the "Agreement"). Section 5.3, "Capital Projects" of the Agreement provides for Veolia's management of certain capital projects to be undertaken on behalf of the City. ITEMNO. ..1.S 5
City Council Staff Report September 10, 2020 --Page 2 Authorize Veolia to Proceed with the Digester #2 Cleaning Project, City Project 20-23 The City's WWTP has two large 30 feet tall tanks called "Digesters" that collectively hold 2,000,000 gallons of semi-solid wastewater generated through the treatment process at the WWTP. These Digesters further treat the solids removed from the wastewater, ultimately disposed of as bio-solids. Digester #2 has been taken off-line and out of service to perform necessary repairs. At this time while out of service, Veolia will coordinate the cleaning of Digester #2 to remove all sludge, grit, sand, rags, plastics, grease and other miscellaneous debris, and finish by pressure washing in accordance with all regulatory requirements. The proposal also includes Veolia staff to manage the project which includes coordinating the day to day activities, construction safety, regulatory compliance monitoring, providing the necessary water and power, and coordinating around the daily operations at the WWTP. Veolia will also be providing odor control abatement during this project. STAFF ANALYSIS: In accordance with Section 5.3, "Capital Projects" of the Agreement, Veolia recommended the City authorize an "Agreed Capital Project", and in June 2020, the City authorized Veolia to proceed with the preparation of a request for proposals ("RFP") to licensed contractors who have the necessary qualifications and ability to complete the cleaning of Digester #2. Staff has identified this as the Digester No. 2 Cleaning Project, City Project No. 20-23, (the "Project"). Veolia issued a public Request for Proposals for the Project from June to July 2020, and received two bids: 1. Wastewater Solids Management Co., Yachats, OR 2. Pipe & Plant, Oakland, CA $59,960 $726,990* On August 13, 2020, Veolia submitted a formal proposal in the amount of $87,985 to complete the Project, inclusive of $28,025 for construction management support and Veolia's subcontract with Wastewater Solids Management Co. of $59,600. A copy of their proposal is included as Attachment 2. Staff has reviewed the bid proposal submitted by Wastewater Solids Management Company and recommends City Council approve the item. CITY OF PALM SPRINGS CONTRACT CHANGE ORDER To: Veolia Water West Operating Services, Inc Date: December 21, 2020 4375 E. Mesquite Ave City Project No.: 20-23 Palm Springs, CA 92264 Project: Digester No. 2 Cleaning Change Order No.: 1 (one) Purchase Order: 21-0518 Attn: Michelle Meley, Project Manager Account No.: 420-6800-57048 This Contract Change Order No. 1 provides for the cost of renting blowers for additional time, due to the cleaning subcontractor's need to reschedule the work. The blowers provided needed ventilation for the safe operation of the WVVTP. Change Order 1: Additional rental of three (3) non-combustible blowers to safely ventilate the digester. Total Change Order Amount: $9,833 Reasons for Changes: As a part of this project, Veolia O&M Group began to drain down the digester tank in preparation for the upcoming cleaning. This process took approximately 9 weeks to drain. The cleaning subcontractor is a specialized contractor that is the only one doing this type of work on the west coast. Due to conflicts with a job they were working on out of state, they were not able to start our project in late September as originally planned. The work was rescheduled to start on November 6, 2020. As the digester sat drained, there was still a need to have the three (3) noncombustible blowers, safely ventilate the digester until the cleaning began. Properly ventilating the digester is necessary for the safe operation of the Wastewater Treatment Plant. It also helped to control odors from digester. Changes to Contract Time: None. Source of Funds: Wastewater Fund (Fund 420). Add $9,833 from Unscheduled Capital Projects (420-6800-50000) to Digester No. 2 Cleaning (420-680-57048).
