Ready, City Manager Initiated by: Aviation Department SUMMARY As required under the original Memorandum of Agreement (MOA) executed in 2003 between the U.S. Customs and Border Protection (CBP) and the Palm Springs International Airport (PSP), the Airport is required to reimburse CBP for upgrading the IT equipment utilized to perform inspection services at the Airport. This request is to authorize the City Manager to sign a supplemental MOA allowing the Airport to reimburse CBP $65,487.40 to upgrade the IT equipment in 2021, with estimated out year recurring annual costs of $12,892.20. RECOMMENDATION : 1. Approve the supplemental Memorandum of Agreement to Reimburse CBP in the amount of $65,487.40 to upgrade the IT equipment in 2021, with estimated out year recurring annual costs of $12,892.20. 2. Authorize the City Manager to execute all necessary documents. BACKGROUND: The original Memorandum of Agreement (MOA) (A4695) from 2003 between the U.S. Customs and Border Protection (CBP) and Palm Springs International Airport (as shown in Attachment 1) established the User Fee Airport Program that allows CBP to perform inspections of aircraft arriving at the Airport from foreign countries. Under the User Fee Airport Program, the Airport is required to reimburse CBP for all inspection related services. The Airport last reimbursed CBP to upgrade the IT equipment in 2015. This request is to authorize the City Manager to sign and execute the supplemental MOA to reimburse CBP as shown in Attachment 2. The agreement includes the list of IT equipment CBP plans to purchase and install in the amount of $65,487.20, with estimated out year recurring annual costs of $12,892.20. CBP will purchase the IT equipment and oversee the upgrade, and will submit a final invoice upon completion to the City for reimbursement. CUSTOMS AND BORDER PROTECTION (CBP) MEMORANDUM OF AGREEMENT TO REIMBURSE CDP This Memorandum of Agreement ("MOA'') outlines the agreement between the below named User Fee Airport Owner/Operator (Sponsor) and CBP regarding the Sponsor's responsibi1ity to reimburse CBP for costs related to providing communications and information technology (IT) equipment and services at the below named User Fee Airport location. The legal authority for CBP to enter into and require such an agreement is found at 6 U.S.C. § 231; 8 U.S.C. §§ 1223-1224, 1356(a); 19 U.S.C. §§ 58(b), 1459, 1461, 1499, 1524, 1644a; 8 C.F.R. Part 234; 19 C.F.R. Part 122. Airport Owner/Operator: Palm Springs International Airport (Sponsor) Location: 3400 E. Tahguitz Canyon Way Palm Springs, CA 92262 PALM SPRINGS INTERNATIONAL AIRPORT RESPONSIBILITIES Data and Cabling Palm Springs International Airport is responsible for the procurement and installation of all data cabling and electrical components, required for connectivity of systems and equipment according to CBP Office of Information Technology (OIT) provided specifications. Palm Springs International Airport is required to provide a two week advanced notice of all cable pulls to allow CBP to observe installation. Reimbursement of Equipment and Recurring Costs Palm Springs International Airport agrees to reimburse CBP for all equipment and connectivity costs, including installation, maintenance, and recurring costs, at the Palm Springs International Airport General Aviation Facility at 210 N. El Cielo Rd, Palm Springs, CA. Current estimated equipment and service costs total $65,487.40. The estimated annual recurring costs are $12,892.20. CBP OIT's Cost Sign-Off Document Estimate, OIT Reference# PAL007A-OFO-21024C is attached. Palm Springs International Airport will be billed the actual costs for the equipment identified in CBP OIT's Cost Estimate, PAL007A-OFO-21024C, along with any outstanding reimbursements due from any previously executed agreement(s). Recurring out-year network circuit charges, and the cost of any necessary replacement equipment not covered under warranty, will also be billed to Palm Springs International Airport. Eguipment Upgrades Upgrades to CBP required equipment and connectivity may be required on a schedule determined by CBP (approximately every 3-5 years, as needed). Palm Springs International Airport is responsible for the cost of required upgrades. CBP will provide Palm Springs International Airport a minimum of 180 days advance notice of any required upgrades. 12Payment Process A copy of this signed agreement will be forwarded to the CBP National Finance Center (NFC). Upon receipt and installation of all equipment, the NFC will issue Palm Springs International Airport a bill for the actual equipment costs not to exceed $65,487.40 as detailed in CBP OIT Cost Estimate P AL007 A-OF0-21024c. The CBP NFC will bill Palm Springs International Airport, 90-days prior to the due date for recurring out-year network and connectivity charges owed, along with any sums owed for replacement equipment not covered by manufacturer warranties. Pursuant to 19 C.F .R. § 24.3a, any amounts due CBP under the terms of this agreement th.at are more than 30 days past-due will begin accruing interest charges based on U.S. Treasury borrowing rates and may ultimately be referred for collection.
