SUBJECT: APPROVAL OF PARCEL MAP 38247 FOR A 122-UNIT APARTMENT
DEVELOPMENT (“LIVING OUT”) AT 1122 EAST TAHQUITZ CANYON

SUMMARY:
Walden and Associates, representing KOAR Palm Springs, a Delaware Limited Liability
Company (the “Developer”), has requested approval of Parcel Map 38247 (formally
known as Tentative Tract Map 37602) to create a 122-unit apartment building and a
commercial building on a vacant 8.5-acre lot. Approval of the Parcel Map is a ministerial
action, as required by the Municipal Code and the Subdivision Map Act. All prior
discretionary actions have occurred allowing for the City’s ministerial approval of the final
map.
RECOMMENDATION:
Adopt Resolution No. _____, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM SPRINGS, CALIFORNIA, APPROVING PARCEL MAP 38247 FOR KOAR
PALM SPRINGS, LLC A DELAWARE LIMITED LIABILITY COMPANY, FOR PROPERTY
LOCATED AT 1122 EAST TAHQUITZ CANYON WAY, IN SECTION 14, TOWNSHIP 4
SOUTH, RANGE 4 EAST.”
BUSINESS PRINCIPAL DISCLOSURE:
The Public Integrity Disclosure Form from KOAR Palm Springs, LLC, is included as
Attachment A.
BACKGROUND:
Tentative Tract Map 37602 was approved by City Council on June 5, 2019, (TTM 37602
was previously a condominium map) for the subdivision of a condominium project of a
vacant 8.5-acre lot. The project was converted to a single lot subdivision for a 122-unit
apartment complex (TPM 38247) which was subsequently approved by Planning
Commission, subject to conditions, on December 17, 2020.

Approval of PM 38247
The expiration date of the Tentative Map was June 5, 2021, although an automatic 18-
month extension by the State (AB 1561) was applied to the project. Walden and
Associates, representing the Developer, timely filed a final map for PM 38247 on
September 7, 2021. Pursuant to state law (California Government Code Section 66452.6
[the “Subdivision Map Act”]), once the filing of a final map has been made to the City
Engineer, all subsequent actions associated with the final map may occur after the
expiration of the associated Tentative Tract Map.
STAFF ANALYSIS:
The developer has completed all required studies, improvement plans, Community
Facility District (CFD) requirements, and has been issued applicable grading permits at
this time.
Pursuant to the prior discretionary entitlements approved by the Council on June 5, 2019,
the Developer requests that the property located at 1122 Tahquitz Canyon Way, in
Section 14, Township 4 South, Range 4 East, be subdivided into a single lot subdivision
for a 122-unit apartment complex. A site map is provided below and a copy of the final
map for PM 38247 is included as Attachment B.

Approval of PM 38247
The City Engineer has determined that required conditions of approval associated with
PM 38247 have been satisfied, that Parcel Map 38247 is in substantial conformance with
the approved Tentative Map, and that Parcel Map 38247 is ready for City Council
approval.
ENVIRONMENTAL ASSESSMENT:
The City Council approved the Mitigated Negative Declaration (MND) on June 5, 2019
which included a series of mitigation measures that have been incorporated into the
approval of the Final Planned Development. When reviewing the Minor Amendment to
the PDD on December 17, 2020, the Planning Commission determined that the change
from condominiums to 122 rental apartments would not create additional impacts beyond
those previously analyzed in the MND and that the mitigation measures identified in the
adopted MND would apply. No further CEQA analysis was determined to be necessary.
FISCAL IMPACT:
Approval of Parcel Map 38247 will subdivide the currently vacant 8.5-acre parcel into a
single lot subdivision for 122 apartment units and a 1-unit commercial building. Ultimately,
upon completion of the units, the City will receive yet-to-be-determined additional property
tax revenue. Additionally, incremental costs for public services (such as Police and Fire
services) will be incurred over time.

PALM SPRINGS, CALIFORNIA, APPROVING PARCEL MAP
38247 FOR KOAR PALM SPRINGS, LLC A DELAWARE
LIMITIED LIABILITY COMPANY, FOR PROPERTY
LOCATED AT 1122 EAST TAHQUITZ CANYON WAY, IN
SECTION 14, TOWNSHIP 4 SOUTH, RANGE 4 EAST.
WHEREAS, the City Council of the City of Palm Springs, (hereinafter the “City”),
at its meeting of June 5, 2019, approved Tentative Tract Map 37602 (TTM 37602,
previous condominium map) later converted to Tentative Parcel Map 38247 subject to
conditions; and
WHEREAS, the Planning Commission of the City of Palm Springs, at its meeting
of December 17, 2020, recommended approval of Tentative Parcel Map 38247, subject
to conditions; and
WHEREAS, KOAR Palm Springs, a Delaware Limited Liability Company,
(hereinafter the “Subdivider”), has filed with the City a final map for Tentative Parcel Map
38247, identified as Parcel Map 38247, in accordance with Section 66458 of the California
Government Code; and
WHEREAS, the Subdivider, has offered dedication to the City of Palm Springs; an
easement for street and public utility purposes; an easement for public sidewalk purposes
said easements dedicated on map as easement notes C and D and
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. Parcel Map 38247 is in substantial conformance with the approved
Tentative Tract Map 38247.
SECTION 2. Parcel Map 38247 is in conformance with the General Plan.
SECTION 3. Parcel Map 38247 conforms to all requirements of the Subdivision
Map Act of the State of California.
SECTION 4. In accordance with Section 66477.1 of the California Government
Code, the offers of dedication to the public on Parcel Map 38247
shall be accepted by the City Clerk, subject to improvement, who
shall certify acceptance by signature on the map thereof.
