I have served on the board here previously, and would like to give it another go. In the late 60's early 70's I did volunteer work with Delaware County Cerebral Palsy in Pennsylvania, spent a few summers as personal gardener to Ralph Sloan (Sloan Valve), his mothers estate, and E.L. Matlack (Pipeline On Wheels) at their summer homes in Media, PA. I spent two years at the vocational horticulture program at the newly created Ridley Creek State Park in Lima. PA. It had been the Riddle Family estate. Man-O-War was one of their horses. I helped to renovate the ancient greenhouses there. At home I had a small homebuilt greenhouse. I have been interested and have studied the many fields of horticulture since my teens. In 1972 upon graduation from high school, I was accepted into the Longwood Gardens, Professional Gardener Training Program, in Kennett Square, PA. I lived, worked and studied on the former Pierre DuPont estate and gardens for two years. After graduating in 1974, I worked several jobs at local colleges, arboreta, and greenhouses near home. Tired and frustrated working for others, I struck out on my own in 1976 as Bills' Landscaping. (now retired) In 1978 I moved to Indiana and lived in Hammond, and Gary, until moving permanently here. I took a steady job at Inland Steel Co. in late 1978 as a Millwright, and did my landscape work on the side. I have done landscape garden work in at least 7 states and have taken classes, seminars, and hands on studies with Penn State University, University of Delaware, Purdue University, and University of Southern California, Riverside, and Indiana University; where I earned two degrees in Environmental Science through the School of Political and Environmental Affairs. I am a certified plantsman, and arborist through Purdue University. I recently completed the Master Gardener program here in Riverside County. While living in Indiana, I ran for political office twice, and served on several boards; including The Grand Calumet River Task Force, and as a result of our work have witnessed the renovation of one of the dirtiest rivers in the world. As President of the board of Hammond Sanitary District in Hammond, IN, I worked to procure and disseminate over $20M in revolving loan funds to renovate the Roosevelt era sewage plant there. I also pushed to purchase a dredging barge to help clean the Grand Calumet River, and pressed the mayor of Hammond to purchase a giant tub grinder to keep yard and garden waste out of the local landfills while providing free mulch to our local citizens. I was President of our neighborhood association in the historic Harrison Park neighborhood. In Gary, on the Park and Buildings boards, I had a short TV program on garden care, and oversaw the construction of a Veterans home. My (our) home gardens received awards in Indiana with the local garden club. G�_Za�2'Z 1 1Mr - ITEM NO. 1"l DYE," j�(/� C, Composting: There are literally tons of green waste taken out of Palm Springs weekly; from grass clippings to palm fronds, tree limbs, and etc. All of this material is being hauled to dumps in the area, polluting the air and wearing on our roadways. Most of this, almost 100 percent, could be ground up and used as soil additive for local farmers, as well as home gardeners. I spent years working with park departments and the sanitary district in Hammond and Gary, Indiana. A lot of the green waste can be ground in large tub grinders, screened, and composted in the open, or in rolling composters. The local sanitary districts can add green waste to sewage and digest it, the resulting mix could be sold as soil, and the Methane generated sold to The Gas Company. I used Philorganic (Philly sludge) when I lived in Philadelphia, Milorganite when in the midwest, and treated sludge from the Hammond Sanitary district as well. The landfilling of this potential resource is truly a crime. The most recent bag of garden soil I bought locally was produced in Ohio. There is no reason why we cannot contact companies as MIRACLE GROW, or others to get a plant here locally to help us along in this venture. William A. I spent many years dealing with the Sanitary District in Hammond, Indiana. As President of the board, we collectively travelled throughout Region 5 EPA to gather some $22 Million to renovate our Roosevelt era out of compliance sewage plant. We built new clarifiers, air systems, and our own lab. We also used casino monies to separate the over 100 year old combined system. Here, if a cat pees in the street, there is a flood! As an example; water from San Raphael must travel down Sunrise all the way to Escuela to a functioning drain, All along San Raphael, and north Sunrise, the inlets are not interconnected. Trees are growing out of inlets filled, as cisterns, with putrid water. These are havens for mosquito growth. Throughout Palm Springs street surface inlets are filled to the top with soil, sand, and landscape waste. There are two at the intersection of El Cielo and Ramon. One in front of the Leisure Center is always full of water. There are many dozens in the city, just as these. Drainage needs to be addressed! One thing the city can do is require landscape laborers to vacuum waste up, instead of blowing it into said inlets. These need to be cleaned out, they should not be seen as garbage disposals. What is Topping? lopping is the indiscriminate cutting of tree branches to stubs or to lateral branches that are nor large enough to assume the terminal role. Other names for topping include "heading," "tipping," "hat -racking," and "rounding over." Topping is often used to reduce the size of a tree. A homeowner may feel that a tree has become too large for his or her property, or that tall trees may pose an unacceptable risk. Topping, however, is not a viable method of height reduction and certainly dos not rcducc favarc risk. in late, topping will increase risk iti the long term. Topping Stresses Trees Topping can remove 50 to 100 percent of a tree's leaf -bearing crown. Leaves are the food factories of a tree. Removing them can tem- porarily starve a tree and trigger various sam-,al Dormant buds are activated, forcing the rapid growth of :multiple shoots below each cut. The tree needs to put out a new crop of leaves as soon as possible. If a tree does not have the stored energy reserves to do so, it will be seriously weakened and may die. A stressed tree with large, open pruning wounds is more vulnerable to insect and disease infestations. The tree may lack sufficient energy to chemically defend the wounds against invasion, and some insects are actually attracted to the chernical_ sigr_alc trees release. Topping Leads to Decay Correct pruning cuts are made just beyond the branch collar at the point of attachment. The tree is biologically equipped to close such a wound, provided the tree is healthy enough and the wound is not too large. Cuts made along a limb between lateral branches create stubs with wounds that the tree may not be able to close. The exposed wood tissues begin to decay. Normally, a tree will "wall off," or compartmentalize, the decaying tissues, but few trees can defend the multiple severe wounds caused by topping. The decay organisms are given a free path to move down through the branches. Topping Can Lead to Sunburn Branches within a tree's crown produce thousands of leaves to absorb sunlight. When the leaves are removed, the remaining branches and trunk are suddenly exposed to high levels of light and heat. The result may be sunburn of the tissues beneath the bark, which can lead to cankers, bark splitting, and death of some branches. Topping Can Lead to Unacceptable Risk The survival mechanism that causes a tree to produce multiple shoots below each topping cut comes at great expense to the tree. Go after unregistered, unlicensed animals, cars parked forever, etc. Along San Raphael there are people living in vehicles by Cabelleros. The trailer parks here in the north are a mess. There is a house on the north side of San Raphael with cameras pointed toward the street. People have little to no regard for stop signs, traffic lights, driving courtesy, tailgating, racing through parking lots, aggressive driver, speeding in general. etc. Many speed limits here are set far too high. The speed limits should be painted on the streets. Many people coming off the expressway race into the city. There should be lines on the curbs downtown to demark parking spaces. we have to get out and look to see that we are properly in the spaces. Up north here we regularly hear gunshots, houses in Sunrise Palms have been hit by bullets from the trailer park across the street. The ladders on the walls need to GO. William Miller 219 616 6975 January, 2018 Dear Editor: As a federally certified arborist, I am disgusted, disappointed, and dismayed. Here once again is the season of tree butchery. I am appalled at the fact that no one seems to care that the people wielding chainsaws throughout our valley have absolutely NO idea what they are doing. I have seen so many ruined trees here that it physically hurts! Where are our Arbor Day Foundation Tree Cities? How is it that local municipalities have absolutely NO regulations that apply to these so- called gardeners who hack and whack their way across the desert? Are there NO rules, requirements, or expected norms? Trees that are topped and denuded of branches and leaves are destined to become DEAD trees. I have been working in the field of horticulture since the 1970's. I am trained, and know how to maintain trees and herbaceous plants properly. Most of the 'gardeners' here have not on iota of training, or knowledge of simple plant physiology! None at all! This applies to at least 90% of what I have seen here. Anyone with eyes to see can observe dead trees, shrubbery, and even ornamental grasses that have been mishandled. Two easy to observe examples are damaged, dying trees along Dinah Shore and Gene Autry. Two years ago the beautiful Palo Verde trees at Public Storage were ruined, a couple are struggling to come back. Another is on the east side of the Wells Fargo bank near Aldi on Gene Autry. That tree was recently denuded of branches and all leaves. Just cut it off at ground level and start over! A tree that has been made to look like a hat rack is a ruined tree, destined to be a dead tree. Damaged trees cost consumers and taxpayers money. A mature topped tree will soon be a diseased, dead tree. Many spoiled trees and other herbaceous plants I have observed are on public land, therefore, YOU pay for the trees, and their destruction. Along Dinah Shore from Cathedral City east the trees have been mishandled for miles! Our region is a major flyway, bird trap, and resting area for migratory birds. Trees that have no proper branching do nothing for these creatures looking for a place to rest, nest, or find food or shade. Many birds nest in the same tree for generations. For those of you who have forgotten your basic botany; observe at your open hand, that represents the trees heartwood, slip on a rubber glove, this is the cambium, living tissue, over that put on a leather glove, and represents the bark. Now cut off your fingers, but don't go to the hospital.... that is what is going on with topped trees. A slow painful death. Why is it that this is allowed to continue?? I am incredibly weary of hearing the mantra, "That is how things are done here in the desert." Why and how is it that people claiming to be gardeners and arborists are not required to be licensed, and trained to do things properly?? The correct pruning of plants has been about the same since Jesus said, "I am the vine, you are the branches." The primary reasons are loss of habitat and use of pesticides and herbicides. As vacant lands become housing developments and unimproved roadsides are sprayed or incorporated into paved roadways, the Deser Milkweed plant that Monarch butterflies depend on for life is disappearing. Why Is This Important? Monarch butterflies from west of the Rocky Mountains overwinter in California, generally along the coast. The Coachella Valley is one of several areas in California where Monarchs gather, rest, and lay eggs to create the next generation of butterflies that will complete the migration. In the desert, Monarchs lay their eggs only on Desert Milkweed. A secondary role of Monarchs is that, like bees, butterflies carry pollen fror plant to plant. As the bee population decreases, butterflies become more important as plant pollinators. Butterflies are also an important food source fc other species, like birds and mice. RECYCLING: In Indiana we were able to separate our reclyclables into bins placed around towns and cities. If secure bins were installed here; interested parties, as The Center, Mizell, etc., could be chosen to empty them, and take the proceeds to bolster their purses. My little church earns about $400.00 per year from things our parishioners bring in. I take the material up to Smoke Tree for recycling. HOMELESS HELP: Sites could be chosen North, Central, and South for banks of mailboxes with an address. We are writing in regards to the housing development on Crestview in the Mesa. We would like to view the environmental reports per CEQA. Currently, the owner of 5 adjacent parcels, all upstream of and closest to the existing FEMA Flood Map, is seeking to develop two homes. The reason why we are requesting the developer be held to CEQA guidelines is because the developer is on record from the Jan 19th 2021 ARC meeting stating intent to develop all lots. CEQA requires a Hydrology Survey of the entire property. Palm Springs Staff does not concur with the developer's summary water report and concurs that re-routing the water will cause significant changes and impact to the watershed. We would like to view the CEQA mandated hydrology report to understand this impact and risks. The canyon water flow exits onto El Camino Way, which is identified as a FEMA Flood Zone AO, and is classified as 1-3 feet of flooding. The construction of the first two homes could alter the water flow from upcanyon. Please see the attached photos of the past flooding of W El Camino from 9/9/2017. This flooding significantly impacted the home at 175 W El Camino. In only our first year in The Mesa, we have seen our street flow with flood water and have had two periods of heavy debris in the road which last 2-3 months each. El Camino Way into our front yard and right into our front door and garage door. Not satisfied to just complain I have set forth specific suggestions to our city leaders which can be adopted to address the top issues our city face. Our city leaders have revealed they will concentrate on a proposed resource center in the north part of Palm Springs after abandoning the hotel conversion site due to cries from the NIMBY's. So, here we are today recognizing the new resource center will not be in service until 2023. What can the city do in the meantime? Plenty. If our city leaders have the will. My research revealed remarkably interesting findings and concerns our city can and should address in the short term. Stop letting the Riverside County Board of Supervisors off the hook. It is clear the Supervisors continue to throw our city under bus by withholding funds we rightly deserve. Palm Springs must adopt an aggressive approach to obtain funding, resources and dedicated mental health officials/facilities for Palm Springs and the Coachella Valley — we taxpayers deserve to have the county step up. I encourage our City Council, City Manager and PSPD to develop a comprehensive plan to receive well -deserved funding. Housing must come first. To keep people from falling into homelessness we need affordable housing at all price levels. Affordable housing should be affordable low-income as well as very -low-income housing. The city should be looking at vacant land on which to build `tiny home' communities — these cost far less than constructing new apartment buildings and have been built in major vacation -destination cities. One suggestion is to partner with the Agua Caliente and lease vacant parcels which are located within our city. The Home Key program is not a permanent fix and should only be used as a temporary solution to offer housing now. Mental illness and substance abuse are contributing factors to homelessness. Recent surveys in Los Angeles found that 25% of the homeless reported they suffer from mental illness and 27% reported they had substance use problems. About 4 1 % had one or the other or both. It would be worthwhile for Palm Springs to survey these primary factors of our homeless population. The results could be the foundation of creating new policies, options and help for those on the street. Providing these people with housing first will give them a stable base from which to seek treatment. This is a more humane approach — housing first. Housing first does not mean housing only but get someone housed and then offer treatment options. The city cannot continue to shelter -bed its way out of homelessness. Temporary housing is expensive. A person in a shelter is still a homeless person. The city must concentrate on finding faster ways to create affordable permanent supportive housing. Protect vulnerable renters from losing their housing. More Californians are becoming homeless each day. People who do have housing are spending more than half of their income on rent and utilities leaving them with little savings to manage rent increases, a job loss, or unexpected bills. These renters need to be protected or else they will be forced into homelessness and the cycle will continue. Enforcement is not the only way. Residents and businesses alike are complaining about homeless encampments in their neighborhood and along our business corridors. Removing someone from the sidewalk only means they will turn up somewhere else in short order. It is easy to talk about enforcement, but it also needs to be a major factor in any plans for more housing whether it is permanent or temporary. A specific plan of action provided to our residents over the next few months, with doable goals is the least our city leaders can do — talk is cheap — we need action now, not in 2023. We can no longer continue to ignore the economic damage to our community and downtown. Palm Springs clearly needs to clean up our business corridors and neighborhoods. The visual of our city streets from residents, visitors, snowbirds, and people passing through is a stark reminder we have a work to do. As our city leaders continue to seek, and implement solutions these coming months, I would encourage them to do a better job in communicating to the public their goals as well as successes. Public relations are one of the missing factors at City Hall. If the public is never aware of positive actions/goals, then the doors for criticism will always be open. I use an old saying from my grandfather —'the tail does not wag the dog' — and the NIMBY's, naysayers, and people whose social media to influence policy are in a minority. Thank them for their views and move on to create a better community. You will never satisfy everyone, but our city leaders cannot continue to let those people delay or obstruct a new direction and vision of our city. Your jobs are not easy. Public service is never easy. My goal is to promote, encourage and support our city as we face our challenges with a determination to remain a world -class tourist destination. An attorney representing Palm Springs on Tuesday emailed a memorandum to a lawyer representing the college to express the city’s opinion that COD is not in compliance with the Brown Act, California's sunshine law for local government agencies. “Upon review of COD Board of Trustees (Board) meeting agendas, minutes, and recordings, and comments made by Board members to the press, several of COD’s practices relating to the Brown Act have emerged that appear to be inconsistent with open and transparent public meetings, and may in fact be violations of the Brown Act,” wrote Andrew Jared, a Palm Springs city attorney. The memo was copied to Riverside County District Attorney Michael Hestrin, COD's president, and the Board of Trustees. Jared added: 'The manner in which COD has identified properties for discussion in closed session denies the public not only the right to be informed, but also the ability of the public to comment before the Board makes decisions or provides direction. Palm Springs' main city attorney, Jeff Ballinger, works for the same law firm as one of COD's lawyers, Carlos Campos. Due to that potential conflict of interest, both the city and the college would need to agree to a consent waiver that would allow Ballinger to represent the city on issues related to COD. Since the city hired Jared, the college has signed a partial waiver that would allow Ballinger to represent the city on certain issues but not others — including potential litigation with the college and some real estate concerns. Under the Brown Act, members of the public have the right to speak on all items on a legislative body’s agenda before the body may act on them. The COD Board of Trustees, as a group of elected officials, is a legislative body. In his memo, addressed to attorney Andreas Chialtas, Jared said that COD's board has approved minutes of at least two prior meetings before accepting public comments. In one instance, he and one other member of the public expressed to the board that the prior meeting minutes were inaccurate, but they were only able to do so after the board had already voted to ratify those minutes. “Had the Board complied with the Brown Act, either by allowing the public to speak on each item, or by only taking action only after the public had been allowed to address the Board, the Board could have corrected the minutes easi-ly,” Jared wrote on Tuesday. The college has listed Superintendent/President Martha Garcia as its designee (negotiator) for all of the properties. “First, the agenda omits what is being negotiated. An agency is only allowed to discuss price of a real property negotiation, terms of a real property negotiation, or price and terms,” Jared wrote to the college. He continued: “Here, COD has failed to indicate whether it intended to discuss price, terms of payment, or both. Additionally, COD has failed to indicate who the negotiating parties are as to each parcel. Naming your chief executive 'or designee' amounts to no meaningful disclosure at all. The public is entitled to know who your negotiators are, and they must attend the meeting. Otherwise, you may be tempted to use closed sessions to discuss issues related to real estate acquisition from which you may not exclude the public.' Jared wrote that a blanket closed session property conference agenda item gives the impression that there is one property transaction taking place involving all 22 parcels. He claims that is not the case, and the Riverside County Assessor’s website shows the properties are scattered in different cities throughout the Coachella Valley including Indio, Coachella and Palm Springs. Jared previously raised his concern to the COD trustees in a public comment at the board’s Jan. 21 meeting. At that time, a COD staff member acting as clerk indicated that the closed session item listing 22 parcel numbers was a “clerical error” and would be remedied. In his letter, Jared writes that the agenda was never corrected. COD did not list those parcel numbers on its February board agenda. Complicating matters further, Trustee Bea Gonzalez alleged at that meeting that another member of the COD board has been leaking closed session information to the public. She said she attended a recent community meeting at which she recognized a presentation slide that contained a portion of a discussion that she said took place in a closed session of the COD Board of Trustees, without being more specific. Gonzalez has not responded to multiple requests from The Desert Sun for clarification. Jared’s communication with the board and COD attorneys is not the first time the City of Palm Springs has expressed its concern about COD’s adherence to the Brown Act. In January, the COD board called a special meeting on short notice to discuss its master plan and expansion plans. The agenda was posted online 24 hours in advance of the meeting with no supporting documents attached. Palm Springs City Councilmember Geoff Kors expressed his disappointment that the public was given “almost zero notice so that they can pay attention and watch the meeting or attend it, let alone have enough time to make public comment.” COD attorneys said the notice complied with the Brown Act. Mr. Levy has been living at 2550 S Araby since selling his Anza Trail Home in March 2018 for $900,000 and has the money to repair 2550 S Araby to be habitable and not to be the Nuisance that Mr. Levy has created, to purposefully harass anyone that owns or occupies 2540 S Araby. This behavior of Mr. Levy, a Licensed Architect and former Licensed Builder is beyond absurd. We are very concerned that The City of Palm Springs refuses to apply the law to the residential properties of 2500, 2501 and 2550 S Araby Drive. The City's Inactions have created a health and safety issues for occupants of 2540 S Araby Drive. The welfare of myself and my family has been severely neglected. Vacant buildings can be a source of blight in both residential and non-residential neighborhoods, especially if these buildings are not properly maintained. Even one vacant building which is not actively maintained and managed can become a burden to the community, becoming the core and cause of spreading blight. The City of Palm Springs now requires that vacant properties be registered with the Department of Building and Safety so that we may work in partnership with property owners to ensure our City's standards are met and maintained. Vacant properties, including single-family homes, must be registered as soon as possible, but no later than 10 days after becoming vacant. A commercial property where at least 35% or more of the total floor area within the building(s) is not occupied is considered a vacant property and must be registered. A separate registration form must be completed for each vacant property. 8.80.100 Purpose. The purpose of this Chapter is to ensure all vacant and boarded buildings comply with minimum property maintenance requirements, to encourage proactive and preventive maintenance of properties, to ensure maintenance issues are quickly and efficiently remedied, and to promote the health, safety, and welfare of the people of the City of Palm Springs. (a) Violation Unlawful. It is unlawful and declared a public nuisance for any person to violate any provision of this Chapter. (b) Criminal Penalties. Any person who violates any provision of this Chapter is guilty of a misdemeanor punishable by a fine of up to $1,000, or by imprisonment in the County jail not exceeding six months, or by both such fine and imprisonment, except the City Attorney may prosecute a violation of this Chapter as an infraction, in his or her discretion, as set forth in Section 1.01.140 of this Code. (c) Administrative Penalties. Any person who violates any provision of this Chapter may be issued an administrative penalty in accordance with this Section and Chapter 1.06 of this Code. (1) Appeal and Collection of Penalty. The Enforcement Official's administrative penalty may be appealed in the manner provided in Chapter 1.06 of this Code. Any administrative penalty may be collected as provided in Chapter 1.06 of this Code. (2) Fine for Non -Residential Properties. For any non-residential properties subject to this Chapter, the initial penalty shall be $2,500.00. If the violation continues after the compliance date in the first administrative citation or any extension period granted by the City, a second administrative penalty in the amount of $5,000.00 may be issued. If the violation continues after the compliance date in the second administrative citation or any extension period granted by the City, a third administrative penalty in the amount of $25,000.00 may be issued. For any residential properties subject to this Chapter, the penalties shall be in the amounts set forth in Section 1.06.040 of this Code. (d) Civil or Equitable Enforcement. Nothing in this Chapter prevents the City Attorney from bringing a civil or equitable action, at his or her discretion, to seek the abatement of any violation of this Code. (e) Ongoing Violations. Each and every day a violation is maintained, caused, aided, abetted, concealed, suffered, or permitted is a separate offense. (f) Remedies Cumulative. The remedies, procedures, and penalties provided by this Chapter are cumulative to each other and to any other available under City, State, or federal law. (g) Joint and Several Liability. The duties and liabilities specified in this Chapter are joint and several among and between all owners.
