CITY COUNCIL STAFF REPORT DATE: JANUARY 28, 2021 CONSENT SUBJECT: REQUEST BY PENCIL BOX ARCHITECTS, INC., ON BEHALF OF THE 420 LOUNGE, LLC (OBA COOKIES), FOR A MINOR ARCHITECTURAL APPLICATION TO ALTER THE EXTERIOR OF AN EXISTING COMMERCIAL BUILDING FOR A NEW CANNABIS DISPENSARY FACILITY LOCATED AT 777 NORTH PALM CANYON DRIVE (APN: 505- 283-008), ZONE C-1, SECTION 10, (CASE 3.229 MAA). Ready, City Manager BY: Development Services Department SUMMARY: On December 10, 2020, the City Council reviewed the proposed Minor Architectural Application for a cannabis dispensary and voted 4 to 1 to refer the matter back to the Architectural Advisory Committee (AAC) to address the opaque storefront window treatment proposed by the applicant. The City Council provided the following comments: 1. The windows visible from Palm Canyon Drive (particularly the windows located on both sides of the entrance door) need to not be opaque so that they can function as display windows; 2. The business name, Cookies, may attract unintended trade targets such as minors; and 3. The AAC shall review and pay attention to building lighting to ensure that it will not appear as a dark smoking lounge. In response to the City Council's comments, the applicant submitted revised plans for AAC review. On January 4, 2021, the AAC reviewed several storefront window treatment options and modifications proposed to the business logo, and voted 5-0-2 to recommend approval of a proposed treatment that would retain visibility to the interior tenant space. RECOMMENDATION: That the City Council approve the proposed exterior alterations, including the application of a gradient film with a modified logo for the storefront windows, subject to a condition that the glazing of the entrance door will remain transparent. rtEM N0..._1 _\ _t\..__ City Council Staff Report January 28, 2021 --Page 2 Case 3.229 MAA-Cookies Cannabis Facility Exterior Alterations STAFF ANALYSIS: Following the December 10, 2020 City Council meeting, the applicant submitted several options for treatment of the exterior windows for consideration by the AAC. The AAC reviewed the options at their meeting of January 4, 2021; the selected option involves the use of a gradient film applied to the windows, which retains complete visibility at the upper portion of the window, while becoming more opaque at the lower portion of the window. This treatment assists in partially concealing the visibility of cannabis products, while still allowing a certain degree of visibility to the interior from the sidewalk frontage. The applicant has selected three (3) types of gradient films, and the manufacturers' specifications are attached to this report (Attachment #9); staff will select the film type based on field conditions. The use of the gradient film will provide a relatively consistent treatment of the windows as depicted in the rendering below, including those windows that are obstructed by interior shelving. It is recommended that no gradient film be used on the entrance door, for the purposes of visibility and surveillance. In reviewing this requirement relative to State law, it has been determined that the issue of visibility is intended to apply to cannabis lounges and not to dispensaries. The use of the gradient film treatment will resolve any issues relative to compliance with local regulations, while also being consistent with State regulations. In addition to the modifications to the window treatments, the applicant has proposed a modification to the logo for the business, using a simplified letter "C" on the exterior windows instead of the full name of the dispensary. This is intended to address the City Council's concern about the name of the dispensary being appealing to minors. Image 1.2: Interior view towards Palm Canyon Drive Image 1.3: Interior view towards covered parking lot Please note that the applicant has already completed the interior tenant improvements, and interior shelving obscures several windows; however, only one of the obstructed windows is along the street-facing elevation. As previously noted, the use of the gradient film will assist in providing a consistent appearance to the exterior windows, whether obstructed or not. ENVIRONMENTAL ASSESSMENT: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of Title 14, Chapter 3 of the California Code of Regulations (Class 1, Existing Facilities). CONCLUSION: The proposed use of the gradient film will assist in complying with State and local regulations relative to cannabis dispensaries, while maintaining an active frontage along 3 City Council Staff Report January 28, 2021 --Page 4 Case 3.229 MAA -Cookies Cannabis Facility Exterior Alterations Palm Canyon Drive. Therefore, staff recommends that the City Council approve the proposed exterior alterations, including the application of the gradient film with the approved window signs subject to a condition that the glazing of the entrance door remain transparent. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Fumiko Docker of Pencil Box Architects, Inc. ("Applicant") has filed a Minor Architectural application (Case 3.229 MAA) and a Sign Permit application (Case 20-015 SI) with the City pursuant to Sections 94.04.00 (Architectural Review) and 93.20.10 (General Provisions) of the Palm Springs Zoning Code (PSZC) to apply a new coat of 'Cookies Blue' paint to two (2) exterior columns and to install new signage at a commercial building for a new cannabis dispensary, Cookies, at 777 North Palm Canyon Drive (APN: 505-283-008), Zone CBD. B. On September 8, 2020, the Architectural Advisory Committee reviewed the proposed project and voted unanimously to approve the Sign Permit application (Case 20-015 SI) subject to staff recommendations but required the painting of the two (2) columns (Case 3.229 MAA) to be re-studied for further review. Pursuant to Palm Springs Zoning Code 93.23.15(F)(3)(a), the action taken by the Architectural Advisory Committee on the Sign Permit application is final. C. On November 2, 2020, the Architectural Advisory Committee (AAC) reviewed the revised development plan and voted 6-0-1 to recommend approval of the project to the City Council as submitted. D. On December 10, 2020, the City Council reviewed the application and voted 4-1 to refer the matter back to the AAC to address the opaque storefront window treatment proposed by the applicant. E. On January 4, 2021, the Architectural Advisory Committee (AAC) reviewed the applicant's proposal to modify the approved window sign design and two (2) storefront window treatment options to address the City Council's comments. The AAC voted 5-0- 2 to approve the modifications to the approved window signs and recommended approval of the two (2) design options to the City Council as submitted. 8 Resolution No. Page2 F. Due to the project involving a cannabis dispensary, the City Council shall review and make a decision on this project, in accordance with Palm Springs Zoning Code Section 93.23.15(F)(3) of the Palm Springs Zoning Code. G. On January 28, 2021, the City Council held a regularly scheduled meeting and reviewed the project in accordance with applicable law, and carefully considered all of the evidence presented in connection the project, including but not limited to the staff report and all written and oral testimony presented. H. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, because the project involves minor alterations to an existing building. I. Pursuant to Section 94.04.00(D) of the Palm Springs Zoning Code, the City Council finds: The City Council has examined the material submitted with the architectural approval application and has examined specific aspects of the design and determined the proposed development will (1) provide desirable environment for its occupants; (2) is compatible with the character of adjacent and surrounding developments, and (3) aesthetically it is of good composition, materials, textures and colors. The City Council's evaluation is based on consideration of the following: 1. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas; i.e., sidewalks as distinct from parking Jot areas. The project will not alter the site layout; however, it is proposing to modify the existing pedestrian path located in front of the tenant space to provide steps and a wheelchair ramp for ADA compliance purposes. The new steps and ramp will provide direct access to the North Palm Canyon Drive and create a defined path for visitors. 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted; The project proposes to paint all exterior columns and one (1) of the existing low- height walls in 'Cookies Blue', which is the business' signature color. While the paint will accentuate the simplistic white exterior of the building, its limited application will prevent the color from dominating the design of the building. The use of a bright accent color in paint scheme is a commonly observed technique in Uptown, and the 'Cookies Blue' columns will add unique identity and vibrancy to the building. 9 Resolution No. Page3 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment; The project does not involve any changes to the building height, setbacks, or overall mass, including any walls or screen. The proposed window signs were approved by the Architectural Advisory Committee (AAC). No mechanical equipment installation is proposed as a part of this application. 4. Building design, materials and colors to be sympathetic with desert surroundings; While typical desert color palette includes earth-toned colors such as white, beige, and brown, 'Cookies Blue' represents the color of the desert sky. The color is sympathetic with the desert surrounding and complements the exterior of the building, a large portion of which is painted white. 5. Harmony of materials, colors and composition of those elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously; The project proposes all exterior columns to be painted in 'Cookies Blue' for consistency and a sense of order. Additionally, one of the existing low-height walls will be painted in the matching color to achieve a cohesive and balanced appearance when the property is viewed as a whole, including the approved window signs and proposed storefront window treatment. 6. Consistency of composition and treatment; The project proposes to paint all exterior columns in 'Cookies Blue' for visual consistency. In addition to the columns, one of the low-height walls will be painted in the identical color. 'Cookies Blue' is the business' signature color, and it will be seen in the window signs and product packages. 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials; There are no existing specimen or landmark trees at the project site. The project proposes to install additional Agave in the existing planting beds on the North Palm Canyon Drive frontage to enhance the site's landscape. The drought-tolerant Agave is appropriate for the desert environment and its bold, defined shape complements the simplistic design of the building. 8. Signs and graphics, as understood in architectural design including materials and colors; The new signage for the business was approved by the Architectural Advisory Committee (AAC), and it is not subject to City Council review. 10 Resolution No. Page4 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Vice Chair asked about signage and the existing paint colors for the existing tenant. Member Lockyer questioned if existing landscape was removed; Director Fagg responded that staff would verify if the property is in compliance with the approved landscape plan and direct that any missing landscape be installed. Member Walsh asked about the material for columns (the applicant noted that they are proposing anodized aluminum tubing in a dark brown color); Mr. Walsh also verified the details of the trellis structure. Chair Jakway asked if the business exists in other locations and if the proposed color scheme is different than those locations. Ms. Dean responded there are other locations, and this would be different as the other locations have blue on the entire building. Member Lockyer said the proposed blue isn't offensive, but expressed concern on the lack of landscaping. Member Poehlein agreed that the blue color is fine and felt the signage was good if it complied with the sign regulations relate to height. Member Doczi said there should be some continuity in color with the other columns. Member Walsh and Vice Chair Rotman expressed concern with only painting two of the columns blue, noting it would create inconsistencies on the building. Vice Chair Rotman said the signage gets lost in its proposed location and there could be a more effective location to place signage. 1 17 Chair Jakway was not in support of the signage or blue color as proposed, as well. Vice-Chair Rotman questioned whether the building owner has provided consent to the applicant to paint all columns blue. Staff responded that is correct and the applicant can confirm the information. Fumiko Docker, Applicant, described the proposed changes and stated that the building owner is eager to move forward with the project. Member Discussion: Vice-Chair Rotman stated that the proposed changes tie the overall design of the building together, and the simplistic landscape is in line with the simplicity of the building. Member Thompson commented that he is in favor of the columns and the low- height wall being painted blue. Member Thompson also questioned other Committee members whether the two (2) low-height walls on the North Palm Canyon Drive frontage should be painted blue for consistency, instead of painting only one (1) wall. The Committee discussed about painting the two (2) low-height walls blue and ultimately agreed that the paint application should be limited to just one (1) wall. MOTION: Recommend approval to the City Council as submitted. On November 2nd , 2020 AAC reviewed and approved the revised development plan and recommended approval to City Council. On December 10th, 2020, City Council reviewed a request for approval of a Minor Architectural Application to apply a coat of specially mixed Sherwin William's paint in the same color as the Cookies logo to exterior building columns and a wall in addition to altering the frontage of an existing commercial building for ADA compliance for a cannabis dispensary located at 777 North Palm Canyon Drive. City Council approved a motion to send the project back to Architectural Advisory Committee to change the appearance of the windows facing North Palm Canyon Dive. Section 92.23.Sl(F)(3)(a) of the Palm Springs Zoning Code (PSZC) requires cannabis dispensaries and lounges to undergo Architectural Review. The review shall include the treatment of the exterior of the building, or tenant space, and all signage proposed. For signage, the Architectural Advisory Committee (AAC) shall conduct the final review. For all other architectural elements, review shall be by the City Council upon recommendation by the AAC. Applicant is eager to become operational as soon as possible and now seeks approval for revised frontage that is sympathetic to Council's concerns about transparent windows that face main streets and the pedestrian experience for residents and tourists of all ages while also complying with both state and local regulations in a cost-effective manner. Due to setbacks during the COVID19 pandemic, this project has taken more time than anticipated and has caused setbacks and delays in local hiring, which is hurting local residents and local cashflow. As you may know, cannabis is one of the fastest growing sectors in the Coachella Valley, even during the current Covid-19 pandemic, and this emerging industry creates new jobs contributing to the City's economic base, which has a multiplier effect on surrounding local businesses and housing. Unemployment in Palm Springs jumped from 4.6% in March 2020, to 25% in November 2020. From the earliest days during cannabis prohibition in a San Francisco garage to global growth, the goal has remained the same: authenticity and innovative genetics. Cookies controls the entire experience from start to finish, seed-to-sale, which sets Cookies apart from other operators. The mission aligns with the concept that Palm Springs is looking for: modern, high-class, and colorful. Cookies looks forward to opening a brick-and-mortar shop in Palm Springs as it has in San Francisco, Sacramento, and Los Angeles. Findings This project was found to satisfy all findings of PSZC § 94.04.00(D). 1. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas, i.e., sidewalks as distinct from parking lot area. PSZC § 94.04.00(D) (1) a. The project will not alter the site layout; however, it is proposing to modify the existing pedestrian path located in the front of the tenant space to provide steps and a wheelchair ramp for ADA compliance purposes. The new steps and ramp will provide direct access to all. 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted; PSZC § 94.04.00(D) (2) a. The project proposes to paint all exterior columns and one (1) of the existing low-height walls in 'Cookies Blue', which is the business' signature color. While the paint will accentuate the simplistic white exterior of the building, its limited application will prevent the color from dominating the design of the building. The use of a bright accent color in paint scheme is a commonly observed technique used in Uptown, and the columns painted in this color will add unique identity and vibrancy to the building. 3. Maximum height, area, setbacks, and overall mass, as well as parts of any structure (buildings, walls, screens, towers, or signs) and effective concealment of all mechanical equipment; PSZC § 94.04.00(D) (3) a. The project does not involve any changes to the building height, setbacks, or overall mass, including any walls or screen. The proposed window signs were approved by AAC. No mechanical equipment installation is proposed as a part of this application 4. Building design, materials, and colors to be sympathetic with desert surroundings; PSZC § 94.04.00(D) (4) a. While the typical desert color palette includes earth-toned colors such as white, beige, and brown, 'Cookies Blue' resembles the color of the desert sky. Therefore, the color is sympathetic with desert surrounding. Its limited application complements the exterior of the building, a large portion of which is painted white. 5. Harmony of materials, colors, and composition of those elements ofa structure, including overhangs, roofs, and substructures which are visible simultaneously; PSZC § 94.04.00(D) (5) a. Applicant proposes exterior columns to be painted in the 'Cookies Blue' for consistency and a sense of order. Consistency of composition and treatment; PSZC § 94.04.00(D) (6) a. The project proposes to paint all exterior columns in 'Cookies Blue' for consistency. In addition to the columns, the low-height walls will be painted in the identical color. 'Cookies Blue' is the business' signature color, and it will be seen in the window signs and product packages. 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials; PSZC § 94.04.00(D) (7) a. There are no existing or landmark trees at the project site. The project proposes to install additional Agave in the existing plant beds facing the main street to enhance the site's landscape. The drought- tolerant Agave is appropriate for the desert environment and its bold, defined shape and form complement the simplistic building design. 8. Signs and graphics, as understood in architectural design including materials and colors; PSZC § 94.04.00(D) (8) a. The new signage for the business must be approved by City Council. Applicant has chosen to take the word "Cookies" off of the signage, leaving only the logo, the famous "C-bite". Further, Applicant will restrict access to anyone without a valid government- issued identification and have at least one security guard monitoring the site 24 hours a day and seven days a week. To be clear the name Cookies, LLC was born out of its cultivation of arguably the most popular strain in the world, Girl Scout Cookies(GSC). GSC is a strain that Cookies has integrated and bred into its genetic library and is a parent of many of its other strains. Thus, Girl Scout 'Cookies' is integral part of the company and genesis for its world-renowned name 'Cookies'. Applicant respectfully asks that the review of this project consider the entire experience of the customer. The name is notto entice minors but is a name that encapsulates what initially made the brand famous. its superb flower. the Girl Scout Cookies strain. For example, to compare cannabis flower genetics to the wine industry we can look to similar wine brands with dessert sounding names such as "Cake bread", "Layer Cake", "Cupcake". While all brands sound like sweets and even may depict a logo of a sliced cake, the brands are easily recognizable to wine enthusiasts as wine, not desserts. UPDATED WINDOW FRONTAGE -A COMPLIANT COMPROMISE Second, City Council has asked for clear window treatment for all windows facing North Palm Canyon Drive. Cookies' main priority is compliance and understands Council's request for clear windows to comport with past decisions the Council has made about frontages of buildings located in the downtown area. However, both state regulations and the local Palm Springs Municipal Code prohibit clear windows. Section 26070(j){3) of the Business and Professions Code requires that all of a licensed retailers cannabis goods be secured in a locked room, safe, or vault, in a manner reasonably designed to prevent diversion, theft or loss. That section of the Business and professions code further provides that licensees may only display limited amounts of cannabis goods. Section 5405 of the Bureau's regulations further clarifies the requirements of section 26070 of the Business and Professions Code and provides that cannabis goods for inspection and sale shall only be displayed in the retail area. Accordingly, licensed retailers with all glass fronts are not allowed underthe existing commercial cannabis legal framework. Locally, 5.55.200 (A) (17) of the Palm Springs Municipal Code prohibits cannabis goods, graphics depicting cannabis goods from visibility through the exterior of the premises. Cookies' proposed facility has an open floor plan. So, unlike other dispensaries that have a closed waiting room where a security guard will buzz customers into a closed retail area or shop, this facility is completely open with large round tables that house stationary sample jars, which will be visible to the public. At this point the Applicant cannot endure another hardship and bear the expense of new building permits and remodeling costs to change the floor plan. For example, Harvest located in the heart of downtown on North Palm Canyon Drive has darkened windows that face the street. The window faces the check in lobby, which is completely separate from the retail shop. See picture below. An important distinction to make between Cookies' project and Harvest's frontage is that their windows have nothing on the interior blocking a view to the inside of the building otherwise prevented by darkened windows. Cookies' has a physical barrier, a display case, blocking a view to the inside of the building so that even if there were completely untreated windows, it would be impossible to see to the interior of the building. The colors of the posters fit into the Palm Springs' aesthetic because they have bright colors and have a simple yet elegant design concept (see below for some examples of bright color murals/designs approved by the City for other projects). Additionally, the Collins Ave strain art depicts a neon flamingo. Neon colors fit into the more modern Palm Springs concept and flamingo lawn ornaments are classic mid-century modern novelty. From the eye of a child or non- cannabis using adult it would be difficult to tell the shop was a cannabis retailer without any prior knowledge of the Cookies' brand.
