SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE NO. 2059
AMENDING CHAPTER 10.22.060 OF THE PALM SPRINGS MUNICIPAL
CODE RELATED TO UNATTENDED ANIMALS IN ENCLOSED
VEHICLES – GUIDE DOGS OF THE DESERT

RECOMMENDATION:
Waive the second reading of the ordinance text in its entirety and read by title only; and
adopt Ordinance No. 2059 entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, AMENDING PALM SPRINGS MUNICIPAL
CODE CHAPTER 10.22 RELATED TO UNATTENDED ANIMALS IN ENCLOSED
VEHICLES."
BACKGROUND:
On January 27, 2022, the City Council introduced Ordinance No. 2059 for first reading,
as noted below:
MOTION BY MAYOR PRO TEM GARNER, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to introduce Ordinance No. 2059 entitled, “AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
AMENDING PALM SPRINGS MUNICIPAL CODE CHAPTER 10.22 RELATED TO
UNATTENDED ANIMALS IN ENCLOSED VEHICLES.”
City Attorney’s Summary: This ordinance amends the Palm Springs Municipal Code to
authorize the Chief of Police to permit certain vehicles to keep unattended animals in
enclosed vehicles subject to conditions of approval.
This report provides for the City Council to waive further reading and adopt the ordinance.
The ordinance shall be effective 30-days from adoption.

AN ORDINANCE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, AMENDING PALM SPRINGS MUNICIPAL
CODE CHAPTER 10.22 RELATED TO UNATTENDED
ANIMALS IN ENCLOSED VEHICLES
City Attorney’s Summary
This ordinance amends the Palm Springs Municipal Code to
authorize the Chief of Police to permit certain vehicles to
keep unattended animals in enclosed vehicles subject to
conditions of approval.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. Section 10.22.060, Exemptions, of the Palm Springs Municipal
Code shall be amended to read as follows: “This chapter is not applicable to animals
which are in a peace officer’s vehicle, or an animal control officer’s vehicle, or other
vehicles with a permit (subject to conditions of approval) issued by the Chief of Police,
while such peace officers or animal control officers are engaged in their regularly
assigned duties.”
SECTION 2. The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same, or the summary thereof, to be
published and posted pursuant to the provisions of law and this Ordinance shall take
effect thirty (30) days after passage.
