SUBJECT: RESOLUTION IN SUPPORT OF SB 1383 LOCAL ASSISTANCE GRANT
PROGRAM APPLICATION

SUMMARY:
The City Council is requested to adopt a resolution in support of the California Department
of Resources Recycling and Recovery (“CalRecycle”) SB 1383 Local Assistance Grant
Program Application and authorize Staff to transmit resolution to CalRecycle with the
grant application.
RECOMMENDATION:
Adopt a Resolution entitled “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, AUTHORIZING SUBMITTAL OF APPLICATIONS FOR
ALL CALRECYCLE GRANTS FOR WHICH THE CITY OF PALM SPRINGS IS
ELIGIBLE.”
BACKGROUND:
In September 2016, Governor Brown set methane emissions reduction targets for
California (SB 1383 Lara, Chapter 395, Statues of 2016) in a statewide effort to reduce
emissions of short-lived climate pollutants. Many of these emissions come from landfilled
food and green waste, which is why the law is primarily focused on diverting organic
materials from landfills. Through increased recovery of food, green waste, and edible
food, the State must:
•Reduce organic waste disposal 50% by 2020 and 75% by 2025.
•Rescue at least 20% currently disposed surplus food by 2025 for human
consumption.

STAFF ANALYSIS:
The Department of Resources Recycling and Recovery (“CalRecycle”) offers the SB 1383
Local Assistance Grant Program pursuant to Chapter 395, Statues of 2016. This non-
competitive grant program will provide one-time funding to local jurisdictions to assist with
the implementation of regulation requirements associated with SB 1383.
Eligible Projects/Products include:
• Capacity Planning
• Collection
• Edible Food Recovery
• Education and outreach (includes organic waste and edible food recovery)
• Enforcement and Inspection
• Program Evaluation/Gap Analysis
• Procurement Requirements (using recycled organic products – compost, mulch,
electricity, and/or renewable gas and recycled paper and paper products)
• Record Keeping
It is intended that the grant funding would be used to offset the costs of outreach and
education programs, as well as procurement costs.
Applicants of this grant must have an adopted enforceable ordinance, pursuant to Section
18981.2 of Title 14 of the California Code of Regulations. The City of Palm Springs
adopted Ordinance No. 2053 on December 9, 2021, which amended Chapter 6.04 of the
Municipal Code to implement the requirements of SB 1383.
The Grant Terms for first-round funding begins April 1, 2022 and ends April 2, 2024. The
Grant Terms for second-round funding begins September 1, 2022 and ends September
2, 2024. The City of Palm Springs will be applying for first-round funds by submitting the
application by February 1, 2022.
FISCAL ANALYSIS:
The City of Palm Springs is eligible to receive grant funding in the amount of $63,654 to
offset expenses related to the implementation of SB 1383.

RESOLUTION NO. _____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, AUTHORIZING
SUBMITTAL OF APPLICATIONS FOR ALL CALRECYCLE
GRANTS FOR WHICH THE CITY OF PALM SPRINGS IS
ELIGIBLE.
WHEREAS, Public Resources Code sections 48000 et seq. authorize the
Department of Resources Recycling and Recovery (CalRecycle) to administer various
grant programs (grants) in furtherance of the State of California’s (state) efforts to reduce,
recycle and reuse solid waste generated in the state thereby preserving landfill capacity
and protecting public health and safety and the environment; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the application, awarding, and management of the grants; and
WHEREAS, CalRecycle grant application procedures require, among other things,
an applicant’s governing body to declare by resolution certain authorizations related to
the administration of CalRecycle grants.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of Palm Springs authorizes the submittal of
applications to CalRecycle for all grants for which The City of Palm Springs is eligible;
and
SECTION 2. The City Manager, or his/her designee, is hereby authorized and
empowered to execute in the name of the City of Palm Springs all grant documents,
including but not limited to, applications, agreements, amendments and requests for
payment, necessary to secure grant funds and implement the approved grant project; and
SECTION 3. These authorizations are effective for five (5) years from the date of
adoption of this resolution.
