SUBJECT: RATIFYING THE ANNUAL ADJUSTMENT OF THE ACCESS LINE RATE
PURSUANT TO PALM SPRINGS MUNICIPAL CODE 3.39.050 APPROVED
BY VOTERS BY MEASURE “G”

SUMMARY:
Pursuant to Palm Springs Municipal Code §3.39.050 approved by voters on November
3, 2009 by Measure “G” imposing an Access Line Tax, formerly known as Emergency
Response Fee, to fund improvements to and operation of the City’s 911 communication
system.
RECOMMENDATION:
Adopt Resolution No. _____ “A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM SPRINGS, CALIFORNIA, RATIFYING THE ANNUAL ADJUSTMENT OF
THE ACCESS LINE RATE PURSUANT TO PALM SPRINGS MUNICIPAL CODE
§3.39.050 APPROVED BY VOTERS BY MEASURE “G”.
BACKGROUND:
Pursuant to Palm Springs Municipal Code §3.39.050, the voters approved an annual
adjustment in accordance with the increase of the Consumer Price Index. Such annual
adjustments as of December 31st of each year, beginning with December 31, 2010. The
voter approved adjusted Access Line Tax pursuant to Section 1 of this Resolution shall be
effective pursuant to §799(a)(5) of the Public Utilities Code of the State of California,
collecting of this adjusted tax by no later than May 1, 2022.
The new amount of the Access Line tax pursuant to Palm Springs Municipal Code
§3.39.050 shall be adjusted as follows:
Access Line from $1.40 per month per access line to $1.49.
Trunk Line from $10.59 per month per trunk line to $11.29.

FISCAL IMPACT:
The estimated total amount of the annual adjustment for all telecommunication users for
a one-year period is approximately $68,000.

RESOLUTION NO. _____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, RATIFYING THE ANNUAL
ADJUSTMENT OF THE ACCESS LINE RATE PURSUANT TO
PALM SPRINGS MUNICIPAL CODE §3.39.050 APPROVED
BY THE VOTERS BY MEASURE “G”.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY FIND
AS FOLLOWS:
A. At the November 9, 2009 Regular Municipal Election, the voters passed
Measure “G” imposing an Access Line Tax.
B. Pursuant to Palm Springs Municipal Code §3.39.050, the voters approved
an annual adjustment in accordance with the increase of the Consumer Price Index. Such
annual adjustment is to commence after December 31, 2010.
C. The Consumer Price Index: All Urban Consumers for the Los Angeles-
Long Beach-Anaheim Standard Metropolitan Statistical Area for All Items as reported by
the United Stated Bureau of Labor Statistics is 6.6% for the period of January 1, 2021
and December 31, 2021.
D. Based on the CPI the annual adjustment is as follows: nine (9) cents per
month per access line, and thirty (30) cents per month per trunk line.
E. The estimated total amount of the annual adjustment for all
telecommunication users for a one-year period is approximately $68,000.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The new amount of the Access Line Tax pursuant to Palm Springs
Municipal Code §3.39.050 shall be adjusted as follows:
Access Line $1.49 per month per access line.
Trunk Line $11.29 per month per trunk line.
SECTION 2. The City Clerk is hereby directed and authorized to amend the
Access Line Tax pursuant to voter approved Measure “G” and Palm Springs Municipal
Code §3.39.050.
SECTION 3. The Director of Finance is hereby directed and authorized to provide
written notice to service providers pursuant to §799(a)(5) of the Public Utilities Code of
the State of California.

SECTION 4. The voter approved adjusted Access Line Tax pursuant to Section 1
of this Resolution shall be effective pursuant to §799(a)(5) of the Public Utilities Code of
the State of California, but not later than May 1, 2022.
