HomeMy WebLinkAbout24964RESOLUTION NO. 24964 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING SOLID WASTE CHARGES THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY FIND AS FOLLOWS: WHEREAS, the Palm Springs Disposal Service ("PSDS") presently serves the City of Palm Springs ("City") pursuant to an exclusive solid waste franchise agreement; and WHEREAS, under the franchise agreement, PSDS collects, transports, processes, and disposes of all solid waste generated or accumulated within the City; and WHEREAS, PSDS seeks to collect during the 6-month period from January 1, 2022, through June 30, 2022, its annual inflationary adjustment for the period July 1, 2021 through June 30, 2022, based on the change in the Consumer Price Index for All Urban Consumers for Los Angeles -Long Beach -Anaheim Area (CPI), February to February, as set forth in Exhibit A, pursuant to its franchise agreement with the City, and WHEREAS, in recent years, the recycling market was deeply impacted by diminished processing capacity, stricter quality standards, and the environmental policies of other countries and a City audit found that PSDS incurred unanticipated excess expenses of $573,587 to process mixed recycling from residences and $694,683 for recycling from businesses; and WHEREAS, PSDS also seeks to collect during the 6-month period from January 1, 2022, through June 30, 2022, a one-time extraordinary rate adjustment as set forth in Exhibit A to recover the excess expenses; and WHEREAS, on October 14, 2021, the City Council approving moving forward with a public hearing under Proposition 218 for both the annual inflationary adjustment and the extraordinary rate adjustment; and WHEREAS, the City has determined that it is necessary to impose new, increased or modified rates for solid waste service charges (collectively herein, the "Charges"); and WHEREAS, the rate structure for solid waste collection includes three customer classes — residential, commercial, and industrial, based on the container size, type of container (e.g. solid waste, recycling, or green/organic waste), and frequency of collection; and Resolution No. 24964 Page 2 WHEREAS, the revenues derived from the Charges will not exceed the funds required to provide the services for which the Charges are imposed, and will be used exclusively for the provision of the City's integrated solid waste management services; and WHEREAS, the Charges are equitable to all customer classes; and WHEREAS, the amount of the Charges will not exceed the proportional cost of the service attributable to each parcel upon which they are proposed for imposition; and WHEREAS, the Charges will not be imposed on a parcel unless the service for which such Charge is imposed, is actually used by, or immediately available to, the owner of the parcel; and WHEREAS, article XIII D, section 6 of the California Constitution ("Article XIII D") requires that prior to imposing any increase to the Charges, the City shall provide written notice (the "Notice") by mail of the new or increased Charges to the record owner of each parcel upon which the Charges are proposed for imposition and any tenant directly liable for payment of the Charges, the amount of the Charges proposed to be imposed on each parcel, the basis upon which the Charges were calculated, the reason for the Charges, and the date time and location of a public hearing (the "Hearing") on the proposed Charges; and WHEREAS, pursuant to Article XIII D such Notice is required to be provided to the affected property owners and any tenant directly liable for the payment of the Charges not less than forty-five days prior to the Hearing on the proposed Charges, and the City provided such notice in compliance with Article XIII D; and WHEREAS, the Hearing was held on this day, December 9, 2021; and WHEREAS, at the Hearing the City Council heard and considered all oral testimony, written materials, and written protests concerning the establishment and imposition of the proposed rate increases for the Charges, and at the close of the Hearing the City did not receive written protests against the establishment and imposition of the proposed rate increases for the Charges from a majority of the affected property owners subject to Charges; and WHEREAS, the City conducted a majority protest proceeding in an abundance of caution and without conceding that Proposition 218 applies to privately provided solid waste service; and WHEREAS, the City Council now desires to establish and impose the proposed Charges as set forth in Exhibit A. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES RESOLVE, DECLARE AND DETERMINE AS FOLLOWS: Resolution No. 24964 Page 3 SECTION 1. Incorporation of Recitals. The City Council finds and determines that the foregoing Recitals are true and correct and incorporates the Recitals herein. SECTION 2. Adoption of Solid Waste Service Charges. The City Council hereby adopts the solid waste service charges, to take effect, in the amounts, at the rates, and from January 1, 2022 to July 31, 2022, as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. SECTION 3. CEQA. The City Council finds that the administration and operation of the City's solid waste services, which are to be funded by the Charges, and set forth herein, are necessary to maintain the City's existing solid waste service as described herein. Based on this finding, the City Council determines that the ,adoption of the Charges established by this Resolution are exempt from the requirements- ,of the California Environmental Quality Act pursuant to section 21080(b)(8) of the Public Resources Code and Section 15273(a) of the State CEQA Guidelines. The documents and materials that constitute the record of proceedings on which these findings have been based are located at City of Palm Springs, 3200 East Tahquitz Canyon Way, Palm Springs, California 92262. The custodian for these records is the City Clerk of the City. SECTION 4. Severability. If any section, subsection, clause or phrase in this Resolution or the application thereof to any person or circumstances is for any reason held invalid, the validity of the remainder of this Resolution or the application of such provisions to other persons or circumstances shall not be affected thereby. The City Council hereby declares that it would have passed this Resolution and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that one or more sections, subsections, sentences, clauses or phrases or the application thereof to any person or circumstance be held invalid. SECTION 5. Conflicts. All prior actions of the City Council, including resolutions, ordinances, or parts thereof, that are inconsistent with any provision of this Resolution are hereby superseded by this Resolution to the extent of such inconsistency. SECTION 6. Effective Date. This Resolution shall take immediate effect and be in full force immediately after its adoption.
