Ready, City Manager BY: Development Services Department SUMMARY Jimmy McGill, Steven Piacenza, and Bryan Rogers, the owners of Boozehounds, LLC, have initiated the application process for California Department of Alcoholic Beverages Control (ABC) Type 48 (On Sale General -Public Premises) liquor license as part of a full-service restaurant located in the former DINK'S building located at the southeast corner of North Palm Canyon Drive and West Via Escuela. The subject property is located within a Census tract area which is identified by the ABC as an area with over concentration of liquor licenses. The applicant is requesting the City Council to make a determination of public convenience or necessity for the proposed activities. RECOMMENDATION: 1) Adopt Resolution No. __ , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC CONVENIENCE OR NECESSITY WOULD BE SERVED BY THE ISSUANCE OF ALCOHOLIC BEVERAGE CONTROL LICENSE TYPE 48 FOR BOOZEHOUNDS LOCATED AT 2080 NORTH PALM CANYON DRIVE WITHIN CENSUS TRACT NUMBER 446.06." 2City Council Staff Report Page 2 of 6 January 14, 2021 Case 5.1166 PCN -Boozehounds PRIOR ACTIONS/EVENTS: }._Date .. .., .·-!> -._.,, " -~·.. ;;, --(~~ Actions/Events .,. -.~ -.. -08/22/2007 The Planning Commission approved a Major Architectural Application (3.2961 MAJ) and a Conditional Use Permit (5.1166 CUP) for a new restaurant building and associated cocktail lounge use at the subject property. 03/05/2008 A building permit was issued for construction of the 6,465 square foot restaurant building. 10/17/2012 The business license for the restaurant and liquor license for the lounge use was surrendered to the CA-ABC. 05/13/2015 The Planning Commission approved a CUP application for a new cocktail lounge and nightclub named the W Ultra Lounge. 11/23/2020 Boozehounds LLC submitted a request for Resolution of Public Convenience and Necessity. BACKGROUND AND PROJECT DESCRIPTION: The existing 6,465-square foot restaurant building with associated off-street parking lot was constructed in 2008 and operated until 2012 when the business closed and the Type 48 liquor license was surrendered to the California of Alcoholic Beverage Control. The Planning Commission granted a Conditional Use Permit (Case 5.1166 CUP) in 2007 to operate the business and in 2015 reaffirmed the entitlement by granting a second CUP at the subject location. The conditions of approval for Case 5.1166 remain in effect. The current application for Boozehounds will allow a business to occupy a restaurant building that has been vacant for many years. The applicant's justification letter describes the business as follows: "A restaurant lounge that will be dog-friendly. Following all guidelines from the health department, we will utilize our large outdoor patios for locals and visitors to bring their dogs on a short leash to enjoy socializing over a cappuccino in the morning, or a glass of wine or craft cocktail in the afternoon or evening. Our indoor dining area will strictly be for humans and their interactions. Many have called North Palm Springs as a "food desert". With this in mind, we have hired a renowned chef to create a small menu with locally sourced items that will cater to every appetite and dietary restriction." The zone designation of the subject property is General Commercial (C-1) along North Palm Canyon Drive and Multi-Family Residential (R-3) for the back portion containing the parking lot. The operation of a full-service restaurant and cocktail lounge is allowed with the approval of a Conditional Use Permit, which was granted in 2015 and remains valid. The California Department of Alcoholic Beverage Control (ABC) requires a Type 48 liquor license to operate a restaurant/cocktail lounge for the sale of wine, beer, and spirits for on-site consumption only. Restaurant 2,373 1 space 68 SF /35 SF of dining area TOTAL SPACES REQUIRED 68 69 65 3 66 3 4City Council Staff Report Page 4 of 6 January 14, 2021 Case 5.1166 PCN -Boozehounds ANALYSIS: The proposed full-service restaurant/cocktail lounge use is consistent with the General Plan designation (TRC -Tourist Resort Commercial), and is allowed in the C-1 zoning district upon approval of a Conditional Use Permit per Case 5.1166 CUP. The restaurant use is permitted by right in the C-1 zoning district. It should be noted that the parcel is split between two zoning districts; the western 250-foot portion of the site adjacent to North Palm Canyon Drive is zoned C-1, and the eastern portion of the property is zoned R-3. The restaurant building lies wholly within the C-1 portion of the property, with the parking area located on the R-3 portion of the site. A parking lot is a permitted use in the R-3 zoning district. No exterior modifications are proposed to the existing building, nor is any additional square footage being added. The site complies with the parking requirements for a restaurant use as listed in PSMC Section 93.06.00(0)(30). The applicant has applied for a Type 48 (On-Sale General) liquor license through the California Department of Alcoholic Beverages Control (ABC) to operate as a full-service restaurant and cocktail lounge for on-site consumption. The ABC identifies the Type 48 license as follows: • Type 48-On Sale General-Public Premises (Bar, Nightclub) Authorizes the sale of beer, wine, and distilled spirits for consumption on the premises where sold. Minors are not allowed to enter or remain. Food Service is not required. Pursuant to Section 23958 of the State of California Business and Professions Code, the California Department of Alcoholic Beverage Control (ABC) is required to " ... deny an application for a license if issuance of that license would tend to create a law enforcement problem, or if issuance would result in or add to an undue concentration of licenses, except as provided in Section 23958.4." Sections 23958.4(a)(2) and (3) of the Code defines the term, undue concentration, as follows: • As to on-sale retail license applications, the ratio of on-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of on-sale retail licenses to population in the county in which the applicant premises are located. [State of California Business and Professions Sections 23958. 4( a)(2)] The Section further states that a liquor license may nevertheless be issued in an area of undue overconcentration when " ... the local governing body of the area in which the applicant premises are located, or its designated subordinate officer or body, determines within 90 days of notification of a completed application that public convenience or necessity would be served by the issuance ... " [State of California Business and Professions Code, Section 23958.4(b)(2)]. 5City Council Staff Report Page 5 of 6 January 14, 2021 Case 5.1166 PCN -Boozehounds The subject property is located within Census tract number 446.06, which is identified as the west side of the north portion of Palm Canyon Drive that includes parts of Uptown and Downtown neighborhoods. According to the applicant's ABC applications, there are six (6) on-sale liquor licenses issued within this Census tract while only two (2) such licenses would be allowed. Palm Canyon Drive 125 E Tahquitz Canyon Way 140 W Via Lola The General Plan land use designation of the subject property is Tourist Resort Commercial (TRC). The General Plan states the intended use of the land use designation area as " ... providing for large-scale resort hotels and timeshares including a broad range of convenience, fitness, spa, retail, and entertainment uses principally serving resort clientele. Commercial entertainment facilities including restaurants, should be designed to be compatible with neighboring development." The project site is located along a Major Thoroughfare at a corner containing other entertainment and hotel uses. North Palm Canyon Drive is the primary commercial corridor in the Census tract number 446.06, and the site is easily accessible from the attached off-street parking lot. The project site is 1.24 -acres in area, and it is adequate in size and suitable for the proposed use. A full-service restaurant/lounge will contribute to diversifying products and services the area has to offer to local residents and visitors. The site, structure and landscaping has been maintained in good condition, therefore, the proposed use is consistent with the intent of the General Plan and will occupy a building that has been vacant for many years. Considering these attributes, staff finds that the issuance of the requested liquor licenses is suitable for the area and will serve the public convenience. FISCAL IMPACT: No fiscal impact. Boozehounds, LLC has initiated the application process for California Department of Alcoholic Beverage Control (ABC) Type 48 (On Sale General -Public Premises) liquor license for the operation of a full-service restaurant and cocktail lounge located at 2080 North Palm Canyon Drive, Census Tract No. 446.06, Zone C-1/R-3, APN 504-320-001. B. The California Department of Alcoholic Beverages and Control (ABC) has determined that: 1) there are six (6) existing on-sale liquor licenses issued within Census tract number 446.06 while only two (2) of such permits would be allowed based on on-sale retail licenses to population in the County in which the applicant's premise is located. C. The California Department of Alcoholic Beverages and Control (ABC) has determined that there is an "undue concentration" of alcohol-related licenses in the Census tract number 446.06. D. Pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license. E. Boozehounds, LLC is located within Census tract number 446.06. The zone designation is General Commercial (C-1), and it is located within the Tourist Resort Commercial (TRC) General Plan land use designation area. The proposed full-service restaurant and lounge located within an existing building is consistent with the intent of the General Plan because: 1) a Conditional Use Permit was approved by the Planning Commission (Case 5.1166 CUP) on May, 13, 2015 for a full-service restaurant and lounge; 2) the project site is adequate in size and suitable for the proposed uses; 3) the site is easily accessible from an attached off-street parking lot; and 4) the issuance of the requested licenses will contribute to diversifying products and services the area has to offer to local residents and visitors. Pre-COVID, the three members of this team spent a considerable amount of time and money working towards another property on South Palm Canyon. We restarted our search in September and discovered that the old Dink's/Glitch building was available. This has always been a favorite building of ours, for it's one of the first structures visitors see as they enter the "gateway" to our amazing city. Our goal, and something we are in the process of completing, is to fully rebrand and update this special corner lot. In fact, we've already had a half dozen individuals from the Palm Springs Police Department stop by to check on the property and they're very excited about our proposal as a community friendly location. Our name can be taken literally ... BOOZE(HOUNDS). It's a restaurant lounge that will be dog-friendly. Once completed, we will attach it to our current minor architectural submission for review. Many have called North Palm Springs a "food desert." With this in mind, we have hired a renowned chef to create a small menu with locally-sourced items that will cater to every appetite and dietary restriction. With our friends and neighbors at Billy Reed's, Rick's, Infusion, The Palm Springs Aerial Tram, The Cole, the new Margaritaville, etc., we hope to play a very important role in helping to revitalize this great sector of our city. We realize we are competing with Arenas, Downtown PS, and Agua Caliente, and we fully accept the challenge with exciting new ideas. About us: Jimmy McGill, Steve Piacenza, and Bryan Rogers are all entrepreneurs and residents. Jimmy McGill has the top tour company in Beverly Hills {www.glitteratitours.com), Bryan Rogers and his wife Jeni have a thriving photography company {ravenandthewillow.com), and Steve Piacenza has a background in DIV and hosting his own craft shows on HGTV. At a minimum, we will be supplying at least 20 jobs in hospitality. As community members, we also plan on fund raising to be a major factor. Every member/owner · is a volunteer for animal services, so a large benefactor will certainly include The Palm Springs Animal Shelter. Most importantly, we've always desired a location where different generations can gather for communication and community. Boozehounds will not be a nightclub. Instead, we plan on a comfortable lounge and restaurant environment where guests don't have to compete with loud music to have a simple conversation. We will have soft recorded music that will span the decades. There will be no live shows/performances, D.J.'s, microphones, etc. We will also have outstanding WiFi for guests that want a relaxing workspace in the morning.
