Senate Bill 9 (SB 9)•Signed into law on 9/16/21, effective January 2022•Applicable to all cities and counties (incl. charter cities)•Requires staff-level approval of:1. Division of existing single-family lot into 2 lots (“Urban Lot Split”)2. Development of two residential units on a single-family lotDEVELOPMENTSERVICESDEPARTMENT
Urban Lot Split•Allows division of existing single-family lot into two lots via tentative parcel map application•Must have street frontage•Must be 2,400 SF or larger to split•Resulting lots must be approximately equal in size (no more than 60/40 split)10,000 SF lot = (2) 5,000 SF lots or(1) 6,000 SF & (1) 4,000 SF lotDEVELOPMENTSERVICESDEPARTMENT
Urban Lot SplitRestrictions:•Must not be a historic landmark or within a historic district•Must not involve demolition/alteration of protected housing•Short-term rentals prohibited•Owner-occupied for minimum of 3 years•City cannot require dedications, off-site improvementsDEVELOPMENTSERVICESDEPARTMENT

Two-Unit Development•Allowed on any existing single-family lot or any lot created by an Urban Lot Split•New units created under the ordinance are limited to 800 SF in area; existing units may be maintained at current square footage•Side and rear-yard setbacks may be reduced to as little as 4’ to accommodate a 2ndunit•Parking – 1 space per unit (reductions allowed)DEVELOPMENTSERVICESDEPARTMENT
