HomeMy WebLinkAboutPresentation - Updates on SB 1383 and Food Ware Ordinance 2022-01-13Updates on SB 1383 and Food Ware Ordinance OFFICE OF SUSTAINABILITY SB 1383:California’s Climate Pollutant Reduction Strategy •Senate Bill 1383 (SB 1383)is a law enacted by the State of California to reduce emissions of short-lived climate pollutants (like organic waste). •It sets a goal to reduce organics waste in landfills by 75%and to rescue at least 20%of currently disposed edible food by 2025. •SB 1383 went into effect on January 1,2022 and has an anticipated implementation date in Palm Springs of October 1,2022. •Reason for delayed implementation is equipment delays and supply chain issues. SB 1383: Implementation Schedule •All residents will have three (3) bin system by October 1, 2022. Brown cart:Refuse/landfill Blue cart:Recycling Green cart:Yard and food waste •When Green cart service begins, residents will be asked to place their food waste in a plastic bag and place that bag in the Green cart with the yard waste in the same container. •Residents can choose from a 95, 65 or 35-gallon rolling cart depending on how much Green Waste they may generate. SB 1383 Franchise Agreement Status It is anticipated the Franchise Agreement will be presented to City Council in February 2022 Public hearing notice (per Proposition 218) advertising new rates to be issued in May 2022 Public Hearing for new rates may be held 45 days after public hearing notice is issued New rates for residential customers to begin by October 1, 2022 SB 1383 Resolutions –January 27th City Council SB 619 Notification of Intent to Comply CalRecycle will waive civil penalties if a jurisdiction submits a Notification of Intent to Comply with the regulatory requirements and successfully implements a plan to correct any violations Requires a Resolution passed by City Council, which is scheduled for the 1/27/22 Consent Agenda Grant opportunity SB 1383 Local Assistance Grant Application due February 1st; $63,000 award amount Application requires a Resolution passed by City Council, which is scheduled for the 1/27/22 Consent Agenda Food Ware Ordinance Food Ware Ordinance Ordinance in Effect on January 1, 2022 •Two consultants providing technical assistance to business: Abbe and Associates and ReCREATE. •During the month of December, 91 businesses were contacted and provided with technical assistance. Food Ware Ordinance Support: Outreach Support offered to businesses through: Technical support from consultants via phone, email and in-person site visits. Scholarship program to assist with implementation costs. Development of signage for businesses to use informing customers of ordinance. Food Ware Ordinance Support: Scholarships, Exemption Requests A scholarship has been created to help businesses comply with the new requirements including: •Purchase of reusable food service ware (plates, glassware, cups, trays, baskets, cutlery, linens) •Purchase equipment to wash and sanitize reusable food service ware and/or linens •Purchase of bulk dispensers for condiments Exemptions offered on an annual basis for extenuating circumstances (straws/lids for certain products, storage space) Questions and Support - Office of Sustainability: 760-323-8248
