HomeMy WebLinkAbout1994ORDINANCE NO. 1994 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY OF PALM SPRINGS. City Attorney's Summary This Ordinance authorizes and approves an amendment to the contract between the City of Palm Springs and the Board of Administration of the California Public Employees' Retirement System (PERS) in order to implement the recently adopted Memoranda of Understandings between the City and the Palm Springs Firefighters' Assocation and the Palm Springs Fire Management Assocation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES ORDAIN AS FOLLOWS: SECTION 1. Approval of Amendment. An amendment to the contract between the City Council of the City of Palm Springs and the Board of Administration of the California Public Employees' Reitrement System is hereby authorized and approved, a copy of said amendment being attached hereto, marked "Exhibit A", and by such reference made a part hereof as though herein set out in full, as on file in the office of the City Clerk. SECTION 2. Authority to Execute. The City Manager of the City of Palm Springs is hereby authorized, empowered, and directed to execute said amendment for and on behalf of the City Council and the City of Palm Springs. SECTION 3. Urgency Findings. Pursuant to City Charter Section 312 and California Government Code Section 36937, this Ordinance is designed to protect the health, safety and welfare of the citizens of the City of Palm Springs and becomes effective immediately up adoption by a four -fifths (4/5) vote of the City Council. The City Council hereby finds that there is an urgent need to adopt this Ordinance as an urgency ordinance, so that it may go into effect immediately and be in place before the first payroll period in the 2019/2020 fiscal year. SECTION 4. Certificaiton/Effective Date. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect on June 6, 2019. SECTION 5. CEQA. The City Council finds that this action is not a "Project" as Urgency Ordinance No. 1994 Page 2 defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The ordinance approving this amendment is exempt from CEQA pursuant to Section 15378(b)(5) -- organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. A reasonable amount, as fixed by the Board, payable in one installment within 60 days of date of contract to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. C. A reasonable amount, as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special valuations on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law. 17. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Law. 18. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within fifteen days after the end of the period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may be made by direct payments between the employee and the Board. B.
