HomeMy WebLinkAbout24647RESOLUTION NO. 24647 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING MODIFIED USER FEE INCREASES RELATED TO THE BUILDING, FIRE AND PLANNING SERVICES DEPARTMENTS AND AMENDING THE COMPREHENSIVE FEE SCHEDULE FOR FISCAL YEAR 2019-20. WHEREAS, the City, under various statutory provisions under California Government Code, may set and collect fees for the costs of providing various public services to the community; and WHEREAS, the City retained a qualified consultant to prepare a User Fee Study and Cost Allocation Plan, to compare direct and indirect administrative costs in providing various public services to the community; and WHEREAS, the User Fee Study estimated that the City's current developer fees associated with the Building, Engineering, Fire, and Planning Services Departments (the "Developer Fees"), do not fully fund the total cost of services provided by the City in those Departments, and the full cost recovery recommended by the User Fee Study would generate an additional $1,351,188 in revenue through increased Developer Fees to ensure the City was adequately recovering its costs to provide services in those Departments; and WHEREAS, the increased Developer Fees proposed modifications to certain development fees, permit fees, and/or regulatory fees that are subject to the Mitigation Fee Act, codified at California Government Code (CGC) §66000 et seq., and more specifically in accordance with CGC §66016, §66013, or §66014, and the City, in considering the User Fee Study, adhered to the procedures of CGC §66016(a); and WHEREAS, on June 5, 2019, following legal notice in accordance with CGC §66000 et seq., the City Council conducted a public hearing, at which oral and written presentations were made, as part of the City Council's regularly scheduled meeting to review and consider approval of: (1) the User Fee Study and Cost Allocation Plan, (2) the Fiscal Year 2019-20 Comprehensive Fee Schedule, and (3) a policy for adjustments to user fees and charges commencing with Fiscal Year 2020-21 (the "CPI Increase"); and WHEREAS, on June 5, 2019, pursuant to CGC §66000 et seq., the City Council did adopt Resolution No. 24622 approving increases to certain User Fees, including the Developer Fees; and WHEREAS, pursuant to its action adopting Resolution No. 24622, the City Council deferred the full cost recovery associated with the Developer Fees by phasing the total fee increase related thereto, whereby 50% of the proposed increase will be implemented in Fiscal Year 2019-20 and the remaining total fee increase will be implemented in Fiscal Resolution No. 24647 Page 2 Year 2020-21 with the CPI Increase, (the "Fee Increase Phasing"), in accordance with and following the statutory requirements identified in CGC §66000 et seq.; and WHEREAS, the City estimates that the Fee Increase Phasing will result in a reduction of $675,594 in revenue necessary to fully recover the City's costs for providing services paid for through Developer Fees; and WHEREAS, on June 19, 2019, the City Council conducted a duly noticed Public Hearing with respect to the Fiscal Year 2019-20 and Fiscal Year 2020-21 Budget in which the City incorporated $750,000 of additional revenue associated with the increased Developer Fees, and where the Fee Increase Phasing caused a deficit to be resolved through certain alternative funding recommendations identified by City staff; and WHEREAS, on June 19, 2019, pursuant to City Charter Section 903 and applicable law, the City Council did adopt Resolution No. 24636 approving the Budget for Fiscal Year 2019-20 and Fiscal Year 2020-21, incorporating alternative funding recommendations to provide a balanced budget, with direction to City staff to schedule a public hearing for July 10, 2019, pursuant to CGC §66000 et seq., to reconsider the Fee Increase Phasing in a way to reduce its fiscal impact to the Fiscal Year 2019-20 Budget; and WHEREAS, on July 10, 2019, pursuant to CGC §66000 et seq., the City Council held a public hearing to consider amending its action on June 5, 2019, relating to adoption of increases to certain User Fees, including the Developer Fees; and WHEREAS, the City Council continued the July 10, 2019, public hearing to July 24, 2019, to give further consideration to amending its action on June 5, 2019, relating to adoption of increases to certain User Fees, including the Developer Fees; and WHEREAS, notice of the July 24, 2019 public hearing was published, posted and distributed in accordance with the provisions of the California Government Code; and WHEREAS, the public data indicating the amount of cost, or estimated cost, required to provide the services for which the fees or service charges are levied and the revenue sources anticipated to provide the service, including General Fund revenues, (the "Fee Data"), was previously provided and made available at least 10 days prior to the initial June 5, 2019 public hearing, at which the City Council considered the increased Developer Fees; and WHEREAS, the public data remains unchanged for the purposes of the continued July 24, 2019, public hearing to reconsider the Fee Increase Phasing, and was previously made available at least 10 days prior to the July 10, 2019 public hearing; and WHEREAS, on July 24, 2019, the City Council conducted a public hearing, at which oral and written presentations could be made, as part of the City Council's regularly scheduled meeting; and Resolution No. 24647 Page 3 WHEREAS, the City Council has considered any verbal and/or written testimony, and has reviewed and considered the information in the study and supporting data, and information provided at the public hearing by staff and the public. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, HEREBY RESOLVES, DETERMINES AND APPROVES AF FOLLOWS: SECTION 1. Factual Findings Pursuant to Government Code §66013, §66014, or §66016. A. The City has completed an analysis of certain City fees and charges and desires to amend the fees and charges. B. The current user fees are insufficient to cover all the City's costs and expenses associated with providing the various public services. C. The cost of such services should be borne by those who are the special beneficiaries rather than the citizenry at large. D. There is a reasonable relationship between the amount of the fee and the estimated reasonable cost of providing the type of services for which the fee is imposed. E. The amount of services provided does not exceed what is reasonably necessary in order to process the requested service. F. The cost estimates set forth in the User Fee Study are reasonable and best approximate the direct and indirect (overhead) costs of City staff and consultants for providing the necessary service to respond to public requests. G. The method of allocating the City's administrative costs of processing service bears a fair and reasonable relationship to the public burden on, and benefit from, the services requested by the public. H. The fees do not exceed the estimated reasonable cost of providing the service for which the fee is charged. SECTION 2. Fees Imposed. A. The City Council hereby amends the Comprehensive Fee Schedule adopted on June 5, 2019, and included as Exhibit B of Resolution No. 24622, specifically related to Developer Fees subject to the Mitigation Fee Act, codified at California Government Code (CGC) §66000 et seq., as follows: 1. Implement the full increase for all Building Fees upon the effective date of this Resolution. Resolution No. 24647 Page 4 2. Implement the full increase for all Fire Prevention New Construction Plan Check and Inspection Fees listed under the Building Fees upon the effective date of this Resolution. 3. Implement the full increase for all Planning Fees upon the effective date of this Resolution. 4. Implement the full increase of all Engineering Fees upon the effective date of this Resolution. B. All other User Fee increases not subject to the Mitigation Fee Act, codified at California Government Code (CGC) §66000 et seq., are not affected by this Resolution, and shall be implemented as approved on June 5, 2019. C. Each person requesting a service in the City of Palm Springs for which a user fee or charge is imposed shall pay the new fees as set forth in the City's Comprehensive Fee Schedule. D. The user fees and charges may also be adjusted if the City conducts a public hearing, when required, to implement a new or revised fee or fees based upon a new study or analysis. E. The adoption of this Resolution does not affect the ability of the City to request an agreement between an applicant and the City to pay extraordinary processing costs and to establish deposit accounts. F. The City Council, in its discretion, may waive or reduce applicable fees for residential projects that construct lower -cost housing, workforce housing, or affordable housing meeting state mandated income levels. SECTION 3. Severability. Each component of the fees and all portions of this Resolution are severable. Should any individual component of the fee or other provision of this Resolution be adjudicated to be invalid and unenforceable, the remaining provisions shall be and continue to be fully effective, and the fee shall be fully effective except as to that portion that has been judged to be invalid. SECTION 4. Effective Date. In accordance with Government Code §66017, all modified development fees, permit fees, and/or regulatory fees that are subject to Government Code §66000 et seq. shall be effective sixty (60) days after the adoption of this Resolution. The Director of Finance is hereby authorized and directed to incorporate the modified Developer Fees identified in Section 2(A) of this Resolution into the Comprehensive Fee Schedule.
