HomeMy WebLinkAbout24642RESOLUTION NO. 24642 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC CONVENIENCE WOULD BE SERVED BY THE ISSUANCE OF ALCOHOLIC BEVERAGE CONTROL LICENSE TYPE 21 (OFF -SALE GENERAL) AT 300 NORTH INDIAN CANYON DRIVE WITHIN CENSUS TRACT #9414. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Gergis Yousef of Palm Springs Car Wash has initiated the application process for a California Department of Alcoholic Beverage Control (ABC) Type 21 (Off -Sale General) license to sell beer, wine, and distilled spirits for off -premise consumption at 300 North Indian Canyon Drive, Census Tract No. 9414, Zone REO, APN 505-031-021. B. The California Department of Alcoholic Beverages and Control (ABC) has determined that there are three (3) existing alcohol licenses within Census Tract No. 9414, while one (1) alcohol license would be allowed based on off -sale retail licenses to population in the County in which the applicant's premise is located. C. The California Department of Alcoholic Beverages and Control (ABC) has determined that there is an "undue concentration" of alcohol -related licenses in the Census Tract No. 9414. D. Pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license. E. Palm Springs Car Wash is located in Census Tract No. 9414 within the Tourist - Resort -Commercial (TRC) General Plan land use designation area and the Section 14 Specific Plan REO (Retail -Entertainment -Office) land use designation area. The sale of alcoholic beverages for off -premise consumption is consistent with the intent of the General Plan and the REO land use designation area because: 1) it provides convenience to consumers by providing products that are ready for purchase; 2) the project site is easily accessible from hotels and other resort -related amenities in Downtown without the need of vehicular transportation as intended for the area; and 3) the sales of packaged alcoholic beverages will serve the local tourism by diversifying the products and services the area has to offer. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES: That the public convenience would be served by the issuance of Type 21 (Off -Sale General) alcoholic beverage license for the sales of beer, wine and distilled spirits for off- Resolution No. 24642 Page 2 premise consumption at Palm Springs Car Wash located at 300 North Indian Canyon Drive, Census Tract No. 9414, Section 14/T4/R4.
