A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, CERTIFYING A MITIGATED
NEGATIVE DECLARATION (MND) FOR A PROPOSED
GENERAL PLAN AMENDMENT, A PLANNED
DEVELOPMENT DISTRICT IN LIEU OF A CHANGE OF
ZONE, A MAJOR ARCHITECTURAL APPLICATION, AND A
DEVELOPMENT AGREEMENT FOR ACTIVITIES AT THE
13.2-ACRE DESERT AIDS PROJECT CAMPUS TO
INCLUDE AN 18,000-SQUARE FOOT MEDICAL OFFICE
ADDITION AND SIXTY-ONE (61) UNIT SPECIAL NEEDS
HOUSING APARTMENTS LOCATED AT 1695 NORTH
SUNRISE WAY.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS AND
DETERMINES AS FOLLOWS:
A. Desert Aids Project and the Coachella Valley Housing Coalition ("Applicant") filed
applications pursuant to Palm Springs Zoning Code (PSZC) Section 94.04 (Architectural
Review), Section 94.03 (Planned Development District), and California Government Code
Sections 65350-65362 (General Plan Amendment) for an 18,000-square foot addition
connecting the DAP Building to the adjacent DAP Annex, site and landscape
improvements, and the construction of Vista Sunrise II (61-unit) special needs housing
apartment building (APN's 507-100-026,-041,-042,-044,-045) ("Project").
B. The Project is considered a "project" by the California Environmental Quality Act
(CEQA).
C. On October 1, 2020, the City issued a Notice of Intent (NOI) to adopt a Mitigated
Negative Declaration (MND). The NOI was circulated to responsible agencies and
interested groups and individuals for review and comment. An Initial Study (IS) was
prepared by the Altum Group and circulated for a 20-day public review period from
October 6 to October 26, 2020.
D. The City received no written comments on the circulated MND and a Notice of
Determination (NOD) was prepared and filed.
E. Notice of a public hearing of the Planning Commission of the City of Palm Springs
to consider the Project was given in accordance with applicable law for the meeting of
November 18, 2020.
F. On November 18, 2020, the Planning Commission held a public hearing on the
Project in accordance with applicable law. Upon reviewing and considering all evidence
presented, the Planning Commission voted to recommend that the City Council certify the
MND, make all required findings and statements, and adopt all mitigation measures.

G. On December 10, 2020, the City Council held a public hearing on the Project in
accordance with applicable law. The City Council carefully reviewed and considered the
information contained in the MND, all of the evidence presented in connection with the
meetings on the Project including, but not limited to, staff reports on all aspects of the
Project, and all written and oral testimony presented, and found the MND to be in
compliance with CEQA and found that any potentially significant environmental impacts
outlined in the report will be adequately mitigated to less that significant levels.
H. A Mitigation Monitoring Program prepared for the MND pursuant to CEQA has
been incorporated into the Project whereby potentially significant environmental impacts
will be mitigated to less than significant levels.
I. The certification of the MND, and approval of the Mitigation Monitoring Plan, is
consistent with the provisions of CEQA.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS
FOLLOWS:
SECTION 1. The Initial Study (IS) is an adequate assessment of the potential
environmental impacts of the proposed Project under the guidelines of the CEQA. The
IS has been prepared, published, circulated and reviewed in accordance with CEQA, the
State CEQA Guidelines and the provisions of the City of Palm Springs. The mitigation
measures outlined in the Mitigation Monitoring Plan are sufficient and adequate to reduce
potentially significant environmental impacts to less than significant levels.
SECTION 2. The City Council has reviewed and considered the information
contained in the IS prior to approval of the Project and the IS reflects the City's
independent judgment and analysis.
SECTION 3. The City Council hereby certifies the MND and adopts the Mitigation
Monitoring Plan for the project, attached to this Resolution as Exhibit A. The documents
that constitute the record of proceedings are located at 3200 E. Tahquitz Canyon Way,
Palm Springs, California 92262, and the custodian for these documents is the City Clerk.
