A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, APPROVING A PIPELINE
CROSSING AGREEMENT WITH THE UNION PACIFIC
RAILROAD COMPANY FOR THE EXTENSION OF A
SEWER LINE WITHIN AND ACROSS UNION PACIFIC
RAILROAD COMPANY RIGHT OF WAY TO BE
CONSTRUCTED AS PART OF THE INDIAN CANYON
DRIVE WIDENING AND BRIDGE REPLACEMENT, CITY
PROJECT NO. 01-11, FEDERAL AID PROJECT NO. BRLO

WHEREAS, the City of Palm Springs has been actively working since 2000 to
deliver a major capital project to widen Indian Canyon Drive from the Union Pacific
Railroad ("UPRR") bridge to Garnet Avenue, from 2 lanes to 6 lanes, identified as the
Indian Canyon Drive Widening and Bridge Replacement, City Project No. 01-11,
Federal Aid Project No. BRLO 5282 (017), (the "Project"); and
WHEREAS, the scope of the Project includes removal of the existing 2-lane
UPRR bridge and construction of a new 6-lane bridge, and widening of Indian Canyon
Drive to 6-lanes from the UPRR bridge to Garnet Avenue; and
WHEREAS, the commercial and industrial area of Palm Springs located north of
the UPRR bridge does not have a public sewer system and is located in an area defined
by the Colorado River Regional Water Quality Control Board (the "Board") as an area of
special concern due to the exceptional quality of the underground water aquifer; and
WHEREAS, in its Plan for Services and Environmental Impact Report prepared
for Annexation No. 26 approved by the Local Agency Formation Commission of
Riverside County ("LAFCO"), the City expressly identified that the City would extend or
provide new public sanitary sewer service to that area of Palm Springs following its
annexation by the City; and
WHEREAS, the City's Environmental Impact Report prepared for Annexation No.
26 was certified on May 19, 1993; and
WHEREAS, in its findings to approve Annexation No. 26 designated as LAFCO
No. 93-28-3, LAFCO identified the following findings: (2) The reorganization is proposed
to provide more municipal services by the City of Palm Springs; and (4) The City of
Palm Springs, as lead agency, certified an Environmental Impact Report and has
complied with the California Environmental Quality Act and all appropriate State
Guidelines, and the Commission has reviewed and considered the environmental
documentation; and

WHEREAS, the City is considering the extension of a new public sanitary sewer
line within Indian Canyon Drive from Tramview Road north to Garnet Avenue as a
means of providing public sewer service to the commercial and industrial area of Palm
Springs located north of the UPRR bridge consistent with its expressed intention of
providing such public service in Annexation No. 26 approved by LAFCO; and
WHEREAS, extension of a new public sewer line across UPRR right-of-way will
require installation of an 18 inch diameter steel encasement with a 10 inch diameter DIP
sewer pipe through a "jack -and -bore" operation where the steel encasement is tunneled
underneath the UPRR right-of-way; and
WHEREAS, the opportunity to jack -and -bore underneath the UPRR right-of-way
can only occur concurrent with the City's removal of the existing 2-lane UPRR bridge
and construction of the new 6-lane bridge; and
WHEREAS, it is important to ensure the City Council can consider the option of
including the sewer line extension across UPRR right-of-way as part of the Project; and
WHEREAS, the UPRR has prepared a Pipeline Crossing Agreement approving
the sewer line extension across UPRR right-of-way.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. The Pipeline Crossing Agreement with Union Pacific Railroad
Company providing for the construction of an 18 inch diameter steel encasement with a
10 inch diameter DIP sewer pipe across Union Pacific Railroad Company right-of-way,
and providing for the City's operation of the public sewer line, is hereby approved.
SECTION 2. The City Manager is authorized to execute the Pipeline Crossing
Agreement with Union Pacific Railroad Company on behalf of the City of Palm Springs.
ADOPTED THIS 10TH DAY OF SEPTEMBER 2020.
