HomeMy WebLinkAbout24772RESOLUTION NO. 24772 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, REQUESTING A DISBURSEMENT OF FUNDS FROM RIVERSIDE COUNTY'S CARES ACT PAYMENT TO FUND THE CITY'S NECESSARY EXPENDITURES INCURRED RELATING TO THE PUBLIC HEALTH EMERGENCY WITH RESPECT TO THE CORONAVIRUS DISEASE 2019 (COVID-19) THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council finds and declares as follows: A. On March 4, 2020, Governor Gavin Newsom declared a State of Emergency due to the number of confirmed cases of the novel coronavirus ("COVID-19") in the state of California. B. On March 14, 2020, the City Manager/Director of Emergency Services declared the existence of a local emergency within the City of Palm Springs due to the threat presented by the continuing spread of COVID-19 in the community. C. On March 17, 2020, pursuant to the declaration of a local emergency, the City Manager/Director of Emergency Services issued a Shelter -in -Place Order to ensure that persons within the City not leave their homes, except for essential activities, as defined in the Order. D. On March 19, 2020, the City Council adopted Resolution No. 24738 ratifying and confirming the Declaration of the Existence of a Local Emergency relating to COVID-19 in the City of Palm Springs, as issued by the City Manager/Director of Emergency Services on March 14, 2020, and ratified the City's Shelter -in -Place Order. E. On March 19, 2020, Governor Newsom issued Executive Order N-33-20 ordering all individuals living in the State of California to stay home or at their place of residence except as needed to maintain continuity of operations of the federal critical infrastructure sectors, effective March 19, 2020, and in effect indefinitely until rescinded by the Governor. F. Due to the threat presented by the COVID-19 pandemic, and the State of Emergency declared by Governor Newsom, the Local Emergency and Shelter -in -Place Order ratified by this City Council, and the Executive Order issued by Governor Newsom, the City Manager/Director of Emergency Services has issued Supplemental Orders and directed its Departments to appropriately respond to the COVID-19 pandemic occurring within the City. G. As a result of the State of Emergency and Local Emergency relating to COVID-19, the City has, and will continue to incur necessary expenditures due to the public health emergency with respect to COVID-19. The City's 2019/2020 Fiscal Year budget in effect as of March 27, 2020, did not account for all of the expenditures necessary to contain and mitigate the effects of COVID-19. On March 27, 2020, the federal government enacted the Coronavirus Aid, Relief, and Economic Security Act ("CARES Act") providing funding in the amount of $2.2 trillion to provide relief to those impacted by the COVID-19 pandemic. The CARES Act funding includes the Coronavirus Relief Fund in the amount of $150 billion. Pursuant to the CARES Act, States and certain local governments, including Riverside County, will receive payments for specified uses to contain and mitigate the effects of COVID-19. J. The State of California will receive $15.3 billion from the Coronavirus Relief Fund, from which Riverside County has received $431 million as a direct payment to cover costs necessary to respond to the ongoing public health emergency related to COVID-19. K. The CARES Act specifically excluded direct payments to units of local government with a population less than 500,000 thereby excluding any direct relief to the City of Palm Springs. L. The City Council hereby finds that the conditions described in the foregoing recitals related to COVID-19 warrant and necessitate the City Council's request to Riverside County to allocate sufficient funds from its direct payment of $431 million to the City of Palm Springs to cover all of the City's costs necessary to respond to the ongoing public health emergency related to COVID-19 that will otherwise not be reimbursed through any Federal or State Disaster Declaration related to COVID-19 issued by the President or Governor. SECTION 2. The City Council hereby requests that the Mayor send a certified copy of this executed Resolution on behalf of the entire City Council to the Riverside County Board of Supervisors, accompanied by a letter identifying a formal request for disbursement of funds to the City of Palm Springs from Riverside County's direct CARES Act payment in an amount determined by the City Manager that will be sufficient to cover the City's unanticipated costs directly related to responding to the COVID-19 pandemic.
