HomeMy WebLinkAbout24768RESOLUTION NO. 24768 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MINOR ARCHITECTURAL APPLICATION (CASE NO. 3.4166 MAA) TO RE -PAINT AND INSTALL WINDOW TREATMENTSATA PROPOSED CANNABIS DISPENSARY & LOUNG LOCATED AT 757 SOUTH WILLIAMS ROAD. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Ash's First, LLC ("Applicant") has filed a Minor Architectural application (Case 3.4166 MAA) with the City pursuant to Section 94.04.00 (Architectural Review) of the Palm Springs Zoning Code (PSZC) for minor exterior enhancements to a proposed cannabis dispensary and lounge occupying approximately 2,400-square feet of space within a multi -tenant property at 757 South Williams Road (APN 680-160-018), Zone M-1. (This application is referred herein as the "Project".) B. On June 15, 2020, the Architectural Advisory Committee reviewed the proposed Project and voted unanimously to recommend approval. C. Due to the Project involving a cannabis dispensary and lounge, the City Council shall review and make a decision on this Project, in accordance with Section 93.23.15(F)(3) of the Zoning Code. D. On June 25, 2020, the City Council held a regularly scheduled meeting and reviewed the Project in accordance with applicable law, and carefully considered all of the evidence presented in connection the Project, including but not limited to the staff report and all written and oral testimony presented. E. The proposed Project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, because the project involves minor alterations to an existing building. F. Pursuant to Section 94.04.00(D) of the Palm Springs Zoning Code, the City Council finds: The City Council has examined the material submitted with the architectural approval application and has examined specific aspects of the design and determined the proposed development will (1) provide desirable environment for its occupants; (2) is compatible with the character of adjacent and surrounding developments, and (3) aesthetically it is of good composition, materials, textures and colors. The City Council's evaluation is based on consideration of the following: 1. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas; i.e., sidewalks as distinct from parking lot areas. Resolution No. 24768 Page 2 (Existing, no changes proposed.) 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted; (Existing, no changes proposed.) 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment; (Existing, no changes proposed.) 4. Building design, materials and colors to be sympathetic with desert surroundings; The proposed colors will match the neutral beige and brown that exist on the building and continue to be sympathetic to the natural colors found in the desert surroundings. 5. Harmony of materials, colors and composition of those elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously; The building will be refreshed with new paint to match existing colors. Existing window graphics will be removed and a new translucent film will be applied, eliminating the appearance of window clutter and providing a clean storefront appearance that is harmonious along the street. 6. Consistency of composition and treatment; Building colors will be applied consistent with existing conditions. 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials; (Existing, no changes proposed.) 8. Signs and graphics, as understood in architectural design including materials and colors. Signage will be evaluated under separate application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the City Council hereby approves the Project, Case 3.4166 MAA, for minor exterior enhancements to a proposed cannabis dispensary and lounge at 757 South Williams Road, subject to the Applicant installing an interior partition wall between the entry door/lobby and lounge area to comply with Section 93.23.15(F)(6) of the Palm Springs Zoning Code regarding the visual screening of smoking areas.
