A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, CONSENTING TO THE
ENFORCEMENT OF ALL HEALTH LAWS WITHIN THE
CITY OF PALM SPRINGS BY THE RIVERSIDE COUNTY
HEALTH OFFICER
WHEREAS, the United States of America has confirmed cases of individuals who
have a severe acute respiratory illness caused by a novel (new) coronavirus ("COVID-
19" or "the virus") first detected in Wuhan, Hubei Province, People's Republic of China
("China"). The virus was first reported in China on December 31, 2019. As of March 2,
2020, the World Health Organization ("WHO") reported more than 3,000 deaths
stemming from approximately 89,009 confirmed cases of COVID-19 and the virus is
present in 67 countries; and
WHEREAS, the number of confirmed COVID-19 cases has continued to escalate
dramatically over a short period of time; and
WHEREAS, WHO officials now report that sustained human -to -human
transmission of the virus is occurring. Transmission from asymptomatic individuals has
been documented. Suspected community transmission of the virus is occurring in the
United States; and
WHEREAS, although the majority of individuals infected with COVID-19 recover
from the disease without special treatment, there is significant potential for serious
infection and death; and
WHEREAS, the City of Palm Springs does not currently possess an appointed
health official; and
WHEREAS, California Health & Safety Code Section 101460 requires a city to
appoint a health officer except when the City Council has made arrangements for the
county to exercise the same powers and duties within the city as are conferred upon city
health officers by law; and
WHEREAS, California Health & Safety Code Section 101375 authorizes the
county health officer to enforce all health laws within an incorporated city with the
consent of the city council.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the foregoing Recitals are true and correct and are
incorporated herein by this reference.
SECTION 2. The City Council of the City of Palm Springs hereby authorizes the
"Health Officer' to mean the Riverside County Health Officer acting as the City Health

SECTION 3. The City Council of the City of Palm Springs authorizes and directs
the Riverside County Health Officer to enforce and observe: (a) all orders and
quarantine regulations, rules prescribed by the State Department of Public Health and
other rules and regulations issued under the California Health and Safety Code; and (b)
all statutes, ordinances, regulations and rules relating to public health, all as provided
for in California Health & Safety Code Section 101375 within the City of Palm Springs.
