HomeMy WebLinkAbout24827RESOLUTION NO. 24827 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MINOR ARCHITECTURAL REVIEW APPLICATION (CASE NO. 3.1437 MAA) TO ALTER THE EXTERIOR ELEVATIONS OF AN EXISTING COMMERCIAL BUILDING FOR A NEW CANNABIS DISPENSARY, HITS STUDIO, LOCATED AT 155 SOUTH PALM CANYON DRIVE SUITE Al. (APN 513-143-019, ZONE CBD, SECTION 15) THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Craig Bouman of Hits Studio ("Applicant") has filed a Minor Architectural application (Case 3.1437 MAA) with the City pursuant to Section 94.04.00 (Architectural Review) of the Palm Springs Zoning Code (PSZC) to alter the exterior elevations of a commercial building for a new cannabis dispensary located at 155 South Palm Canyon Drive (APN: 513-143-019), Zone CBD. B. On October 5, 2020, the Architectural Advisory Committee reviewed the proposed Project and voted unanimously to recommend approval of the project subject to conditions of approval. C. Due to the project involving a cannabis dispensary, the City Council shall review and make a decision on this project, in accordance with Palm Springs Zoning Code Section 93.23.15(F)(3) of the Zoning Code. D. On November 12, 2020, the City Council held a regularly scheduled meeting and reviewed the project in accordance with applicable law, and carefully considered all of the evidence presented in connection the project, including but not limited to the staff report and all written and oral testimony presented. E. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, because the project involves minor alterations to an existing building. F. Pursuant to Section 94.04.00(D) of the Palm Springs Zoning Code, the City Council finds: The City Council has examined the material submitted with the architectural approval application and has examined specific aspects of the design and determined the proposed development will (1) provide desirable environment for its occupants; (2) is compatible with the character of adjacent and surrounding developments, and (3) aesthetically it is of good composition, materials, textures and colors. The City Council's evaluation is based on consideration of the following: Resolution No. 24827 Page 2 9. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas; i.e., sidewalks as distinct from parking lot areas. The project will not alter the existing site layout, including the pedestrian and vehicular areas and sidewalks. 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted; The primary elevation of the Mercado Plaza on the Palm Canyon Drive frontage is painted in alternating colors to create rhythm and make the staggered building facades appear cohesive when they are viewed as a whole. The project site is currently painted in light brown color with a touch of orange hue. The proposed beige paint is compatible with the paint color scheme of the Mercado Plaza. 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment; The project does not involve any changes to the building height, setbacks, or overall mass, including any walls or screen. No mechanical equipment installation is proposed as a part of this application. 4. Building design, materials and colors to be sympathetic with desert surroundings; The proposed beige paint resembles the color of desert rocks and stones, and the proposed paint color and Cantera stone tiles are compatible with the desert surroundings. 5. Harmony of materials, colors and composition of those elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously; The proposed paint and material are appropriate for the existing architectural features, adjoining tenant space to the north, and overall appearance of the Mercado Plaza. The removal of the heavy stone veneer and ornate wall -mounted light fixtures will contribute to a more streamlined appearance. 6. Consistency of composition and treatment; The existing cornice will remain as existing, and the color of the entry arch will match the cornice in color. Application of identical paint color and construction materials is proposed for the entire site for visual consistency. Resolution No. 24827 Page 3 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials; No changes are proposed to the existing landscaping. 8. Signs and graphics, as understood in architectural design including materials and colors; The new signage for the business was approved by the Architectural Advisory Committee (AAC), and it is not subject to City Council review. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the City Council hereby approves Case 3.1437 MAA, which seeks Minor Architectural Review approval to alter the exterior elevations of an existing commercial building for a new cannabis dispensary, Hits Studio, located at 155 South Palm Canyon Drive.
