A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, SUPPORTING THE
SUBMITTAL OF A COMMUNITY FUNDING REQUEST FOR
CALIFORNIA DISTRICT 36 (RUIZ) IN THE AMOUNT OF
$1,000,000 FOR ACQUISITION OF A 3 ACRE PROPERTY
LOCATED AT THE NORTHWEST CORNER OF EL CIELO
ROAD AND BARISTO ROAD TO DEVELOP FOR
AFFORDABLE HOUSING AND RELATED PURPOSES.
THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS:
A. The City Council of the City of Palm Springs, California, (hereinafter the "City
Council') recognizes that in current times local financing of community programs,
capital projects and infrastructure is more challenging with limited resources of
revenue for new and expanded programs or to fund critically important capital
projects and infrastructure.
B. The City Council continues to review its financial resources and annual
expenditures to ensure the most important community programs, capital projects
and infrastructure are delivered.
C. The City Council continuously reviews potential federal, state and local funding
opportunities to fund new and expanded programs or to fund critically important
capital projects and infrastructure.
D. For many years, the United States Congress included in its appropriations process
of each annual funding bill a means of allowing individual members of Congress
to identify funding for specific projects in each Congressional District, known as
"earmarks."
E. The United States Congress used its legislative power to earmark discretionary
funds on specific "earmarks" as part of its regular process of allocating funds within
the Federal government, and for many years were a core aspect of legislative
policymaking.
F. Many "earmarks" were for legitimate public purposes allowing the local U.S.
Member of Congress to identify programs or projects important to the community
for funding through the United States Congress. Among the "earmarks" previously
appropriated for Palm Springs were two "earmarks" for public improvements to be
made on the Agua Caliente Band of Cahuilla Indians reservation: 2006 Public
Lands Highway Discretionary (PLHD) Earmark #3677 — HR 3058, Public Law 109-
115 for $631,791; and Highway Priority Project (HPP) Earmark #3792 DEMO ID
716, Public Law 109-59 for $449,903.

G. The City of Palm Springs in collaboration with the Agua Caliente Band of Cahuilla
Indians (the "Tribe") successfully delivered public street and storm drainage
improvements funded with these two "earmarks" benefitting the Tribe and its
Reservation and the Palm Springs community.
H. In the 112th United States Congress (2011 — 2012), the House and Senate began
observing what has been referred to as an "earmark moratorium" or "earmark ban."
The "earmark ban" eliminated any opportunity for communities like Palm Springs
to advocate to its Member of Congress for federal funding of important community
programs, capital projects and infrastructure.
In the 117th United States Congress (2021 — 2022), lawmakers will reinstate the
process of earmarking for local governments and nonprofits after a decade -long
ban, ushering in the return of congressionally directed spending through a revised
process called "Community Project Funding" with added oversight mechanisms.
Potentially eligible projects range from infrastructure, community programs,
university research, hospitals and other local initiatives.
Congressman Raul Ruiz (California District 36) has released an announcement for
submission of Community Project Funding requests, and pursuant to rules
established by the United States House, will accept, review and identify ten (10)
requests for submission to the Appropriations Committee for consideration in the
Federal Fiscal Year 2022 Budget.
K. The City Council has reviewed the various eligible programs from which
Community Project Funding requests may be funded, and compared those eligible
programs with the City programs, capital projects and infrastructure that are
important to the Palm Springs community.
L. Community Project Funding requests must demonstrate community support. The
City Council included an item on its April 8, 2021 City Council agenda for
discussion of Community Project Funding request opportunities for Palm Springs
as a means of soliciting public comment on the types of programs, capital projects
and infrastructure that might be considered for submission to Congressman Raul
Ruiz (California District 36).
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS
FOLLOWS:
SECTION 1. The findings and determinations reflected above are true and correct and
are incorporated by this reference herein as the cause and foundation for the action taken
by and through this Resolution.
SECTION 2. The City Council has considered the types of programs, capital projects and
infrastructure that might be considered for submission to Congressman Raul Ruiz
(California District 36) and based on its review, and in consideration of public comments
received, adopts this Resolution to document community support for submission of a

request for funding in the amount of $1,000,000 for acquisition of a 3 acre property located
at the northwest corner of El Cielo Road and Baristo Road to develop for affordable
housing and related purposes. The City Council hereby commits to match $600,000 of its
local funding for affordable housing and homelessness purposes to acquire the property
with a fair market value of $1,600,000.
