HomeMy WebLinkAbout24948RESOLUTION NO. 24948 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DELEGATING TO THE CITY MANAGER, OR DESIGNEE, THE AUTHORITY TO RESOLVE CLAIMS MADE AGAINST THE CITY IN AN AMOUNT NOT TO EXCEED $50,000, AS AUTHORIZED BY GOVERNMENT CODE SECTION 935.4 AND RESCINDING RESOLUTION NO. 12340 WHEREAS, pursuant to Section 909 of the City's Charter, the City Council may delegate its authority to reject claims to the city manager, city attorney, risk manager or other appropriate officer or department head; and WHEREAS, Section 935.4 of the Government Code of the State of California provides that a local public entity may authorize an employee of the local public entity to resolve a claim against the local public entity; and WHEREAS, the Palm Springs City Council adopted Resolution No. 12340 authorizing the City Manager to allow, compromise or settle claims made against the City in an amount of five thousand dollars ($5,000) or less; and WHEREAS, the City Council now wishes to increase the amount the City Manager is authorized to resolve claims made against the City to fifty thousand dollars ($50,000). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The City Manager, or the City Manager's designee, is authorized to take administrative actions, including, but not limited to, rejecting, accepting or settling claims against the City, necessary to resolve claims against the City that do not exceed fifty thousand dollars ($50,000), pursuant to the provisions of the Palm Springs Charter Section 909 and California Government Code Section 935.4. Upon the written order of the City Manager or the City Manager's designee, the Finance Director shall cause a warrant to be issued upon the treasury of the City in the amount for which a claim has been allowed, compromised, or settled. Nothing contained in this Resolution shall prevent the City Manager from forwarding any claim in any amount to the City Council for consideration and action, as the City Manager deems appropriate. SECTION 2. This Resolution shall become effective immediately upon its adoption and upon its effectiveness Resolution No. 12340 is hereby rescinded. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED BY THE PALM SPRINGS CITY COUNCIL THIS 28th DAY OF OCTOBER 2021.
