HomeMy WebLinkAbout24923RESOLUTION NO.24923 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MINOR ARCHITECTURAL REVIEW APPLICATION (CASE NO. 3.4316 MAA) FOR EXTERIOR IMPROVEMENTS TO A CANNABIS DISPENSARY, CALIBLISS LLC., LOCATED AT 562 SOUTH INDIAN CANYON DRIVE THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS AND DETERMINES AS FOLLOWS: A. Global Go, LLC ("Applicant") has filed a Minor Architectural application (Case 3.4316 MAA) and a Sign Permit application (Case 20-058 SI) with the City pursuant to Sections 94.04.00 (Architectural Review) and 93.20.10 (General Provisions) of the Palm Springs Zoning Code (PSZC) to repaint the exterior building a Pantone grey, install a frosted glass partition between the two units on the second story, removed the existing awning and replace it with an aluminum awning, install six (6) landscape planters along South Indian Canyon, and one (1) larger landscape planter along the front side of the building, relocate the mail box, upgrade the rear parking lot, and install new signage at a commercial building for a new cannabis dispensary, Calibliss, at 562 South Indian Canyon Drive (APN: 508-121-004), Zone C-1. B. On May 18, 2021, the Architectural Review Committee reviewed the proposed project and voted unanimously to approve the exterior modifications (3.4316 MAA) and Sign Permit application (Case 20-058 SI) subject to modifying the sidewalk to define a pedestrian area, revising the plans so that the awning, and partition match the existing railing, and requiring the applicant to submit final landscape plans for staff review. Pursuant to Palm Springs Zoning Code 93.23.15(F)(3)(a), the action taken by the Architectural Advisory Committee on the Sign Permit application is final. C. Due to the project involving a cannabis dispensary, the City Council shall review and make a decision on this project, in accordance with Palm Springs Zoning Code Section 93.23.15(F)(3) of the Palm Springs Zoning Code. D. On July 22, 2021, the City Council held a regularly scheduled meeting and reviewed the project in accordance with applicable law, and carefully considered all of the evidence presented in connection the project, including but not limited to the staff report and all written and oral testimony presented. E. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, because the project involves minor alterations to an existing building. Pursuant to Section 94.04.00(D) of the Palm Springs Zoning Code, the City Council finds: 0 The City Council has examined the material submitted with the architectural approval application and has examined specific aspects of the design and determined the proposed development will (1) provide desirable environment for its occupants, (2) is compatible with the character of adjacent and surrounding developments, and (3) aesthetically it is of good composition, materials, textures and colors. The City Council's evaluation is based on consideration of the following: 1. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas, i.e., sidewalks as distinct from parking lot areas. The project will not alter the site layout; however, it is proposing to modify the existing pedestrian path located in front of the building to make it more defined. The rear parking lot will be redesigned and include a new ADA parking space with a defined path of travel. 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted, The project proposes to paint the exterior a light gray, which will allow the building to maintain a harmonious relationship with the surrounding developments. 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment The project does not involve any changes to the building height, setbacks, or overall mass, including any walls or screen. The proposed window signs were approved by the Architectural Review Committee (ARC). No mechanical equipment installation is proposed as a part of this application. 4. Building design, materials and colors to be sympathetic with desert surroundings, - The proposed materials and colors include a light grey, and Pantone Blue, which are neutral and sympathetic with desert surroundings. 5. Harmony of materials, colors and composition of those elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously, - The building walls currently consist of CMU walls and a guardrail on the second story. The applicant is proposing new paint colors and a new planter area along Resolution No. 24923 Page 3 the frontage. The materials and colors are harmonious with each other and the surrounding area. 6. Consistency of composition and treatment; As mentioned above, there is consistency with the proposed colors and materials. 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials: - One planter is proposed along the frontage of the building and six (6) smaller, individual planters are located along the South Indian Canyon frontage to create a more defined pedestrian pathway. Drought tolerant plants are recommended. 8. Signs and graphics, as understood in architectural design including materials and colors; One main sign is proposed and is in conformance with the sign standards. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the City Council hereby approves Case 3.3416 MAA, which seeks Minor Architectural Review approval for the above - mentioned exterior modifications at a new cannabis dispensary, Calibliss, located at 562 South Indian Canyon Drive.
