THE AMOUNT OF $75,000:
ACTION: 1) Approve a "Special Expertise" hazardous material abatement contract, under
Municipal Code Section 7.04.030, with Brickley Environmental for City facilities that are being
modified under the Chevron Energy Solutions contract, in an amount not to exceed $75,000;
and 2) Authorize the City Manager to execute all required documentation. . Approved as
part of the Consent Calendar.
This agreement has never been executed.

CHEVRON PROJECT — HAZARDOUS MATERIAL ABATEMENT
UTILIZING BRICKLEY ENVIRONMENTAL

SUMMARY
The proposed action would result in a special expertise hazardous material abatement
contract with Brickley Environmental.
RECOMMENDATION:
1. Approve a "Special Expertise" hazardous material abatement contract, under
Municipal Code Section 7.04.030, with Brickley Environmental for City facilities
that are being modified under the Chevron Energy Solutions contract, in an
amount not to exceed $75,000.
2. Authorize the City Manager to execute all required documentation.
STAFF ANALYSIS:
The Chevron Energy Solutions Company (CES) contract to install energy conservation
measures throughout City facilities requires the City to remove any hazardous material
encountered during the projects construction. Under provisions of the contract if CES
locates what they believe to be hazardous materials they are to mark the area and pull
off the job until the suspected material is tested and or removed. The City must be able
to immediately move to abate the materials or be subject to delay charges change
orders from CES.
To be prepared for this eventuality, and to avoid delay claims, it is recommended that
the City have a hazardous material abatement contractor under contract and on
standby. On numerous competitively bid projects the City has previously contracted
with Brickley Environmental for abatement work. They are familiar with many of our
buildings, have worked in our cogeneration plants and have worked in the secure

environment at the airport. For all of these reasons Brickley Environmental has "Special
Expertise" as defined in section 7.04.030 of the Municipal Code.
An on -call contract will be negotiated with Brickley Environmental to include abatement
as well as disposal of hazardous materials from various City facilities. The contract will
be based on a negotiated hourly rate to cover all required work and materials to safely
abate hazardous materials. The contract will include a maximum cost of $75,000.
FISCAL IMPACT:
The funding for this work will come from Cogeneration Accounts that were carried forward
from the previous year for this type of work, 550-5812-54073.
