CITY COUNCIL STAFF REPORT DATE: DECEMBER 10, 2020 CONSENT SUBJECT: REQUEST BY FUMIKO DOCKER OF PENCIL BOX ARCHITECTS, INC., ON BEHALF OF THE 420 LOUNGE, LLC (OBA COOKIES), FOR A MINOR ARCHITECTURAL APPLICATION TO APPLY A NEW COAT OF 'COOKIES BLUE' PAINT TO EXTERIOR BUILDING COLUMNS AND A WALL IN ADDITION TO AL TERI NG THE FRONTAGE OF AN EXISTING COMMERCIAL BUILDING FOR ADA COMPLIANCE AT A NEW CANNABIS DISPENSARY FACILITY LOCATED AT 777 NORTH PALM CANYON DRIVE (APN: 505-283-008), ZONE C-1, SECTION 10, (CASE 3.229 MAA). Ready, City Manager BY: Development Services Department SUMMARY: This is a request for Minor Architectural Review approval for exterior alterations at a new cannabis dispensary, Cookies. Pursuant to Palm Springs Zoning Code (PSZC) Section 93.23.15(F)(3)(a), exterior alterations to a cannabis facility require review and approval by the Architectural Advisory Committee (AAC) and the City Council. On November 2, 2020, the AAC reviewed the proposed project and voted 6-0-1 to recommend approval to the City Council as submitted. In conjunction with this application, the applicant submitted a Sign Permit application (20-015 SI), which was reviewed and approved by the AAC on September 8, 2020. The sign application is not subject to City Council review per Palm Springs Zoning Code Section 93.23.15(F)(3)(a). RECOMMENDATION: That the City Council approve the proposed project as submitted. BUSINESS PRINCIPAL DISCLOSURE: The legal name of the entity is The 420 Lounge, LLC, and the OBA of the entity is Cookies. Edvin Mailyan is the officer, general partner, and sole owner of the business (Attachment #3). The City issued a regulatory permit for an adult-recreational cannabis dispensary with delivery and a cannabis consumption lounge at Suite 102 and 101 Re ulato Permit #C-2018-037 . The City issued a revised regulatory permit for The 420 Lounge, LLC dba Cookies. The AAC voted unanimously to approve the proposed signage subject to the conditions recommended by staff and the exterior column aintin ortion of the ro·ect be further studied. The AAC voted 6-0-1 to recommend approval of the project to the City Council as submitted. Staff conducted a site visit to confirm the site's conditions. The project area is the ground-level portion of a two (2)-story multi-tenant building. Constructed in 1979, the architectural design of the building is modern, and it is characterized by its strong horizontal orientation and simplistic white fa9ade which is devoid of decorative elements. A driveway which is located directly beneath the second floor of the building leads to a parking area, and there are four (4) rows of columns parallel to the driveway. The frontage of the property is developed with two (2) low-height walls on both sides of the driveway entrance, in addition to limited plant materials in the planting beds. The proposed project was initially reviewed by the Architectural Advisory Committee (AAC) on September 8, 2020. At the meeting, the AAC voted unanimously to approve the proposed signage (20-015 SI) subject to the recommendations presented by staff; however, the Committee required the applicant to further study the column painting portion of the project. The revised development plan was reviewed by the AAC on November 2, 2020, and the Committee voted 6-0-1 to approve the project as submitted. An excerpt from the November 2, 2020 AAC draft meeting minutes is attached to this Staff Report (Attachment #6). STAFF ANALYSIS: Proposed Paint Color: The project proposes the application of a custom Sherman-Williams custom paint in 'Cookies Blue.' 'Cookies Blue' is the business' signature color. The approved window signs and the business' product package design (Attachment #5) incorporate this signature color as well. 7City Council Staff Report December 10, 2020 --Page 7 Case 3.229 MAA -Cookies Cannabis Facility Exterior Alterations Alterations to the Entrance Area: The applicant is proposing to alter the existing pedestrian access path and front entry of the building to be ADA compliant, which is required for the establishment of the new cannabis facility. The ADA upgrade will replace the existing sloping entry area with a new wheelchair ramp and steps as depicted below. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. The project will not alter the site layout; however, it is proposing to modify the existing pedestrian path located in front of the tenant space to provide steps and a wheelchair ramp for ADA compliance purposes. The new steps and ramp will provide direct access to the North Palm Can on Drive and create a defined ath for visitors. 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous re etition, but allowin similarit of st le, if warranted; The project proposes to paint all exterior columns and one (1) of the existing low-height walls in 'Cookies Blue', which is the business' signature color. While the paint will accentuate the simplistic white exterior of the building, its limited application will prevent the color from dominating the design of the building. The use of a bright accent color in paint scheme is a commonly observed technique in Uptown, and the columns painted in 'Cookies Blue' will add uni ue identit and vibranc to the buildin . 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical e ui ment; The project does not involve any changes to the building height, setbacks, or overall mass, including any walls or screen. Bui/din colors to bes m athetic with desert surroundin s; While typical desert color palette includes earth-toned colors such as white, beige, and brown, 'Cookies Blue' resembles the color of the desert sky as the applicant explains in the Justification Letter. Therefore, the color is sympathetic with desert surroundings. Its limited application complements the exterior of the building, a large ortion of which is ainted white. Additionally, one of the existing low-height walls will be painted in the matching color to achieve a cohesive and balanced appearance when the property is viewed as a whole, including the approved window signs. 6. Consistency of composition and treatment; Yes The project proposes to paint all exterior columns in 'Cookies Blue' for visual consistency. In addition to the columns, one of the low-height walls will be painted in the identical color. 'Cookies Blue' is the business' signature color, and it will be seen in the window signs and product packages. 7. Location and type of planting, with regard for desert .climate Yes conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials; There are no existing specimen or landmark trees at the project site. The project proposes to install additional Agave in the existing planting beds on the North Palm Canyon Drive frontage to enhance the site's landscape. The drought-tolerant Agave is appropriate for the desert environment and its bold, defined shape and form complement the simplistic design of the building. 8. Signs and graphics, as understood in architectural design including Yes materials and colors; The new signage for the business was approved by the Architectural Advisory Committee (AAC), and it is not subject to City Council review. The business plans to install a blade sign on the North Canyon Drive frontage in the future after obtaining landlord's approval. Installation of the signage will be reviewed via a Sign Program application under a separate review, and it is not a part of this application. ENVIRONMENTAL ASSESSMENT: This project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of Title 14, Chapter 3 of the California Code of Regulations (Class 1, Existing Facilities). 10City Council Staff Report December 10, 2020 --Page 10 Case 3.229 MAA -Cookies Cannabis Facility Exterior Alterations FISCAL IMPACT: No fiscal impact. CONCLUSION: As the applicant explains in the Justification Letter (Attachment #4), 'Cookies Blue' is the color of the desert sky and the business' signature color. The applicant is proposing to paint all exterior building columns and the existing low-height wall in 'Cookies Blue' for enhanced visual continuity and to establish a distinctive identity for the building. In addition to the painting of the columns, the project proposes minor alterations to the existing pedestrian path and the entrance area to be ADA compliant, which includes the installation of new steps and a wheelchair ramp. Furthermore, the existing planting beds will be enhanced with additional Agaves. The proposed ADA upgrading work will create a defined path and provide direct access to North Palm Canyon Drive. Since the proposed alterations to the entrance area of the building are necessitated by the Building Code and the proposed improvement work meets the required findings as analyzed above, staff recommends that the City Council approve the project as submitted. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Fumiko Docker of Pencil Box Architects, Inc. ("Applicant") has filed a Minor Architectural application (Case 3.229 MAA) and a Sign Permit application (Case 20-015 SI) with the City pursuant to Sections 94.04.00 (Architectural Review) and 93.20.10 (General Provisions) of the Palm Springs Zoning Code (PSZC) to apply a new coat of 'Cookies Blue' paint to two (2) exterior columns and to install new signage at a commercial building for a new cannabis dispensary, Cookies, at 777 North Palm Canyon Drive (APN: 505-283-008), Zone CBD. B. On September 8, 2020, the Architectural Advisory Committee reviewed the proposed Project and voted unanimously to approve the Sign Permit application (Case 20-015 SI) subject to staff recommendations but required the painting of the two (2) columns (Case 3.229 MAA) to be re-studied for further review. Pursuant to Palm Springs Zoning Code 93.23.15(F)(3)(a), the action taken by the Architectural Advisory Committee on the Sign Permit application is final. C. On November 2, 2020, the Architectural Advisory Committee (AAC) reviewed the revised development plan and voted 6-0-1 to recommend approval of the project to the City Council as submitted. D. Due to the project involving a cannabis dispensary, the City Council shall review and make a decision on this project, in accordance with Palm Springs Zoning Code Section 93.23.15(F)(3) of the Palm Springs Zoning Code. E. On December 10, 2020, the City Council held a regularly scheduled meeting and reviewed the project in accordance with applicable law, and carefully considered all of the evidence presented in connection the project, including but not limited to the staff report and all written and oral testimony presented. F. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, because the project involves minor alterations to an 16Resolution No. Page2 existing building. G. FUMIKO DOCKER OF PENCIL BOX ARCHITECTS, INC., ON BEHALF OF COOKIES, FOR A MINOR ARCHITECTURAL APPLICATION AND A SIGN PERMIT APPLICATION TO PAINT EXTERIOR COLUMNS IN 'COOKIES BLUE' AND INSTALL NEW SIGNAGE AT A NEW CANNABIS DISPENSARY FACILITY LOCATED AT 777 NORTH PALM CANYON DRIVE (APN: 505-283-008), ZONE C-1, SECT ON 10, (CASE 3.229 MAA): Associate Planner Kikuchi presented the proposecl project. Questions to Staff: Member Thompson questioned about the blade sign which the business plans to install and asked whether the two (2) windows signs woulcl strll be permitted under a Sign Program or not. Staff responded that the window signs have been approved and they would be permitted under a Sign Pro9ram. Vice-Chair Rotman questioned wt:lether the building owner has provided consent to the applicant to paint all columns blue. Staff responded that is correct and the applicant can confirm the infofi~ation. Fumiko Docker, Applicant, desc[ibed the proposed changes and stated that the building owner is eager to move forward with the Rroject. Member Discussion: Vice-Chair Rotman stated that the proposed changes tie the overall design of the building together, and the simplistic landscape is in line with the simplicity of the building. Member Thompson comment~that he is in favor of the columns and the low-height wall being painted blue. Member Thompson also questioned other Committee members wAether the two (2) low-height walls on the North Palm Canyon Drive fronta~e hould be painted blue for consistency, instead of painting only one (1) wall. The Committee discussed about painting the two (2) low-height walls blue and ultimately agreed that the paint application should be limited to just one (1) wall. MOTION: Recommend approval to the City Council as submitted.
