SUBJECT: SECOND READING AND ADOPTION OF AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACTING AS
THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO.
2020-1 (CANYON VIEW) OF THE CITY OF PALM SPRINGS,
AUTHORIZING THE LEVY OF SPECIAL TAXES IN SUCH COMMUNITY
FACILITIES DISTRICT

RECOMMENDATION:
Waive the second reading of the ordinance text in its entirety and read by title only; and
adopt Ordinance No. 2035 entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF
COMMUNITY FACILITIES DISTRICT NO. 2020-1 (CANYON VIEW) OF THE CITY OF
PALM SPRINGS, AUTHORIZING THE LEVY OF SPECIAL TAXES IN SUCH
COMMUNITY FACILITIES DISTRICT."
BACKGROUND:
On November 12, 2020, Ordinance No. 2035 was introduced for first reading, as noted
below:

GARNER, CARRIED 5-0, to introduce Ordinance No. 2035 entitled, "AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACTING AS
THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 2020-1
(CANYON VIEW) OF THE CITY OF PALM SPRINGS, AUTHORIZING THE LEVY OF
SPECIAL TAXES IN SUCH COMMUNITY FACILITIES DISTRICT."
This report provides for the City Council to waive further reading and adopt the ordinance .
The ordinance shall be effective 30-days from adoption.

2ORDINANCE NO. ---AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 2020-1 (CANYON VIEW) OF THE CITY OF PALM SPRINGS, AUTHORIZING THE LEVY OF SPECIAL TAXES IN SUCH COMMUNITY FACILITIES DISTRICT WHEREAS, the City Council of the City of Palm Springs, California (the "City Council"), has initiated proceedings, held a public hearing, conducted an election and received a favorable vote from the qualified electors authorizing the levy of special taxes in the community facilities district, all as authorized pursuant to the terms and provisions of the "Mello-Roos Community Facilities Act of 1982", being Chapter 2.5, Part 1. Division 2, Title 5 of the Government Code of the State of California (the "Act"). This community facilities district shall hereinafter be referred to as Community Facilities District No. 2020-1 (Canyon View) of the City of Palm Springs (the "District") . THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 2020-1 (CANYON VIEW), DOES HEREBY ORDAIN AS FOLLOWS: Section 1. This City Council does, by the passage of this ordinance, authorize the levy of special taxes on all parcels of taxable property located in the District which are identified in Exhibit "A" attached hereto. Section 2. This City Council, acting as the legislative body of the District, is hereby further authorized, by resolution, to annually determine the special tax to be levied within the District for the then current tax year or future tax years; provided, however, the special tax to be levied shall not exceed the maximum special tax authorized to be levied pursuant to the Rate and Method. Section 3. The special taxes herein authorized to be _levied, to the extent possible, shall be collected in the same manner as ordinary ad valorem property taxes are collected and shall be subject to the same penalties and the same procedure, sale and lien priority in case of delinquency as is provided for ad valorem taxes. Section 4. The special taxes authorized to be levied shall be secured by the lien imposed pursuant to Section 3114.5 and 3115.5 of the California Streets and Highways Code, which lien shall be a continuing lien and shall secure each levy of the special taxes. The lien of Special Taxes (as defined in the Rate and Method) shall continue in force and effect until the special tax obligation is prepaid and permanently satisfied and the lien canceled in accordance with law or until collection of the special taxes ceases to be levied by the City Council. Section 5. This Ordinance shall be effective thirty (30) days after its adoption.
