Ready, City Manager BY: Development Services Department SUMMARY: This is a request for Minor Architectural Review approval for exterior alterations at a new cannabis dispensary, Hits Studio, located at the Mercado Plaza in Downtown. Pursuant to Palm Springs Zoning Code (PSZC) Section 93.23.15(F)(3)(a), exterior alterations to a cannabis facility require review and approval by the Architectural Advisory Committee (AAC) and the City Council. On October 5, 2020, the AAC reviewed the proposed project and voted unanimously to recommend approval to the City Council subject to conditions of approval. In conjunction with this application, the applicant submitted a Sign Permit application (20-045 SI). The Sign Permit application was approved by the AAC, and it is not subject to City Council review per Palm Springs Zoning Code Section 93.23.15(F)(3)(a). RECOMMENDATION: That the City Council approve the proposed project as proposed. BUSINESS PRINCIPAL DISCLOSURE: The legal name of the entity is Greenskeepers, LLC, and its OBA is Hits Studio. The managers of the entity are John Oswald, Craig Bouman, and Ben Hynes. The business is entirely owned by Greenscape Engineering, Inc., which consists of John Oswald (50%), Craig Bouman (19%), Noelle Bouman (19%), and Chuck Bouman (12%) (Attachment#2). The AAC approved the proposed signage and recommended a roval of other exterior alterations sub·ect to conditions of a roval. The new cannabis dispensary will be established in Suite A 1, a single-story, southern-end unit of the Plaza which directly faces Palm Canyon Drive. Constructed in 1998, the architectural style of the Mercado Plaza is Mediterranean/Spanish Revival. The building exhibits distinctive architectural features such as terra cotta roofs, stucco walls, arched windows and doors, balconies with French doors, decorative ironwork, exposed wood beams, and heavy use of stone and brick veneer. The Plaza is comprised of two (2)-story and single-story building segments which are painted in warm desert colors such as beige and light brown/orange. The frontage of the Plaza is staggered, and it is designed with a mix of rooflines. On October 5, 2020, the Architectural Advisory Committee (AAC) reviewed the proposed project, which included the installation of a new wall sign. At the meeting, the AAC approved the proposed signage subject to a condition that the size of the signage be adjusted for better proportion relative to the sign background. Additionally, the AAC voted 7 to O to recommend approval of the project to the City Council subject to the following conditions: 1) Sign size needs to be adjusted to keep the proportion depicted on image 5 of Sheet 6.0. 5City Council Staff Report November 12, 2020 --Page 5 Case 3.1437 MAA-Hits Studio Exterior Alterations 2) Building paint color shall be warmer and lighter variation of the existing building colors. 3) The existing window on the south elevation to be removed as proposed. 4) The existing lanterns and wall-mounted two (2) light fixtures on the primary elevation to be removed. 5) Application of the Cantera stone tiles needs to be extended further on the building. 6) Select Cantera stone tiles in a different color depending on the final paint colors. 7) Maintain the finish of the cornice as existing. STAFF ANALYSIS: Proposed Paint Color: The building wall color of the project site is currently light brown with a touch of orange hue. The color of the cornice is beige, which matches the color of the building wall in the rear. The applicant is proposing to apply a coat of Dunn-Edwards DE6171 'Sand Dollar' paint to the exterior building walls. No color change is proposed to the cornice as required by the AAC, and the finish of the entry arch detail will match the color of the cornice. The exterior wall will be painted in Dunn-Edwards 'Sand Dollar.' The horizontal band above the building corner columns will extend over the enclosed window opening, and it will match the existing cornice in color. The existing stone veneer on the columns and below the window on the south elevation will be removed, which will be replaced with Cantera stone tiles in 'Nuez' color. The project will remove the existing two (2) pairs of wall-mounted light fixtures. Image 1. 5 Existing Elevations Image 1. 6 Proposed Elevations Architectural Review Criteria: PSZC Section 94.04.00(D) requires an evaluation of the proposed exterior alterations to determine compatibility with the character of adjacent and surrounding developments, and whether it is of good composition, textures and colors. Conformance shall be evaluated based on the following applicable criteria: 1. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas; i.e., sidewalks as distinct from arkin lot areas. The project will not alter the existing site layout, including the edestrian and vehicular areas and sidewalks. 2. The project site is currently painted in light brown color with a touch of orange hue. The proposed beige paint is compatible with the paint color scheme of the Mercado Plaza. 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment; The project does not involve any changes to the building height, setbacks, or overall mass, including any walls or screen. No mechanical equipment installation is proposed as a part of this application. 4. Building colors to be sympathetic with desert surroundinqs; The proposed beige paint resembles the color of desert stones and sand, and the proposed color palette, including the color of the Cantera stone tiles, is compatible with the desert surroundings. 5. Harmony of colors and composition relating to the elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously; The proposed paint and material palette are appropriate for the existing architectural features, adjoining tenant space to the north, and overall appearance of the Mercado Plaza. The removal of the heavy stone veneer and ornate wall-mounted light fixtures will contribute to a more streamlined appearance. 6. Consistency of composition and treatment; The existing cornice will remain as existing, and the color of the decorative stone features will match the cornice in color. The application of identical material and paint is proposed for the entire site for visual consistency. 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials; No changes are proposed to the existing landscaping. 8. Signs and graphics, as understood in architectural design including materials and colors; The new signage for the business was approved by the Architectural Advisory Committee (AAC), and it is not subject to City Council review. FISCAL IMPACT: No fiscal impact. CONCLUSION: The Mercado Plaza currently exhibits ornate architectural details that are characteristics of Mediterranean/Spanish Revival-style architecture. While the proposed window and stone veneer removal will modernize the appearance of the building, the proposed warm beige paint color and Cantera stone tiles will allow the project site to be visually connected to the rest of the Mercado Plaza. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Craig Bouman of Hits Studio ("Applicant") has filed a Minor Architectural application (Case 3.1437 MAA) with the City pursuant to Section 94.04.00 (Architectural Review) of the Palm Springs Zoning Code (PSZC) to alter the exterior elevations of a commercial building for a new cannabis dispensary located at 155 South Palm Canyon Drive (APN: 513-143-019), Zone CBD. B. On October 5, 2020, the Architectural Advisory Committee reviewed the proposed Project and voted unanimously to recommend approval of the project subject to conditions of approval. C. Due to the project involving a cannabis dispensary, the City Council shall review and make a decision on this project, in accordance with Palm Springs Zoning Code Section 93.23.15(F)(3) of the Zoning Code. D. On November 12, 2020, the City Council held a regularly scheduled meeting and reviewed the project in accordance with applicable law, and carefully considered all of the evidence presented in connection the project, including but not limited to the staff report and all written and oral testimony presented. E. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be Categorically Exempt as a Class 1 exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, because the project involves minor alterations to an existing building. F. Pursuant to Section 94.04.00(D) of the Palm Springs Zoning Code, the City Council finds: The City Council has examined the material submitted with the architectural approval application and has examined specific aspects of the design and determined the proposed development will (1) provide desirable environment for its occupants; (2) is compatible with the character of adjacent and surrounding developments, and (3) aesthetically it is of good composition, materials, textures and colors. REQUEST BY CRAIG BOUMAN, ON BEHALF OF GREENSKEEPERS, LLC, FOR MINOR ARCHITECTURAL REVIEW APPROVAL TO ALTER THE EXTERIOR ELEVATIONS OF AN EXISTING COMMERCIAL BUILDING AND INSTALL A NEW WALL SIGN FOR A NEW CANNABIS DISPENSARY, HITS STUDIO, LOCATED AT 155 SOUTH PALM O'ANYON DRIVE SUITE A1 (APN: 513-143-019), ZONE CBD, SECTION 15 (CASE NO. 3.1437 MAA & CASE NO. 20-045 SI). (NK): Associate Planner Kikuchi provided a presentation. Applicant, Craig Bouman, provided brief history and background information of the project. The applicant provided information noting that the property is managed by Grit Development and the project architect is Allen Sanborn. The applicant continued that the intent of the proposed exterior alterations is to provide a modern, clean appearance to the building. Because of the location of the project, which is an end tenant space, the project will contribute to a stand-alone appearance. The proposed paint color is light tan color, and the project proposes the removal of the existing stone veneer, which makes the building appear outdated. Questions to Applicant: Vice-Chair Rotman questioned the. intent of removing the existing window on the south elevat~on. The applicant responded that the removal is requested because of the site's closeness to the adjacent pet store to the south and the future interior layout of the space. Vice-Chair Rotman asked whether the finish of the proposed Cantera stone tiles is smooth or not. The applicant responded that the finish of the tiles will be smooth. Vice-Chair Rotman also questioned the size of the tiles. The applicant responded that the size will be 16" by 16" and added that the size of the tiles can be changed to 18" by 18' or 20" by 20" if needed. Member Doczi asked whether the cannabis facility will be a dispensary or lounge. The applicant responded that it will be a cannabis dispensary only. Committee Discussion: Chair Jakway stated that enclosing the window opening on the south elevation is a good idea, especially considering the roof overhang extending from the adjacent building towards the project site. Chair Jakway added that the proposed building 21Architectural Advisory Committee Meeting Minutes -Excerpt City of Palm Springs October 5, 2020 wall paint color depicted on Sheet 6.0 of the submitted plan appears very white and a color that is "creamier" would be preferable. Chair Jakway recommend that the final paint color to be not white and at least creamy beige in color. Chair Jakway added that alterations that make the project site appear detached from the rest of the building are not desirable. Chair Jakway pointed out that that the Marcado Plaza utilizes different types of Cantera stone tiles and the proposed sign appears too large for the sign installation area. Chair Jakway concluded that the size of the proposed sign could be slightly smaller for better proportion. Member Lockyer stated that removing the existing stone veneer may contribute to the enhancement of the building fa9ade and recommended not to bring back the same amount of details to the building. Member Lockyer added that it is appropriate to bring back the Cantera stone tiles further up on the wall and wrapping around the building corner. The proposed 'Whisper Gray' paint color is acceptable; however, the color which is a shade lighter is more desirable and not the white paint as shown in the submitted plan. Member Lockyer added that the proposed sign appears too large and a reduction i.n sign size to make it between 60% and 70% of the proposed sign size is desirable. Member Walsh stated tHat he agrees with the comments provided by other members. Member Walsh added that the proposed Cantera stone tiles will simplify and clean up the Spanish Revival building fa9ade and removing some of the existing details is a good idea. Member Walsh added that the proposed paint colors appear to be out of the context considering the treatment of the entire building. Member Walsh stated that the proposed sign size does not appear to be problematic; however, a color palette that is more consistent with the existing building is desirable. Vice-Chair Rotman stated that the proposed signage depicted on Sheet 6.0 appears better than the sign design depicted on a separate sign plan sheet. Vice-Chair Rotman added that he agrees with the comments provided by Member Walsh regarding the proposed paint color. Vice-Chair Rotman stated that paint colors which are similar to the existing or slightly lighter than the existing building color is desirable. Vice-Chair Rotman stated that he is nervous about the application of the proposed 'Whisper Gray' paint. Vice-Chair Rotman concluded that the application of colors which belong to the same color family as existing would be appropriate. Member Poehlein stated that he agrees with Member Lockyer's comments regarding increasing the height of the Cantera stone tiles and the use of warmer paint colors. Member Poehlein commented that painting the cornice in the proposed 'Silver Bullet' paint color will make the cornice visually standout from other cornices; therefore, the cornice should remain as existing. Member Poehlein agreed that the proposed sign depicted on Sheet A6.0 is better in terms of scale compared to the rendering shown on the separate sign sheet. 2 22Architectural Advisory Committee Meeting Minutes -Excerpt City of Palm Springs October 5, 2020 Chair Jakway stated that he recommends the existing wall-mounted light fixtures be removed as a condition. Vice-Chair Rotman asked the applicant whether the project proposes the removal of the exiting two (2) lanterns installed on the building. The applicant responded that he wishes to remove them. Member McCoy stated that the project is proposing to install an illuminated sign, and the installation area is close to street sign_.s. Ear this reason, the existing lighting fixtures should be for decoration only should the applicant decide to keep them. Chair Jakway stated that not every tenant space is designed with the lanterns; therefore, it should not be a problem' for such fixtures to be removed and not be replaced. MOTION: Approve the proposed sign subject to the condition as stated below and recommend approval of the proposed exterior alterations to the City Council subject to the conditions of approval stated below: 1) Sign size needs to be adjusted to keep the proportion depicted on image 5 of Sheet 6.0. 2) Building paint color shall be warmer and lighter variation of the existing building colors. 3) The existing window on the south elevation to be removed as proposed. 4) The existing lanterns and wall-mounted two (2) light fixtures on the ~rimary elevation to be rernoved. 5) Application of the Cantera stone tiles needs to be extended further on the building. 6) Select Cantera stone tiles in a different color depending on the final paint colors. 7) Maintain the finish of the cornice as existing.
