Formal City Council acceptance of the Fire Sprinkler and Fire Alarm System Upgrade
Project at the Wastewater Treatment Plant, City Project No. 20-14, is required to
document the completion of the public works improvements and to allow the City's filing
of a Notice of Completion with the Riverside County Recorder in accordance with Section
9200 of the California Civil Code.
RECOMMENDATION:
1. Accept the public works improvements identified in the Fire Sprinkler and Fire Alarm
System Upgrade Project at the Wastewater Treatment Plant, City Project No. 20-14,
as completed in accordance with the plans and specifications; and,
2. Authorize the City Engineer to execute and file for recordation with the Riverside
County Recorder a Notice of Completion for the Fire Sprinkler and Fire Alarm System
Upgrade Project at the Wastewater Treatment Plant, City Project No. 20-14.
BACKGROUND:
On, March 19, 2020, the City Council authorized issuance of a Notice to Proceed to Veolia
Water West Operating Services, Inc., a Delaware corporation, for the Fire Sprinkler and
Fire Alarm System Upgrade Project at the Wastewater Treatment Plant, City Project No.
20-14, (the "Project"); a copy of the staff report is included as Attachment 1.
2City Council Staff Report November 12, 2020 --Page 2 Notice of Completion for Fire Sprinklers and Fire Alarm System Upgrades at the WWTP, CP20-14 STAFF ANALYSIS: Construction of the project began on March 23, 2020 and was accepted as complete on October 16, 2020. Throughout the construction of the project there were no change orders and the final construction cost of the project is $240,524.55. As determined by City Staff, the Contractor satisfactorily completed the Project on October 16, 2020. Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the City Engineer to file and record a Notice of Completion to be submitted to the County, included as Attachment 2. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," the requested action is considered a Class 1 project consisting of the minor alteration of existing public structures or topographical features involving negligible or no expansion of use beyond that existing at the time of the City Council's determination. Therefore, in accordance with Section 15301, Staff has determined that approval of the requested action is considered categorically exempt from CEQA. FISCAL IMPACT: The Project budget, incurred expenditures, and other associated costs are identified in Table 1 below. IN THE AMOUNT OF $241,500 FOR THE FIRE SPRINKLERS AND FIRE ALARM SYSTEMS UPGRADE PROJECT AT THE WASTEWATER TREATMENT PLANT, CITY PROJECT NO. 20-14. FROM: BY: SUMMARY: David H. ("Veolia") to proceed with the installation of new fire sprinklers in the Maintenance Building and Energy Recovery Building, and upgrade the fire alarm system in all seven buildings at the Wastewater Treatment Plant (''V'N/TP") RECOMMENDATION: 1. Authorize the City Engineer to issue a Notice to Proceed to Veolia Water West Operating Services, Inc., in an amount not to exceed $241,500 for the Fire Sprinklers and Fire Alarm Systems Upgrade Project at the Wastewater Treatment Plant, City Project No. 20-14; and, 2. 6City Council Staff Report March 19, 2020 -Page 2 Approve Notice to Proceed with Veolia for Fire Sprinklers and Alarms at the \NWTP BACKGROUND: On November 4, 2015, the City Council approved a Wastewater Services Agreement with Veolia for operations and maintenance of the City's sewer collection system and the WNTP~ In 2017 & 2019, Veolia's risk assessment company, Matrix Risk Consultants, prepared reports to identify risks at the WNTP and provide recommendations to address them. The most recent report was completed after the recent $20 million upgrade project to the WNTP. It identified the following recommendation for the WNTP: Complete design, permitting, installation, testing and approval of an automatic fire sprinkler and alarm detection system throughout seven (7) buildings within the Wastewater Treatment Plant, which includes installation of sprinklers in the Maintenance Building and the Energy Recovery Buildings. To reduce our exposure to risk, and protect our newly built assets, Veolia and City staff agreed to explore options to address this issue. STAFF ANALYSIS: In accordance with Section 5.3, "Capital Projects" of the Veolia Wastewater Services Agreement, Veolia recommended the City authorize an "Agreed Capital Project", and on October 25, 2019, the City authorized Veolia to proceed with the preparation of a request for proposals to licensed C-16 fire protection contractors, to design and construct the improvements. In November 2019, Veolia issued a request for bids for the Project from the following local firms: 1. Desert Fire Extinguisher Co., Inc., Palm Springs, CA 2. Shasta Fire Protection, Inc., Thousand Palms, CA 3. KORD Fire Protection, San Dimas, CA On December 5, 2019, Veolia received only one bid from Shasta Fire Protection. Veolia then worked with them to refine the project scope of work. On January 22, 2020, Shasta Fire Protection provided a revised proposal as follows: 1. Fire Alarm System $87,600 2. Wet Fire Sprinkler System $34,650 3. Underground Piping System $62,000 Total: $184,250 (Veolia's cost estimate was $188,750 for this work)
7City Council Staff Report March 19, 2020-Page 3 Approve Notice to Proceed with Veolia for Fire Sprinklers and Alarms at the WNTP The fire alarm system, to be installed at all seven buildings, needs to be monitored by a UL listed central station, in accordance with NFPA 72 -The National Fire Alarm and Signaling Code, as well as all state and local requirements. Veolia proposes that all plans be sent to Matrix Risk Consultants and the Palm Springs Fire Department for review and approval prior to installation. The wet fire sprinkler system to be installed at the Maintenance Building and the Energy Recovery Building is necessary due to combustible construction materials and provide critical support of plant operations. The electrical room in the Maintenance Building is exposed to a 100% loss in the event of a fire. This room feeds electricity to 60% of the \NWTP. The Energy Recovery Building houses the boiler that provides essential hot water to the digesters. Fire sprinklers will quickly protect our assets should something happen in the boiler room. Similar to the fire alarms, plans will be submitted to the City, Matrix Risk Consultants and the Palm Springs Fire Department for plan check and approval prior to installation. On February 18, 2020, Veolia submitted a formal proposal to the City to proceed with the project. This proposal includes $57,250 for construction management support, and combined with the construction cost of $184,250, the total not to exceed amount is $241,500. A copy of their proposal is included as Attachment 2. Staff in the Engineering Services Department reviewed the bid proposal submitted by Shasta Fire Protection, and their prices are lower than the current fire sprinkler project at Demuth Community Center, City Project No. 19-14. They are in good standing with the State Contractors License Board, and meet the requirements of the "Local Business Preference Program" as defined in Section 7 .09.030 of the Palm Springs Municipal Code. Therefore, Staff recommends approval of the Notice to Proceed.
