This project was previously awarded by the City Council in January of 2020. After the
State, County and City emergency orders issued related to the COVID-19 pandemic,
the City terminated the Contract prior to any work commencing. The construction
documents (specifications and estimates) have been re-evaluated and are complete. In
accordance with Section 7.03.040 of the Procurement and Contracting Code the City
Council is required to approve and adopt plans, specifications and working details, and
authorize the bid request for all public projects in excess of $200,000. Approval of this
action will allow staff to proceed with re-bidding of this capital project, with an estimated
construction cost of $1,850,000. This project includes slurry seal maintenance on 113
streets (8% of the total number of street segments) with a total pavement surface of 3.6
million square feet (7% of the Citywide total pavement surface area).
RECOMMENDATION:
Approve the specifications and estimates, and authorize staff to re-advertise and solicit
bids for the 2020 Slurry Seal, City Project No. 19-02 (Re-Bid).
BACKGROUND
On June 11, 2020, the City Council terminated Construction Contract A8486 with
Pavement Coatings Co., a California corporation, for the 2020 Slurry Seal Project, City
Project No. 19-02. The staff report is included as Attachment 1.
Specific ranges of PCI ratings are given a letter grade and an associated condition, as
shown in Table 1 below.

Severely distressed or large quantities of distortion F Very Poor 0-40 or alligator cracking. Failure of the pavement, distress has surpassed tolerable rehabilitation limits. All streets require regular maintenance to improve the condition and extend the life of the pavement, with the type of maintenance dictated by the PCI index. The following Table lists the various typical maintenance treatment applied per Condition/PC! range. See Table 2 below. The pavement condition distribution from the report is illustrated in Table 3 below. 3City Council Staff Report November 12, 2020 --Page 3 Authorization to Re-Bid, 2020 Slurry Seal (CP 19-02 Re-Bid) STAFF ANALYSIS: In reviewing the Measure "A" sales tax and state Gas Tax revenues received by the City, Staff is recommending we proceed with re-bidding the 2020 Slurry Seal Project, City Project 19-02 (Re-Bid). The recommended list of streets was provided to all public utility operators in order to ensure that the streets proposed for slurry seal application do not conflict with any anticipated utility work. The list of recommended streets for the 2020 Slurry Seal is included as Attachment 2 with corresponding maps included as Attachment 3. With City Council approval, staff will re-advertise the Project in the Desert Sun, submit the Notice Inviting Bids to plan rooms1, and provide the bid documents free of charge to prospective bidders. A copy of the contract documents are on file with the Engineering Services Department. The following tentative schedule has been identified for the re-bid process: Notice Inviting Bids to be posted: Deadline for receipt of bids: Contract awarded by City Council: ENVIRONMENTAL IMPACT: November 16, 2020 3:00 PM, December 17, 2020 January 2020 Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public structures, facilities, mechanical equipment or topographical features involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Therefore, in accordance with Section 15301 (c), staff determined that the 2020 Slurry Seal, City Project No. 19-02, was considered categorically exempt from CEQA and a Notice of Exemption was prepared and filed with the Riverside County Clerk. 1 A Plan Room is a "library" where construction professionals may view bidding documents (blueprints and specifications) for projects seeking price estimates for specific construction products or services. There are 9 various plan rooms in southern California where the City submits its bid documents to ensure all contractors within the area are aware of the bid solicitation.
4City Council Staff Report November 12, 2020 --Page 4 Authorization to Re-Bid, 2020 Slurry Seal (CP 19-02 Re-Bid) FISCAL IMPACT: The FY 2018/2019 and FY2019/2020 budgets included approximately $2,000,000 for the 2020 Slurry Seal Project. Out of concern for the diminished Measure "A" and Gas Tax revenues anticipated for FY 2020/2021, Staff recommended the cancelation of the 2020 Slurry Seal Project. However, sales tax revenues are exceeding projections and the FY 2018/2019 and FY 2019/2020 Measure "A" and Gas Tax funds are available for the 2020 Slurry Seal Re-Bid. The total construction phase of the project is estimated between $1,700,000 and $1,950,000. The estimated funds available and expenditures are identified in Table 4. The final amount will be amended once bids are opened and the lowest responsible bidder is determined. 6Cit}' Council Staff ReQort DATE: June 11, 2020 CONSENT SUBJECT: TERMINATION OF A CONSTRUCTION CONTRACT (A8486) WITH PAVEMENT COATINGS CO., A CALIFORNIA CORPORATION, FOR THE 2020 SLURRY SEAL, CITY PROJECT NO 19-02 FROM: BY: SUMMARY: David H. Ready, City Manager Engineering Services Department The 2020 Slurry Seal, City Project No. 19-02 (the "Project) is funded with Local Measure A sales tax funds and special Gas Tax funds. The $1,830,871 contract was awarded on January 30, 2020, prior to the COVID-19 pandemic. In light of the significant reductions in Measure A sales tax and gas tax revenues in the current and next fiscal years due to the COVID-19 pandemic, the budget anticipated for the contract has been decreased and it is necessary to terminate the contract. RECOMMENDATION: Authorize the City Engineer to issue a Notice of Termination prior to Expiration of Term per Article 2 of Agreement (A8486) with Pavement Coatings Co., for the 2020 Slurry Seal, City Project No. 19-02. BUSINESS PRINCIPAL DISCLOSURE: Pavement Coatings Co. is a California corporation, whose officers are Doug Ford (President), Tom Mucenski (Secretary), and Nathan Seyler (Treasurer). Ownership is vested in Pavement Recycling Systems, Inc., an Employee Stock Ownership Trust. The Public Integrity Disclosure Forms for Pavement Coatings Co. is included as Attachment 1. BACKGROUND: On November 6, 2019, the City Council authorized Staff to bid the Project which consisted of the application of slurry seal to approximately 3.6 million square feet of City streets. The Project area represented approximately 7% of the total pavement surface Citywide and the project was estimated to cost $1,850,000. ITEM NO. ,il-f
7City Council Staff Report June 11, 2020 -· Page 2 Termination of Construction Contract for CP 19-02 On January 30, 2020, the City Council awarded the construction contract (A8486) to Pavement Coatings Co., in the amount of $1,830,871.24 for the Project. STAFF ANALYSIS: The Project is funded solely with Local Measure A funds and Gas Tax funds. Measure A is the ½ ¢ sales tax implemented by Riverside County to generate revenues for transportation projects administered by the Riverside County Transportation Commission (RCTC). The City's allocation of "Local Measure A" funds is generally $2,000,000 annually. Gas Tax funds are allocated to the City through various formula determined by the state. The City's allocation of Gas Tax revenue includes approximately $1,200,000 annually from the "old Gas Tax" and for FY 2019/2020 included an additional $843,400 for the SB1 "new Gas Tax". As a result of the COVID-19 pandemic RCTC has provided estimates on reduced sales tax revenues, and corresponding reductions in this year's and next year's Measure A allocations. Additionally, the COVID-19 pandemic has significantly reduced the state's Gas Tax revenues and the corresponding allocations to cities. The Engineering Services Department relies on its limited Measure A and Gas Tax allocations to fund a variety of important transportation projects, including as the City's "Local Match" to federal and state funding on 6 currently active federally funded projects. Out of concern for the diminished Measure A and Gas Tax revenues anticipated this fiscal year and next fiscal year, Staff recommends cancelling the slurry seal contract to ensure the City has not over-obligated anticipated revenues, and to retain enough budget over the next fiscal year to provide funding for the City's other active transportation projects. Although the slurry seal work is important to ensure adequate maintenance of City streets is provided, Staff is alarmed at the significantly reduced Measure A and Gas Tax revenues and recommends terminating this contract and deferring the slurry seal work until such time as revenues return to normal levels. ENVIRONMENTAL IMPACT: The requested City Council action is not a "Project" as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) 2

FISCAL IMPACT: In terminating a public works contract, the Contractor will be entitled to payment for certain incurred costs, including bond premiums paid and other preliminary overhead costs.
