CALIFORNIA DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL
(ABC) TO ADDRESS THE SALES AND FURNISHING OF ALCOHOL TO
MINORS AND TO FOCUS ON ABC LICENSEE EDUCATION AND
COMPLIANCE.

SUMMARY
Staff is recommending City Council authorize the acceptance of ABC grant funding for
the Police Department to utilize for Minor Decoy Programs, Shoulder Tap Programs, and
for IMPACT (Informed Merchants Preventing Alcohol-Related Crime Tendencies)
programs designed to reduce the sales and furnishing of alcohol to minors and to provide
education to ABC licensees operating within the City of Palm Springs. The total grant
amount will be $19,800 and will be used by the Police Department to expand current
efforts in reducing alcohol-related driving offenses by minors, to reduce alcohol use by
minors, and to educate alcohol retailers in the City of Palm Springs.
RECOMMENDATION:
1. Adopt Resolution No. ____ , "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM SPRINGS, CALIFORNIA, ACCEPTING A GRANT FROM
THE CALIFORNIA DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL IN
THE AMOUNT OF $19,800 FOR ALCOHOL ENFORCEMENT."
2. Authorize the City Manager to execute any necessary documents.
STAFF ANALYSIS:
The City of Palm Springs has approximately 393 ABC-licensed establishments: 51
licensed for the off-sale of alcohol, and 342 licensed businesses for on-sale purchases.
Through the use of ABC grant funds, the Palm Springs Police Department is committed
to expanding its current efforts in addressing alcohol-related criminal activity and alcohol
use by minors. The department will use these grant funds to address the problem of

ABC grant funds would be used to implement several different creative approaches designed to impact alcohol-involved criminal activity and alcohol use by minors, including Shoulder Tap Operations, Minor Decoy Operations, and IMPACT Inspection Operations. The Palm Springs Police Department will conduct four Shoulder Tap Operations, four Minor Decoy Operations, and two IMPACT Inspection Operations during the grant period. Each operation will require one sergeant, three officers, and two minor decoys. The only grant paid employees will be those PSPD police officers and sergeants who will be working approved grant-funded operations on an overtime basis. The minor decoys, consisting of PSPD Police Explorers, are volunteers and will not be compensated from grant funds. A press release will be issued at the start of the grant period by our Public Information Officer explaining the goals and objectives of the ABC grant program. After each operation, a press release will be issued providing updates on the number of licensed businesses who sold to minors, the number of businesses who did not sell to minors, and the number of adults arrested. The intent of these press releases is to publicize, through local media outlets, the actions taken to accomplish these objectives and the positive results of this ABC-funded grant project. The Palm Springs Police Department is committed to the safety of our community and recognizes the importance of alcohol-related enforcement and education. This grant period will conclude on August 31, 2021. FISCAL IMPACT: No fiscal impact. The Palm Springs Police Department is a municipal law enforcement agency serving a destination resort community with a variable population ranging between 48,000 to almost 100,000. The police department currently has an allotted 99 sworn officers; 35 of whom are assigned to patrol. The remaining officers are assigned to detectives, the International Airport, traffic and administration. The command staff consists of one chief, two captains and five lieutenants. There are 15 sergeants who oversee four patrol shifts, personnel and training, investigations, the airport bureau, the traffic bureau and downtown. The Palm Springs Police Department is responsible for patrolling the nearly 95 square miles that are within the city limits. The department has two divisions; operations and services. The City of Palm-Springs will be the target area of this program. It is located approximately 107 miles east of Los Angeles. The city encompasses an area of approximately 95 square miles. According to the Palm Springs Bureau of Tourism, the permanent year-round population of Palm Springs is about 48,518 and doubles to almost 100,000 during the winter season. Palm Springs hosts approximately 4 million visitors annually as well as 1.3 million passengers via the Palm Springs International Airport. These visitors come to Palm Springs to enjoy the weather and recreational activities, including Indian gaming. According to the United States Census Bureau, approximately 56.5% of the permanent population is between 18 and 65 years of age. The City of Palm Springs has approximately 395 ABC licensed establishments, which is the most of all the cities in the Coachella Valley and an increase of 125 licenses from 2018. There are 51 licensed for off-sale and 344 licensed for on-sale purchases. Palm Springs has a downtown area which has a large concentration of ABC licensed establishments. The downtown area is expanding, and current construction is allowing for more hotels, bars and restaurants. 6·• In 2017, the City of Palm Springs had the highest ranking of alcohol involved traffic collisions and the second highest of traffic collisions involving drinking by drivers under the age of 21, in comparable cjJ:ies. The grant operation period will be October 1, 2020·or upon federal spending authority (whichever is later) through August 31, 2021. The goal of the Minor Decoy Program is to reduce the number of licensees who sell alcoholic beverages to minors. On April 4, 1994, the California Supreme Court issued a unanimous decision upholding the use of underage decoys by law enforcement officials. As a result, Section 25658(t) of the Business and Professions Code and Rule 141 of the California Code of Regulations were established to provide the legal requirements for law enforcement agencies when conducting a decoy operation. The Shoulder Tap Program targets adults who furnish alcoholic beverages to minors; "Shoulder Tapping" refers to the practice used by minors to obtain alcohol from adult strangers near off-sale retail outlets. An underage decoy approaches adults outside an alcohol outlet and requests that the adult purchase alcohol on their behalf. IMPACT (Informed Merchants Preventing Alcohol-Related Crime Tendencies) inspections focus. on licensee education. The officers look for loitering, litter, graffiti, posted signs, lack of food service in restaurants, illegal weapons, or other violations. A checklist is used to note any violations observed and is given to the licensee. The Licensee is then provided an opportunity to fix any problems. Follow-up visits are then conducted to ensure the licensee has corrected the problems. All interested agencies should understand the funding of these grants is contingent upon the Department of Alcoholic Beverage Control receiving funds from the Office of Traffic Safety for the 2020/21 federal fiscal year.
