SUMMARY:
This item will authorize the City Manager to execute Right-of-Way Contracts -State
Highway Easements for California Department of Transportation (Caltrans) to upgrade
existing curb ramps to meet current Americans with Disability Act (ADA) standards. The
City of Palm Springs (City) received a request from Caltrans for Highway Easement
Deeds for portions of City owned real properties identified by Assessor's Parcel Number
(APN) 501-355-003 (24478-1) & 677-540-029 (24498-1), located along Vista Chino and
Gene Autry Trail (SR 111 ), respectively, within the City of Palm Springs. The Caltrans
Right-of-Way Acquisition Department has appraised the combined total value of the
easements at $1,800.
RECOMMENDATION:
1. Approve Right-of-Way Contract -State Highway Easement, Document No. 24478-
1 across City owned real property identified by Assessor Parcel Number (APN)
501-355-003 along Vista Chino (SR 111), for a total compensation amount of $500;
and
2. Approve Right-of Way Contract -State Highway Easement, Document No. 24498-
1 across City owned real property identified by 677-540-029 located along Gene
Autry Trail (SR 111 ), for a total compensation amount of $1,300; and
3. Authorize the City Manager to execute all necessary documents.

2City Council Staff Report October 22, 2020 --Page 2 Caltrans Easements SR 111 BUSINESS PRINCIPAL DISCLOSURE: Not applicable. BACKGROUND: Caltrans is upgrading the existing ramps along State Route 111 (SR 111) to current ADA standards. SR 111 runs southeast from the SR 111 exit on Eastbound 1-10 to North Palm Canyon, East along Vista Chino, South along Gene Autry, and East along East Palm Canyon to the City Limits. Some of these locations will require acquisition of easements from the City to allow Caltrans to construct and maintain the upgraded curb ramps along SR 111. On March 9, 2020, Caltrans contacted the City to request easements along the north side of Vista Chino (SR 111 ). Specifically, Caltrans is upgrading existing curb ramps between Park View Drive and Farrell Drive. The requested easements would allow Caltrans to construct curb ramps meeting ADA standards. Parcel 244 78-1 is a permanent easement to Caltrans for the upgraded ramp as shown in Figure 1 below. Figure 1. On April 8, 2020, Caltrans contacted the City to request an easement along the east side of Gene Autry Trail (SR 111 ), between District Center Drive and Mission Drive, designated as Caltrans Parcel Nos. 24498-3, 24498-2, & 24498-1. Parcel 24498-1 is a permanent easement to Caltrans to allow for construction of a larger ADA ramp. The properties in question along Gene Autry for the upgraded ramp as shown in Figure 2 below.

STAFF ANALYSIS: On August 20, 2020 Caltrans Acquisition Branch provided a formal appraisal and presented the City with an offer of $500 for the highway easement deed, designated as Parcel No. 244 78-1. The City Economic Development Staff reviewed the appraisal of a fair market value of $6.15 per square foot, and found the value consistent with and reasonable based on surrounding real estate comparable sales. The final Caltrans offer of $500 for a Highway Easement Deed across City owned real property identified as APN 501-355-003 along Vista Chino is included as Attachment 1. The area of land to be conveyed is only 39 square feet. On April 8, 2020, Caltrans Acquisition Branch presented the City with an offer of $7.00 per Square Foot, for a total of $1,217 for the highway easement deed designated as Parcel No. 24498-1. In June 2020, the City Economic Development Staff reviewed the submitted appraisal and did not agree with the valuation. Staff countered an assigned value of $7.50 per square foot. On August 20, 2020, Caltrans submitted an updated offer of $7.50 per square foot and offers $1,300 for Caltrans Parcel No. 24498-1 (Attachment 1). The area of land to be conveyed is only 183 square feet. The Right-of-Way Contracts -State Highway Easements, Documents No. 24478-1 and No. 24498-1 are included as Attachment 2 and Attachment 3. ENVIRONMENTAL IMPACT: The requested City Council action is not a "Project" as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the
4City Council Staff Report October 22, 2020 --Page 4 Caltrans Easements SR 111 whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. FISCAL IMPACT: Caltrans will pay the City a total valuation of $1,800 as the fair market value for the properties described in Exhibit "A" of Right-of-Way Contracts -State Highway Easements, Document No. 24478-1 and Document No. 24498-1. These funds will be deposited into the General Fund State Highway Maintenance Account given the property is considered an asset of the City. SUBMITTED: ~ Marcus L. We noticed an error with the square footage, the original form showed 183 s.f. but the correct area is 167 s.f. You'll note this lowered the calculated total from $1200.00 to $1100.00, however, as we previously agreed to $1300.00 that amount will be honored. Also, after discussions with multiple members of district personnel it has been decided to pull both parcels 24478 & 24498 from the December CTC calendar. As previously stated the documents should be competed by October 8th or 22nd, which will allow the Department sufficient time to meet our project delivery requirements. Please let me know if you have any questions or concerns. Mallory, The Council did not take official action and that will not happen until October 8, 2020 ( or October 22, 2020). The way Rebecca explained it to me is that the cutoff for Caltrans to got to the CTC is December. As long as the City approves the agreements prior to December Caltrans will remove the parcels from condemnation/eminent domain.

Associate Right of Way Agent, for the State of California. 1. In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as follows: (A) The parties have herein set forth the whole of their agreement. The performance of this agreement constitutes the entire consideration for said document and shall relieve the State of all further obligation or claims on this account, or on account of the location, grade or construction of the proposed public improvement. (B) Grantee requires said property (APN 501-355-003) described in Document No. 24478-1 for State highway purposes, a public use for which Grantee has the authority to exercise the power of eminent domain. Grantor(s) is compelled to sell, and Grantee is compelled to acquire the property. (C) Both Grantor(s) and Grantee recognize the expense, time, effort, and risk to both parties in determining the compensation for the property by eminent domain litigation. The compensation set forth herein for the property is in compromise and settlement, in lieu of such litigation. 2. The State shall: (A) Pay the undersigned grantor(s) the sum of S500.00 for the property or interest conveyed by above document(s). (B) Pay all escrow and recording fees, including any and all notary fees incurred in this transaction and, if title insurance is desired by the State, the premium charged therefor. Said escrow and recording charges shall not, however, include documentary transfer tax. 3. In consideration of the State's waiving the defects and imperfections in all matters of record title, the undersigned Granter covenants and agrees to indemnify and hold the State of California harmless from any and all claims that other parties may make or assert on the title to the premises. The Grantor's obligation herein to indemnify the State shall not exceed the amount paid to the Granter under this contract. 6. State agrees to indemnify and hold harmless the Grantor(s) from any liability arising out of State's operations under this agreement. State further agrees to assume responsibility for any damages proximately caused by reason of State's operations under this agreement and State, will, at its option, either repair or pay for such damage. 7. The acquisition price of the property being acquired in this transaction reflects the fair-market value of the property without the presence of contamination. If the property being acquired is found to be contaminated by the presence of hazardous waste which requires mitigation under Federal or State law, the State may elect to recover its cleanup costs from those who caused or contributed to the contamination. 8. The grantors(s) agrees that no improvements, other than those already on the property, shall be placed thereof; and planting of any crops, trees, or shrubs, or alterations, repairs or additions to existing improvements which may hereafter be placed in said area are at grantor's risk and without expectation of payment if removed by the State. 10. It is agreed and confirmed by the parties hereto that notwithstanding other provisions in this contract, the right of possession and use of the subject property by the State, including the right to remove and dispose of improvements, shall commence on the date the amount of funds as specified in Clause 2(A) herein are paid to the grantor(s). The amount shown in clause 2(A), herein includes, but is not limited to, full payment for such possession and use, including damages, if any, from said date. 11. All work done under this agreement shall conform to all applicable building, fire and sanitary laws ordinances, and regulations relating to such work, and done in a good and workmanlike manner. All structures, improvements or other facilities, when removed, and relocated, or reconstructed by the State, shall be left in as good condition as found. If affected, the State's contractor will relocate any utilities and/or poles if deemed necessary under Construction Contract Work. 12. It is understood and agreed by and between the parties hereto that this Agreement inures to the benefit of, and is binding on, the parties, their respective heirs, personal representatives, successors, and or assigns. 2

The amount shown in clause 2(A), herein includes, but is not limited to, full payment for such possession and use, including damages, if any, from said date. 11. All work done under this agreement shall conform to all applicable building, fire and sanitary laws ordinances, and regulations relating to such work, and done in a good and workmanlike manner. All structures, improvements or other facilities, when removed, and relocated, or reconstructed by the State, shall be left in as good condition as found.
