Formal City Council acceptance of Vista Chino (State Route 111) at Via Miraleste Traffic
Signal Installation, City Project No. 17-03, and North Palm Canyon Drive (State Route
111) at Via Escuela Traffic Signal Installation, City Project No. 17-05, is required to
document the completion of the public works improvements, and to allow the City's filing
of a Notice of Completion with the Riverside County Recorder in accordance with Section
9200 of the California Civil Code.
RECOMMENDATION:
1. Accept the public works improvement identified as Vista Chino (State Route 111) at
Via Miraleste Traffic Signal Installation, City Project No. 17-03, and North Palm
Canyon Drive (State Route 111) at Via Escuela Traffic Signal Installation, City Project
No. 17-05, as completed in accordance with the plans and specifications; and,
2. Authorize the City Engineer to execute and file for recordation with the Riverside
County Recorder a Notice of Completion for Vista Chino (State Route 111) at Via
Miraleste Traffic Signal Installation, City Project No. 17-03, and North Palm Canyon
Drive (State Route 111) at Via Escuela Traffic Signal Installation, City Project No. 17-
05.
BACKGROUND:
On September 20, 2018, the City Council awarded a construction contract in the amount
of $1,174,261.18 to Elecnor Belco Electric, Inc., a California corporation, Vista Chino
(State Route 111) at Via Miraleste Traffic Signal Installation, City Project No. 17-03, and
North Palm Canyon Drive (State Route 111) at Via Escuela Traffic Signal Installation, Gity
Project No. 17-05 , a copy of the staff report is included as Attachment 1.

2City Council Staff Report October 8, 2020 --Page 2 Approve Notice of Completion for SR 111 Signals, CP 17-03 and 17-05 STAFF ANALYSIS: Construction of the Project began in October 2019 following an extended delay in the receipt of traffic signal equipment caused by industry wide shortages. The new traffic signals were turned on March 5, 2020, and the work was accepted as substantially complete at that time. The California Department of Transportation (CalTrans), required the installation of communication hardware within the signal controller cabinet that was not available at the time of the turn on. The hardware was installed in August of 2020, and the project was accepted by CalTrans as complete on September 3, 2020. A copy of the executed Caltrans "100% Completion Notice" for all issued State of California Permits is included as Attachment 2. During construction, one Contract Change Order (CCO) was issued which resulted in a reduction to the Contract price of-$138,717.89 or approximately-11 %. This change order was comprised of reductions in construction quantities necessary to complete the work as well as the return of unused contingency funds. A copy of CCO-01 is included as Attachment 3. As determined by Staff, the contractor satisfactorily completed the Project and it is recommended that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the City Engineer to file and record a Notice of Completion to be submitted to the County, included as Attachment 4. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public structures, facilities, mechanical equipment or topographical features involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Therefore, in accordance with Section 15301 (c), the Project was considered categorically exempt from CEQA, and a Notice of Exemption has been be filed with the Riverside County Clerk. FISCAL IMPACT: The Project budget, incurred expenditures, and other associated costs are identified in Table 1.

RECOMMENDATION: 1. 6City Council Staff Report September 20, 2018 --Page 2 Award Contract CP17-03 / 17-05 BACKGROUND: As a result of two separate pedestrian fatalities in the months of October and November of 2016 at the intersection of Vista Chino (State Route 111) and Via Miraleste, the City Engineer requested Caltrans Traffic Operations to review the intersection and evaluate whether a traffic signal installation was warranted. On January 3, 2017, after completion of the analysis, Caltrans determined that a new traffic signal was warranted for operational improvements at this intersection, and suggested that the City of Palm Springs take the lead on the capital project on the state highway to install the new traffic signal. The City also requested Caltrans Traffic Operations to review the un-signalized intersection of State Route 111 at Via Escuela. This un-signalized intersection is at an acute angle on the alignment of State Route 111, and is within an urbanized area of Palm Springs with high density commercial and residential uses immediately surrounding the intersection. The Engineering Services Department commissioned a traffic signal warrant analysis for the State Route 111 at Via Escuela intersection, and based on the consultant's findings, warrants for a traffic signal at this intersection were not satisfied. However, after completion of the analysis, the City requested that Caltrans Traffic Operations evaluate the intersection for operational improvements. At the conclusion of their review, Caltrans determined that a new traffic signal was warranted for operational improvements, and suggested that the City of Palm Springs take the lead on the capital project to install the new traffic signal. On April 5, 2017 the City Council approved a Cooperative Agreement for State Highway Operation & Protection Program (SHOPP) Minor Funds Contribution from Caltrans for an amount up to $290,000 for the Vista Chino (State Route 111) and Via Miraleste Traffic Signal Installation, City Project No. 17-03, and authorized the issuance of a purchase order to Albert A. Webb & Associates to proceed with final design for the Project. On May 7, 2017 the City Council approved a Cooperative Agreement for State Highway Operation & Protection Program (SHOPP) Minor Funds Contribution from the California Department of Transportation for an amount up to $200,000 for the N. Palm Canyon Drive (State Route 111) and Via Esceula Traffic Signal Installation, City Project No. 17-05. In the spring of 2017, the Coachella Valley Association of Governments (CVAG) released a Call for Projects for $1 0 million in Measure A grant funding related to CVAG's Bicycle and Pedestrian Safety Program. In response to its Call for Projects, Engineering staff submitted 7 grant applications for projects focused on mitigating bicyclist and pedestrian accidents occurring on various major corridors. CVAG approved 5 of the City's grant applications, including the City's grant for funding to install two traffic signals at Vista ChinoNia Miraleste and N. Palm Canyon Dr.Nia Escuela with an estimated cost of $1,475,000. The CVAG grant provides $516,000 in Measure A funding for the Project. 2
7City Council Staff Report September 20, 2018 --Page 3 Award Contract CP17-03 / 17-05 On October 4, 2017, the City Council approved a reimbursement agreement with CVAG for the Project. On July 11, 2018, the City Council approved the plans, specifications and estimate and authorize staff to advertise and solicit bids for the Vista Chino (State Route 111) at Via Miraleste Traffic Signal Installation, City Project No. 17-03, and the North Palm Canyon Drive (State Route 111) at Via Escuela Traffic Signal Installation, City Project No. 17-05 (the "Project") A location map with a 500' radius from each project is provided below for reference. STAFF ANALYSIS: On August 2 and 9, 2018, staff advertised the Project in the Desert Sun, submitted Notice Inviting Bids to plan rooms', and provided the contract documents available free of charge to prospective bidders. Subsequently, on September 6, 2018, the Procurement and Contracting Division received four (4) construction bids from the contractors listed in Table 1. 8City Council Staff Report September 20, 2018 --Page 4 Award Contract CP17-03 / 17-05 The low bid of $1,174,261.18 is approximately 2.1% over the engineer's estimate of $1,150,000. The complete bid summary is included as Attachment 1. Public Works Contractor Registration Law (SB 854) Under California Labor Code Section 1771.1, as amended by Senate Bill (SB) 854 (2014), unless registered with the State of California Department of Industrial Relations (DIR), a contractor may not bid, nor be listed as a subcontractor, for any bid proposal submitted for public works projects on or after March 1, 2015. Similarly, a public entity cannot award a public works contract to a non-registered contractor, effective April 1, 2015. Staff has reviewed the DIR's contractor registration database, and has confirmed that Belco is registered with the DIR, and is appropriately licensed. Elecnor Belco Electric, Inc., of Chino, California, submitted the lowest responsive bid. Staff reviewed the bid, references, and contractor's license, and found the Contractor to be properly licensed and qualified. A construction contract with Elecnor Belco Electric, Inc., for the subject Project is included as Attachment 2. Local Business Preference Compliance Section 7.09.030 of the Palm Springs Municipal Code, "Local Business Preference Program," requires prime contractors to use good faith efforts to sub-contract the supply of materials and equipment to local business enterprises and to sub-contract services to businesses whose work force resides within the Coachella Valley. Elecnor Belco Electric, Inc., is not considered a local business; however, they have demonstrated sufficient evidence of good faith efforts to sub-contract the supply of materials and equipment to local businesses.
