(AUTOMATIC AID - FIRE PROTECTION AND MEDICAL
CITY OF PALM SPRINGS
AND
CITY OF CATHEDRAL CITY
THIS AGREEMENT, is made and entered into effective the �h day
of 1988, by and between the CITY OF PALM SPRINGS, —a-Cali-
fornia municipal corporation (hereinafter referred to as "PALM SPRINGS"),
and the CITY OF CATHEDRAL CITY„ A California municipal corporation (herein-
after referred to as "CATHEDRAL CITY").
The parties mutually agree as follows:
FIRST, four automatic aid areas are hereby established as set forth
in Exhibits A, B, C. and D annexed hereto and incorporated herein by refer-
ence:
AREA A outlines the area for which PALM SPRINGS will dispatch fire
protection services, in coordination with CATHEDRAL CITY Engine One, to
all structure fires west of the Cathedral Canyon Wash as delineated in
Exhibit A.
AREA B outlines the area for which PALM SPRINGS will dispatch fire
protection services, in coordination with CATHEDRAL CITY Engine Two, to
all structure fires west of the Whitewater River Floodway as marked in
Exhibit B.
AREA C outlines the area in which CATHEDRAL CITY will dispatch medical
aid services to all medical aid calls to a portion of PALM SPRINGS lying
immediately west of Cathedral Canyon Drive, comprising the Cathedral Canyon
Country Club area, as shown on Exhibit C.
AREA D outlines the area in which CATHEDRAL CITY will dispatch fire
protection services, in coordination with PALM SPRINGS Engine Five, to
all structure fires in the E1 Dorado Mobile Home Park and Cathedral Canyon
Country Club as shown in Exhibit D.
In each of such areas, the primary responsibility for fire protection
remains with the city in which :such area is located.
SECOND, within these automatic aid zones, PALM SPRINGS and CATHEDRAL
CITY agree to respond as set forth hereinabove to control reported fires
and answer emergency service calls, including the specified medical aid
calls. Each city will respond to reported structure fires within the
delineated areas with its nearest engine company. In addition, CATHEDRAL
CITY will respond to medical aid calls in Area C with its nearest engine
or squad. Whichever city responds to a call in the other city's area
shall immediately notify the other city of such response.
THIRD, the agency which has primary responsibility for fire protection
in the area involved will direct all fire protection operations and support
activities and request such additional assistance as may be needed, provid-
ed, however, in the event the emergency occurs along the border or between
two areas of primary responsibility, the first agency to arrive at the
scene will direct all operations and supporting activities and request
such additional assistance as is needed.
FIFTH, no party to this agreement shall be required to pay any compen-
sation to the other party to this agreement for fire protection or medical
aid rendered hereunder. Each party agrees that the automatic aid advantages
provided hereunder and the protection afforded to both parties by this
agreement are considered adequate compensation to all parties. However,
expenses incurred by either city for contract equipment or any extraordinary
or special supplies resulting from action on joint fires will be subject
to negotiation between the parties.
SIXTH, the extent of aid to be furnished under this agreement shall
be determined solely by the party agreeing to furnish such aid, and it
is understood that any aid so furnished may be recalled at the sole discre-
tion of the furnishing agency.
SEVENTH, this agreement shall not be construed as an agreement for
the benefit of any third party or parties and no third party or parties
shall have any right of action hereunder for any cause whatsoever. Any
services performed or expenditures made in connection with the furnishing
of mutual aid under this agreement by any party hereto shall be deemed
conclusively to be for the direct protection and benefit of the inhabitants
and property of such party.
EIGHTH, each of the parties to this agreement does hereby expressly
waive all claims against the other party for compensation for any loss,
damage, personal injury, or death occurring as a consequence of the
non-reimbursable performance of this agreement.
NINTH, each party shall provide, at its sole expense, the worker's
compensation insurance coverage necessary for its own employees. it is
recognized that at such times as one party provides aid to the other pur-
suant to the terms of this agreement, the employees of one may claim to
have become special employees of the other temporarily; should any such
claim result in any worker's compensation claim being asserted, it is
hereby agreed that each such claim shall be the responsibility and liability
of the general employer to process, defend, and pay, if necessary. Each
party agrees to assume such responsibility as to its own general employees
and to hold the other party harmless as to such claims where the other
party is only a special employer.
TENTH, PALM SPRINGS agrees to indemnify, defend and hold CATHEDRAL
CITY harmless from any loss, liability or claim arising out of the acts
or omissions of PALM SPRINGS or any of its employees. CATHEDRAL CITY
agrees to indemnify, defend and hold PALM SPRINGS harmless from any loss,
liability or claim arising out: of the acts or omissions of CATHEDRAL CITY
or any of its employee.
ELEVENTH, each party shall have the right to terminate this agreement
at any time by giving written notice to the other party and specifying
the effective date thereof.
TWELFTH, any notices required to be given under this agreement shall
be deemed to have been sufficiently given for all purposes if mailed,
postage prepaid, to the following addresses:

APPROVING THE EXECUTION OF AN AUTOMATIC
AID AGREEMENT WITH CATHEDRAL CITY FIRE
DEPARTMENT.
I HEREBY CERTIFY that this Minute Order, approving the execution
of an Automatic Aid Agreement with Cathedral City Fire Department,
was adopted by the City Council of the City of Palm Springs, California
in a meeting thereof held on the 16th day of March, 1988.
