I Richard K. Ehrlich, owner, agree to indemnify, defend, and hold the City of
Palm Springs and its agents and employees harmless from any and all liability,
claims, damages, or injuries to any person, or property which arise from or
are connected with the encroachment of buildings six and/or seven; and any
patios; block walls; fences ; sidewalks; or other items encroaching into the
existing fifteen foot city utility easement. Refer to drawing marked exhibit
A, and to construction (encroachment) permit number 09782; and further agree
to hold the city harmless from damage that may occur to the referenced
projections.
It is also understood that if at a later date this property should change
ownership, this agreement also applies to each and every owner of said
property as long as the city utility easement exists. The present and or
future owner or owners of the project also understand that if at a future date
the size of equipment used to service the utilities in this easement requires
the full fifteen foot width, at the option of owner, the buildings , patios ,
and or property line block walls shall be relocated or removed out of this
easement at owner's expense and at no cost to the city. This agreement is
made for the benefit of the property and shall run with the land.
