Flag Salute C. City Attorney Report on Matters Discussed in Closed Session-See Page 2 of Agenda this date. D. PUBLIC COMMENTS Ed Kibbey spoke regarding the Quimby Act, see prepared letter attached. Joy Meredith, requested that changes not be made to the parking standards downtown. E. COUNCIL COMMENTS/QUESTIONS/REPORTS Councilmembers commented on various civic functions attended. F. CITY MANAGER COMMENTS - None G. STUDY SESSION 1. QUIMBY ACT ORDINANCE City Attorney reviewed the Ordinance and added that the issue is whether the rate would be 3.5 or 5; that the lands counted towards park lands include the trails, certain designated school areas; that a full research of the manner of computation to determine ratio has not been completed and it may be higher once the calculations are done. Ed Kibbey stated that the City’s general plan does not speak to bike trails or school areas being part of the park system; that the Building Industry does support Quimby, but also encourages the City to be fair in the analysis. Director of Planning & Zoning stated that the acreage is based on 96 acres; that there are wide variables that have been used; that in the past the City strove to meet 100 percent density on projects; but that the General Plan indicates a 96- acre availability. Oden stated that further information is needed on the number of Cities that utilitizes capital improvements under Quimby; that no credit should be given for golf courses. City Attorney stated that the Quimby will assist with fees t continue funds for the future population; that it would be fair and reasonable for new presidents to pay to keep a level that other residents have paid for; that the Attorney General opinion on the issue included cultural center; that there are many amenities in Pal Springs that would be reasonable to include in the count i.e., golf courses. Mr. Kibvbey stated that the Attorney General opinion was broad; that a park fee could be complied, but that the parameters should not be misused. Mayor stated that the numbers presented by the Planning Department are not adding up; that the General Plan stated goal is to have 5 acres per thousand; that the figures being presented do not indicate correct numbers. City Attorney stated that the General Plan is adopted; that the numbers being used are to keep data concurrent; that if a future study is performed, certainly the Ordinance could be revised and the fees adjusted. Mayor stated that the quality of life for the residents should be maintained; that the City has already established the goal of 5 acres for thousand; that each year the Quimby is not in effect, the City looses acreage; that a determination need to be found to set the level the City wants to strive for to maintain quality of life. Reller-Spurgin recommended a subcommittee of staff to work on the Quimby issue. Council direction to bring the issue back with correct figures at the July 16, 2003 meeting. 2. SUMMER PARKING SCHEDULE Downtown Development Director sated that the plan is too give courtesy notices during the summer for Mon thru Wed and issue citations on Thurs through Sunday. Council consensus: No change to the downtown parking regulations. 3. STUDY SESSION DOCKET City Manager withdrew the item. ADJOURN ADJOURN
