HomeMy WebLinkAbout24917RESOLUTION NO. 24917 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CASE 5.1091-PDD 324, AN AMENDMENT TO FINAL DEVELOPMENT PLANS OF PDD 324 TO ALLOW THE REMOVAL OF A SPA ON THE SECOND LEVEL OF THE PALM SPRINGS HOTEL AND TO REPLACE IT WITH FOURTEEN ADDITIONAL GUESTROOMS FOR A TOTAL OF 164 GUESTROOMS AT THE PALM SPRINGS HOTEL LOCATED AT 414 NORTH PALM CANYON DRIVE, ZONE PDD 324/CBD. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS AND DETERMINES AS FOLLOWS: A. On behalf of Hall Palm Springs II, SMS Architects ("Applicant') has filed an application to amend the Final Development Plans for Planned Development District 324 with the City pursuant to Section 94.03.00(G) of the Zoning Code to allow the removal of a Spa on the second level of the Palm Springs Hotel (formerly known as the Andaz Hotel) and replace it with fourteen (14) additional rooms for a total of 164 guestrooms hotel located at 414 North Palm Canyon Drive, Zone PDD 324/CBD. B. On October 4, 2006, the City Council adopted a Mitigated Negative Declaration (MND) and approved Planned Development District 324 and a Vesting Tentative Tract Map 34190, for the mixed -use development. C. On September 1, 2011, a public meeting on Case No. 5.1091 PDD 324 was held by the City Council in accordance with applicable law and approved an amendment to Preliminary Planned Development Plans for the mixed -use development. D. On April 2, 2014, a public meeting on Case No. 5.1019 PDD 24-AMND was held by the City Council in accordance with applicable law for a proposed amendment to the mixed -use project. E. On May 26, 2021, and June 9, 2021, a public hearing on the proposed amendment was held by the Planning Commission in accordance with applicable law. F. On June 24, 2021, the City Council held a regularly scheduled meeting and considered the proposed amendment in accordance with applicable law. G. On October 4, 2006, and September 7, 2011, the City Council adopted a Mitigated Negative Declaration (MND) No. 2006109032 for the project. An updated traffic study dated July 8, 2011, and a subsequent environmental analysis was prepared under the provisions of the California Environmental Quality Act (CEQA), and a determination was made by the Planning Department that the amended project will not Resolution No. 24917 Page 2 result in any new additional impacts beyond those that were previously identified and addressed and that adequate mitigation measures had already been incorporated into the project. In the new assessment, staff also concluded that the MND covered the issues the City addressed, including topics such as land use policies, safety, aesthetics, biological resources, noise effects, and traffic impacts during construction, and operation of the project. In addition to the mitigation measures included in the MND, staff has included conditions of approval in support of the subsequent environmental analysis and the previously adopted Mitigated Negative Declaration. H. The City Council has carefully reviewed and considered all the evidence presented in connection with the hearing on the project, including, but not limited to, the staff report, and all written and oral testimony presented and hereby finds as follows. 1. The previously approved design and development standards contained in PDD 324 will remain in effect; the amendment will not include any new deviations from the development standards and will be generally consistent with the original intent of the mixed -use development. The elimination of the spa and addition of fourteen guestrooms will not result to any adverse impacts to the mixed -use project; there is adequate parking to serve the development. 2. The development standards for the proposed amendment will be substantially in conformance with the approved Planned Development District. The applicant is not seeking for any deviations from the development standards such as setbacks, heights and lot coverages. All these development standards will conform to the previously approved development standards. The modifications to the south and east elevations with the use of glass materials will enhance the overall appearance of the project on the North Indian Canyon Drive fagade of the hotel. 3. Overall, the project remains consistent with its original vision; it is a mixed -use development now consisting of a 164-room hotel, commercial retail, and restaurants. The project's original maximum height, overall mass, scale, setbacks, and lower roof lines designed to preserve public views especially along Palm Canyon Drive will not be impacted by the proposed modifications. And finally, given that construction activities at the site have remained stalled for almost two years; the new owners are prepared to move forward with the project with these revisions. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: That the findings and determinations reflected above are true and correct and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the City Council hereby approves Case No. 5.1091 — PDD 324-AMND, an amendment to the previously approved Final Development Plans for PDD 324 to allow the removal of a spa located on the second level and replace it with additional fourteen (14) guestrooms for a total of Resolution No. 24917 Page 3 164 guestrooms at the Palm Springs Hotel located at 414 North Palm Canyon Drive, Zone PDD 324/CBD, subject to the following conditions in addition to those previously established for PD-324: 1. On east elevation, the applicant shall revise the plans by: a. Adding a wall and planting screen in front of the pedestrian ramps. b. Replacing the stacked stone material with white plaster (to match other surfaces) between the storefront windows and trapezoid element near the center of the building. c. Removing the breeze block design on the north face of the stair tower at the south end of the building. 2. On the north elevation, the applicant shall revise the plans by: a. Extending eyebrow elements over adjacent planes in consistent manner, except that the eyebrow above the garage entry shall align above the entry void only. b. Including varying heights of plant materials in front of the large blank white wall or utilizing the wall for a mural. 3. The applicant shall install a minimum of four benches at or near each street corner for public use. 4. The applicant shall consider including a low composition wall within the pedestrian corridor to provide interest within the corridor and wayfinding signage. ADOPTED THIS 24TH DAY OF JUNE 2021.
