HomeMy WebLinkAbout24910RESOLUTION NO. 24910 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AND ADOPTING AN AMENDMENT TO THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN RELATIVE TO THE ARCHITECTURAL REVIEW PROCESS. A. On April 8, 2021, the City Council adopted Ordinance No. 2042, amending the architectural review process and other entitlement procedures, and directed staff to pursue amendments to specific plan documents to reflect these revised procedures; and B. On May 26, 2021, the Planning Commission conducted a duly noticed public hearing to consider a Specific Plan Amendment to the Downtown Palm Springs Specific Plan, and, by a 6 to 0 vote, recommended approval of the Specific Plan Amendment to the City Council; and C. Notice of a public hearing of the City Council of the City of Palm Springs to consider a Specific Plan Amendment was given in accordance with applicable law; and D. On June 10, 2021, a duly noticed public hearing on the proposed Specific Plan Amendment was held by the City Council, wherein the City Council carefully reviewed and considered all evidence presented in connection with the hearing, including, but not limited to, the staff report and all written and oral testimony presented; and E. The proposed Specific Plan Amendment is not subject to the California Environmental Quality Act ("CEQA") (Public Resources Code Section 21000 et seq.) pursuant to Section 15060(c)(2) of the State Guidelines, because the amendment relates to organizational or administrative activities of government that will not result in a direct or reasonably foreseeable indirect physical change in the environment, and is not a "project' as that term is defined in Section 15378 of the State CEQA Guidelines. As projects are submitted and reviewed for compliance with this amendment, the City will conduct CEQA review as required by law. F. The City Council finds that approval of the proposed Specific Plan Amendment would: 1. Align the architectural review procedures for the Downtown Palm Springs Specific Plan with the procedures for architectural review as conducted elsewhere in the city of Palm Springs. 2. Provide a streamlined architectural review process while still allowing for public notification and input in the process. Resolution No. 24910 Page 2 3. Provide consistency with the General Plan relative to the Downtown Urban Design Plan in preserving the rigorous design standards of the specific plan with the intent of the General Plan. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the findings and determinations reflected above are true and correct and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. SECTION 2. That the "Application Review Process" subsection of Section V of the Downtown Palm Springs Specific Plan document shall be rescinded and replaced as identified in Attachment A to this resolution. SECTION 3. That the proposed Specific Plan Amendment is not subject to the California Environmental Quality Act ("CEQA") (Public Resources Code Section 21000 et seq.) pursuant to Section 15060(c)(2) of the State Guidelines, because the amendment relates to organizational or administrative activities of government that will not result in a direct or reasonably foreseeable indirect physical change in the environment, and is not a project as that term is defined in Section 15378 of the State CEQA Guidelines. M#ia, M Jerk City of Palmprings, California Resolution No. 24910 Page 4 RESOLUTION NO. 24910 ATTACHMENT A DOWNTOWN PALM SPRINGS SPECIFIC PLAN AMENDMENT V. ADMINISTRATION AND IMPLEMENTATION A. Application Review Process The implementation tools for the Specific Plan will be Development Permits, Maof Architectural Reviews, Conditional Use Permits and subdivision maps. Under certain conditions, Planned Development Districts may be required. The successful implementation of the Downtown Palm Springs Specific Plan is critical to the long-term health of downtown Palm Springs. In order to assure an efficient and streamlined entitlement process, applications for areas within the Specific Plan will require special handling. This Specific Plan establishes a permit streamlining process which will assure the thorough review of Development Permit, Mjef Architectural Review, Conditional Use Permit and subdivision applications. Application Requirements and Process a. General Requirements. All applications relating to new buildings within the Specific Plan area shall require approval by the City Council. The process for approval of a new building shall be as follows: i. Pre -submittal conference with Planning Division staff: ii. Pre -application submittal: iii. Development Permit application approval: and iv. Architectural Review application approval. b. Pre -application submittal. Prior to .submitting Development Permit and Architectural Review applications, the applicant shall submit a pre - application package in a form as determined by the Director. The pre - application submittal shall include the following: i. A scaled and dimensioned site plan: ii. Schematic massing diagrams: iii. Schematic elevations and floor plans in preliminary form: 10 June 2021 Page 1 Resolution No. 24910 Page 5 iv. A schematic streetscape plan; and V. Any other drawings and studies as may be determined by the Director. The pre -application submittal shall be reviewed by the Planning Commission and the Architectural Review Committee in a ioint study session The commission members and committee members may provide comments to the applicant but neither body shall take any action on the pre -application submittal nor shall they preliminarily indicate approval, conditional approval or disapproval of the proposed project at this stage. C. Development Permit application. Development Permit applications will include the following in addition to the materials required as part of a standard Development Permit application: a-i_ A progressive calculation of building square footage, provided on the site plan. The analysis shall include square footage permitted for the applicable Block under the Specific Plan (Table III-3); square footage approved to date; and square footage proposed with the application. #-ii. If the project is for hotel or residential use, a progressive calculation of the number of hotel rooms or residential units provided on the site. The analysis shall include rooms or units permitted for the Specific Plan area approved to date and rooms or units proposed with the application. �iii If the project is for retail or office use, a progressive calculation of the square footage provided on the site. The analysis shall include square footage permitted for the Specific Plan area approved to date and square footage proposed with the application. d-.iv_ A calculation of parking required, parking provided within the applicable Block, and parking provided elsewhere in the Specific Plan area, as described in Section III.E.8. e-V. If parking is proposed to be located outside the boundaries of the Block where the use is to occur, the application shall include a demonstration that sufficient parking occurs elsewhere in the Specific Plan area, and shall be constructed prior to occupancy of the use, to accommodate the use, as described in Section III.E.8. Zvi. Such review shall include any evaluation required under the California Environmental Quality Act (CEQA). The Commission, upon closing the public meeting, shall: recommend approval of the application to the City Council, including the addition or modification of project conditions; request changes to the application and continue the matter; or deny the rp oiect. The recommendation of the Planning Commission shall be forwarded to the City Council forfinal approval. The decision of the City Council shall be final. d. Architectural Review application. Upon approval of a Development Permit application by the City Council, an Architectural Review application shall be forwarded to the Architectural Review Committee for review and approval. The Architectural Review application shall be processed consistent with the provisions of Section 94.04.00 of the Palm Springs Zoning Ordinance. e. Conditional Use Permit and Land Use Permit applications. Applications for Conditional Use Permits and Land Use Permits, not involving construction of new structures and only the use in question, shall be processed consistent with the provisions of Section 94.02.00 et. seq. of the Palm Springs Zoning Ordinance. f. Subdivision map applications. Subdivisions shall be processed in accordance with the Subdivision Map Act and Title 9 of the Palm Springs Municipal Code. g_ Planned Development District applications. Planned Development Districts, if required, will be processed consistent with the requirements of Section 94.03.00 et. seq. of the Palm Springs Zoning Ordinance. 10 June 2021 Page 3
