HomeMy WebLinkAbout24903RESOLUTION NO. 24903 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RESCINDING THE HISTORIC DESIGNATION OF THE CROCKER-CITIZENS BANK BUILDING LOCATED AT 1711 EAST PALM CANYON DRIVE, (APN #510-020-001) THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS AND DETERMINES AS FOLLOWS: WHEREAS, Chapter 8.05 of the Palm Springs Municipal Code allows for the designation of historic sites and districts; and WHEREAS, on May 2, 2017, TKG Smoke Tree Village applied for a demolition permit for the building located at 1711 East Palm Canyon Drive (known as the Crocker -Citizens National Bank Building); and WHEREAS, on May 9, 2017, the City's Historic Site Preservation Board (HSPB) considered the application at a public meeting and unanimously voted to place a stay on the demolition permit on the property and directed staff to initiate a historic resources report to further study of the site to analyze its potential historic significance; and WHEREAS, on September 12, 2017, at a noticed public hearing, the HSPB considered a staff report, the historic resources report prepared by Historic Resources Group dated August 14, 2017, and all written and oral testimony and voted to not accept the findings of the report or the recommendation in the staff report and forwarded a recommendation for Class 1 historic site designation of the property to the City Council; and WHEREAS, on November 1, 2017, at a noticed public hearing, the City Council considered the HSPB's recommendation on Case HSPB 109, and voted 4-1 to designate the Crocker -Citizens Bank Building at 1711 East Palm Canyon Drive as a Class 1 historic site; and WHEREAS, following its action of November 1, 2017, the City was notified that TKG Smoke Tree Village ("Petitioner") filed a petition with the court for a writ of mandate commanding the City to (1) rescind the City's designation of the property as a Class 1 Historic Site, and (2) issue a demolition permit to the Petitioner pursuant to their application; and WHEREAS, on April 10, 2019, the City was notified that the Court had ruled in favor of the Petitioner and the Court instructed the City to (1) rescind its designation of the property as a Class 1 historic site and (2) issue a demolition permit to the Petitioner. Resolution No. 24903 Page 2 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES: SECTION 1: RESCISSION OF HISTORIC DESIGNATION Based on the Court's ruling, the City Council hereby sets aside its decision of November 1, 2017, in the matter of Case HSPB # 109 and rescinds the Class 1 historic site designation of the Crocker -Citizens National Bank Building located at 1711 East Palm Canyon Drive. SECTION 2: ISSUANCE OF DEMOLITION PERMIT The City Council hereby directs staff to issue a demolition permit for all structures on the site related to the Crocker -Citizens National Bank Building located at 1711 East Palm Canyon Drive. SECTION 3: RECORDATION OF ACTION WITH THE COUNTY The City Clerk shall submit this Council Resolution to the County recorder for recordation within 90 days of the effective date of the Council's resolution. SECTION 4: ENVIRONMENTAL ASSESSMENT The proposed rescission of the historic designation is not subject to the California Environmental Quality Act (CEQA) because pursuant to CEQA Guidelines Section 15379 it is in compliance with a court order. Furthermore, it is not a project as defined by CEQA because pursuant to CEQA Guidelines Sections 15268, 15357, and 15369 it is a ministerial action taken to comply with a court order and the City has no discretion whether or not to comply with the court order.
