HomeMy WebLinkAbout24888RESOLUTION NO. 24888 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC CONVENIENCE WOULD BE SERVED BY THE ISSUANCE OF A TYPE 48 ALCOHOLIC BEVERAGE CONTROL LICENSE FOR "REFORMA PALM SPRINGS" A RESTAURANT, NIGHCLUB AND COCKTAIL LOUNGE LOCATED AT 333 SOUTH PALM CANYON DRIVE, WITHIN CENSUS TRACT NUMBER 446.06, ZONE CBD. (CASE 5.1524 PCN) THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. WHEREAS, Wolfgang "Rob" Giesecke, co-owner of Secondary Source Productions, dba Reforma Palm Springs has submitted an application to the California Department of Alcoholic Beverage Control (ABC) for issuance of a Type 48 (On Sale General Public Premises) alcohol license. In conjunction with the operation of a restaurant, nightclub and cocktail lounge use located at 333 South Palm Canyon Drive, Census Tract No. 446.06, Zone CBD; and B. WHEREAS, the California Department of Alcoholic Beverage Control (ABC) has determined that there are 149 existing on -sale alcohol licenses issued within Census tract number 446.06 while only two (2) such permits would be allowed based on population in the County and the census tract in which the applicant's premise is located; and C. WHEREAS, the California Department of Alcoholic Beverage Control (ABC) has determined that there is an "undue concentration" of alcohol -related licenses in the Census tract number 446.06; and D. WHEREAS, pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license; and E. WHEREAS, The General Plan land use designation of the subject property is Central Business District (CBD). The General Plan describes the intended uses for this land use designation area as "...the main activity center and cultural core of the community and, as such,... entertainment venues are encouraged here. (Palm Springs 2007 General Plan Land Use Element, page 2-7). Page 2-39 of the General Plan states, "it is envisioned that Downtown will become a high -intensity, mixed -use area characterized by residential, office, commercial and entertainment uses." The proposed restaurant / nightclub / cocktail lounge use is harmonious and consistent with the goals and vision of the General Plan as follows: Policy 7.1: "Encourage a diversity of high -quality commercial uses, attractive to both the resident and the visitor, including retail, entertainment cultural and food sales, in appropriate areas of the City." Resolution No. 24888 Page 2 Policy LU10.4: "Accommodate a borage range of uses Downtown to meet the needs of both residents and visitors and to stimulate both daytime and evening activity." Policy 28.7. "Encourage developers of sites containing a significant architectural, historical or cultural structure to adaptively reuse and expand it... " Policy CD30.3: "Encourage retail uses that maintain extended evening hours and support nighttime activity." ; and F. WHEREAS, the project site is located within the Central Business District ("CBD") zone in a historic multi -tenant building with frontages on South Palm Canyon Drive to the east, Baristo Road to the north, and Belardo Road to the west. Palm Canyon Drive is the primary commercial corridor in Census tract 446.06. The site has ample off-street parking on the west side of the parcel which takes access from Belardo Road and Baristo Road. The sale and consumption of alcoholic beverages is complementary to the proposed restaurant / nightclub / cocktail lounge uses. The proposed activities are consistent with the intent of the General Plan and conform to the development standards of the Zoning Code; and G. WHEREAS, on May 6, 2021 the City Council at a noticed public meeting, considered the PCN application including the staff report and all written and oral testimony provided in conjunction with the application. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES: That the public convenience would be served by the issuance of Type 48 (On Sale General Public Premises) alcohol license in conjunction with the proposed restaurant H nightclub / cocktail lounge use located at 333 South Palm Canyon Drive, Census Tract No. 446.06, Section 15/4/4.
