HomeMy WebLinkAbout24885RESOLUTION NO. 24885 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MINOR ARCHITECTURAL APPLICATION FOR THE RENOVATION OF AN EXISTING 2,637-SQUARE FOOT VACANT BUILDING INCLUDING NEW LANDSCAPING AND PARKING LOT UPGRADE AND EXTERIOR SIGN FOR A NEW CANNABIS DISPENSARY AT 315 NORTH INDIAN CANYON DRIVE (CASE 3.3289 MAA). THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Community Development, LLC has filed a Minor Architectural Application (MAA) request pursuant to Section 93.23.15(F)(3)(a) of the Palm Springs Zoning Code, signage is to be approved by the Architectural Advisory Committee and a recommendation of exterior building modifications forward to the City Council for final approval of a cannabis dispensary located at 315 North Indian Canyon Drive, APN: 513-081-011 (Case 3.3289 MAA) B. On July 23, 2020 the City Council approved an Administrative Minor Modification (Case 7.1604 AMM) by Resolution No. 24789 granting relief from the minimum separation distance requirement for a cannabis dispensary located at 315 North Indian Canyon Drive. C. On March 1, 2021, the Architectural Advisory Committee reviewed the project, approved the proposed sign, and recommended approval to the City Council with the following revisions to include: 1. Revise landscape plan to include: a. Add planter along north side of building. b. Site/Landscape plan to include trash enclosure, planter in front of store window. c. Simplify the rooftop screening. d. Define loading area behind the building. D. Section 94.04.00(D) of the PSZC provides specific findings that must be met before the City Council can grant an approval of the Minor Architectural Application. The findings are as follows: a. The Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas; i.e., sidewalks as distinct from parking lot areas. The proposed development is an appropriate re -use of an existing retail building along a Major Thoroughfare. The location of the building at the street edge with sufficient parking located in a lot to the rear of the building provides adequate one- way vehicle circulation. The renovation of the existing parking lot will meet the PSZC standards for design with handicapped access directly to the business entry. Resolution No. 24885 Page 2 b. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted. The renovation of the building will include the relocation of the current front entry on the south facing fagade, the use of stucco in a light grey color to the main body of the building and a new frameless glass butt -glazed with vertical joints in the three original openings of the building facing North Indian Canyon Drive. The windows will have dark shades mounted on the inside that will be drawn when the business is closed and open during regular business hours to allow visibility inside. The new entry door located on the south side under the taller eave will be a double automatic slider allowing for handicapped access. The renovation of the building will result in a business that is consistent with adjoining development and meets the finding. c. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment. The building height, massing, and setbacks will remain as is with no changes other than the exterior and interior renovation. The screening of the roof mounted mechanical equipment will utilize a metal screen in a black color that will enclose the condenser units and the duct work and the finding has been met. d. Building design, materials and colors to be sympathetic with desert surroundings. Building materials to be a smooth stucco finish for the walls in a grey color with frameless glazing and a bright yellow accent color on the entryway column will provide a contrasting element that is sympathetic with its surroundings and the finding has been met. e. Harmony of materials, colors and composition of those elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously. The structure is a one-story commercial building that is a simple design and will complement the other structures in the immediate area. f. Consistency of composition and treatment. The proposed sign approved by the Architectural Advisory Committee will be approximately 13-square feet in size constructed of metal cut out letters affixed to the column near the front entry. The letter height will be sixteen (16") inches and placed vertical and will be back -lit letters that glow from behind at night. g. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials. Resolution No. 24885 Page 3 The landscape plan will utilize a variety of desert landscaping to include Acacia and Palo Verde trees for parking lot shading as indicated on the stie plan, and shrubs and ground covers shall be drought resistant and consist of sage, ocotillo, agave, and lantana. Additional planter beds have been added at the request of the AAC to the front of the building to soften the intersection of the vertical glass as it meets the sidewalk and the finding has been met. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: That the findings and determinations reflected above are true and correct and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the City Council hereby approves Case No. 3.3289 MAA approving the exterior modifications and signage proposed for cannabis dispensary located at 315 North Indian Canyon Drive.
