A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, AUTHORIZING THE CITY
MANAGER OR DESIGNEE TO EXECUTE PROGRAM
SUPPLEMENT AGREEMENTS TO THE MASTER
AGREEMENT, ADMINISTERING AGENCY -STATE
AGREEMENT FOR FEDERAL AID PROJECTS,
AGREEMENT NO. 05-52821`15, AS MAY BE AMENDED.
WHEREAS, the Congress of the United States has enacted the Intermodal Surface
Transportation Efficiency Act (ISTEA) of 1991 and subsequent Transportation
Authorization Bills to fund transportation programs; and
WHEREAS, the Legislature of the State of California has enacted legislation by
which certain federal -aid funds may be made available for use on local transportation
related projects of public entities qualified to act as recipients for these federal -aid funds
in accordance with the intent of federal law; and
WHEREAS, the City of Palm Springs is eligible to receive Federal and/or State
funding for certain Transportation Projects, through the California Department of
Transportation; and
WHEREAS, Master Agreements and Program Supplemental Agreements need to
be executed with the California Department of Transportation before such funds could be
claimed; and
WHEREAS, before federal -funds will be made available for a specific program
project, the City of Palm Springs and State of California are required to enter into an
agreement to establish terms and conditions applicable to the City of Palm Springs when
receiving federal funds for a designated project facility and to the subsequent operation
and maintenance of that completed facility; and
WHEREAS, the City of Palm Springs has entered multiple "Master Agreements"
with the State of California for certain Transportation Projects, through the California
Department of Transportation, including the most recent Master Agreement
No. 08-5282F15 dated November 14, 2016; and
WHEREAS, Paragraph 4 of Article I sets for the requirements for execution of a
Program Supplement to the Master Agreement by the City as a prerequisite for receiving
federal -aid funds from and through the State of California; and
WHEREAS, the City Council of the City of Palm Springs wishes to delegate
authorization to execute the program agreements and any amendments thereto to the
City Manager, or a designee so appointed by the City Manager.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby authorizes the City Manager, or a designee
as may be appointed in writing by the City Manager, to execute all Program Supplement
Agreements and any amendments thereto to that certain Master Agreement,
Administering Agency — State Agreement for Federal -Aid Projects, Agreement
No. 08-5282F15, between the City of Palm Springs and the State of California, acting
through the Department of Transportation.
SECTION 2. The City Council hereby authorizes the City Manager, or a designee
as may be appointed in writing by the City Manager, to execute any future amendments
to that certain Master Agreement, Administering Agency — State Agreement for Federal -
Aid Projects, Agreement No. 08-5282F15, between the City of Palm Springs and the State
of California, acting through the Department of Transportation, as may be required by the
State of California.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
