Attn: Chris Konzen 1455 Market St. Floor 4 San Francisco, CA 94103 RE: EXTENSION OF TERM OF TRANSPORTATION NETWORK COMPANY OPERATING PERMIT AGREEMENT PALM SPRINGS INTERNATIONAL AIRPORT CITY OF PALM SPRINGS Dear Mr. Konzen, On April 15, 2020, the City of Palm Springs, a California charter city and municipal corporation ("City") and Uber Technologies, Inc., a Delaware Corporation ("Permittee") entered into an agreement entitled "Transportation Network Company Operating Permit Agreement Palm Springs International Airport City of Palm Springs." ("Agreement") The Agreement allowed Permittee the nonexclusive right to provide ground transportation services on Airport property subject to the terms of the Agreement. Pursuant to Section 3, the term of the permit expires April 30, 2021. The City would like to amend the Agreement to extend the term to April 30, 2022. Section 3 "Term of Permit" shall read as follows: "3. Term of Permit: Upon receipt of all required documentation, this permit shall become effective on April 15th 2020, and shall continue on a thirty (30) day, month -to -month basis, until revoked or cancelled as hereinafter provided. The term of this permit will not exceed two (2) years, April 30, 2022." All other terms and conditions of the Agreement shall continue in full force and effect, and be binding upon the Parties to this Letter throughout its term. By signing this letter, Permittee acknowledges full understanding and agrees with the terms contained in this letter.
