HomeMy WebLinkAbout24709RESOLUTION NO. 24709 A RESOLUTION OF THE CITY OF PALM SPRINGS, CALIFORNIA, REPEALING A POLICY FOR THE PROVISION OF SOLAR PHOTOVOLTAIC SYSTEMS AS F'ART OF DISCRETIONARY APPROVALS FOR NEW RESIDENTIAL DEVELOPMENT. A. On January 3, 2018, the City Council adopted Resolution No. 24354 establishing a policy for the provision of solar photovoltaic systems as part of discretionary approvals for new residential development. The policy provides that the wattage of the required solar photovoltaic system shall generally be equivalent to two (2) watts times the total square footage of the residential dwelling unit. B. On January 9, 2020, the City Council conducted a public hearing, received public testimony and adopted Ordinance No. 2008 adopting by reference the 2019 California Energy Code, including all appendices, effective January 1, 2020. C. Section 150.1 (c)(14) of the 2019 California Energy Code requires installation of solar photovoltaic systems on low-rise residential buildings (three stories and under), with an annual electrical output equal to or greater than the dwelling's annual electrical usage as determined by Equation 150.1-C. D. For Climate Zone 15, where Palm Springs is located, Equation 150.1-C requires solar photovoltaic systems to have an annual electrical output in excess of the output set out in the policy adopted in Resolution No. 24354. E. The 2019 California Energy Code establishes minimum statewide building energy efficiency standards and therefore preempts the policy adopted in Resolution No. 24354. F. To avoid confusion in the building community, the policy adopted in Resolution No. 24354 should be repealed. ·THE-CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: . - . SECTION-1 :: That the findings and determinations reflected above are true and '.correct and are"incorporated by this reference herein as the cause and foundation for the action taken by and through this resolution. SECTION 2. The policy regarding the requirement for solar photovoltaic panels · as part of discr~tionary approvals for residential development, as contained in Exhibit A of Resolutio[l-No. 24354, is hereby repealed, effective January 1, 2020.
