Hello Council Members,
Vintage Electric has been working in and around Palm Springs since 2001.
Our work force lives entirely in and around Palm Springs. In fact, everyone one of them are homeowners.
We pay them good wages with benefits without being associated with a labor union. On publicly funded projects we pay
the same wages at union electricians yet are forced to make contributions that fund union only benefits.
Our electricians attend continuing education classes to provide the same level of services as any union shop.
We are a part of approximately 85% of the America's workforce that would be excluded from working with the city
without being forced to join the IBEW.
Please consider these things when discussion Project Labor Agreements or associated plans.

RE: Community Workforce Agreement must take local workers and apprentices into
consideration
Dear Mayor and City Council:
We have reviewed the staff report on item 4B and we are appreciative of the efforts by the council and
city staff to take our concerns into consideration. On behalf of our member companies, their employees,
and our apprentices, we are asking your council to allow local businesses to be exempt from the CW A,
allow local workers and apprentices to work regardless of labor affiliation, and not require payment for
benefits a worker will never qualify to use.
All local workers, regardless of labor affiliation, should be allowed to work on City jobs. The current
form of the CWA does not allow our local contractors to utilize their workforce. Specifically, it would
require a local Core Worker to sit home in favor of one that is dispatched from the union hall. There is no
guarantee that the union will dispatch a local resident to the job site.
Apprenticeship is a gateway to prosperity for many, and we encourage your council to allow all
apprenticeship programs to participate on city jobs. Enrolling in an apprenticeship program can be
complicated and requires a serious commitment from the workers. Many of the union programs have
waiting lists. This means that despite the promises that local residents will be recruited into programs
they may have to wait years to be admitted. Apprentices also have to make a commitment for multiple
years before they complete the program. A rising tide raises all ships, and just so all State Approved
Apprenticeship programs should be allowed to participate. By including all programs, you ensure the
benefits of apprenticeship are open to all and provide multiple pathways when they encounter a waiting
list.
Last, we encourage your council to allow contractors to pay into their employees existing health and
retirement plans. The staff report clearly identifies the problems created by the language in the proposed
CW A. Simply put, a non-union worker shouldn't be forced to pay into union plans they will likely never
qualify to utilize.
In closing, we urge your council to hold firm on the revisions you have requested to the CW A or do not
enter into a CW A. Afterall, there is no requirement that the city enter into a CW A. Yet, if that is the
choice, local workers shouldn't be harmed by the CW A implementation.

My name is Frankie Jimenez, President/ Business agent of Union lronworkers 416. I oversee San Bernardino and
Riverside counties.
Our union that is well over 3500 members are in support of CWA as it would be acceptable by the building trades council
and affiliated unions
Here are some key points we are in support of CWA, PLA
Provides goals for Local Hiring, Apprenticeship, and Veterans.
-Guarantees an available pool of Trained and Skilled Craft Workers
-Increases Apprenticeship Training opportunities for Local Residents, Women, LGBTQ+, Veterans, Minorities,
under/unemployed residents, At -risk youth, and previously incarcerated individuals.
-Promotes increased Construction dollars staying local, a benefit to the City, Local Businesses, and the Region.
-Promotes and provides for increased Career Opportunities through the development of Pre-Apprenticeship programs
for entry into formal Labor-Management Apprenticeships
-Reduce Construction Risks through Labor-Management Cooperation, Standardized Dispute Resolution procedures,
Pre-job Conferences, No-Strike/No Lockout Provisions, Standardized meal and rest periods, work hours, and work
weeks.
Therefore we urge this council to reconsider the decision that you are trying to imply

I am a lifelong resident of the Coachella Valley. I was born and attended school in the valley. I went to college in the
valley. Later in life I was married in Palm Springs. I had two children who were both born at Desert regional Medical
Center. They both went to school in the Palm Springs unified school district. I am currently the president of the shadow
Mountain gem and mineral society based out of, and meeting in Palm Springs. When it came to career choices I joined
Carpenters local 1046 out of Palms Springs. I have worked in the Construction industry for more than 27 years, and
honestly the only time I've ever worked in the city of Palm Springs on a construction project was for one day setting
storm drains for the parking lot of Agua Caliente casino in downtown Palm Springs. I spent a lot of my career driving
hours away out of town to other construction projects while the construction projects in my own neighborhood went to
substandard contractors and workers who were cheating the system and/or traveling from in and out of the area. I find
this highly offensive as I not only live in the community, but I support the community by frequenting businesses and
paying taxes. I should be allowed the opportunity to work in the community of Palm Springs. Supporting agenda item 4B,
Will allow me the opportunity to do so as well as others in the community that are in the same situation. It will also help
to eliminate previous bad practices and poor workmanship that the city is currently dealing with the repercussions of.

I urge you to please review the attached letter and take the time to fully consider the implications of the proposed
CWA. Should you choose to implement the CWA, I hope you would support a fair CWA that does not rob union-free
workers of a good portion of their hard earned pay, allows for non-union contractors to keep their workforce and allows

On behalf of the 21,000 essential members that UFCW Local 1167 represents, I am writing to
express our support for Item 48 on the agenda, Approval of a Community Workforce Agreement
by and between the City of Palm Springs and the San Bernardino/Riverside Counties Building
and Construction Trades Council, AFL-CIO and the signatory Craft Councils and Unions.
UFCW Local 1167 fully supports the Community Workforce Agreement (CW A) with the
conditions the Building Trades Council has agreed to.
A CW A provides the City of Palm Springs the ability to bring in new jobs and career
possibilities to the community. Apprenticeship training opportunities would be made available
to local residents, including women, the LGBTQ+ community, veterans, under/unemployed
residents, at-risk youth, and previously incarcerated individuals. These historically underserved
groups of workers deserve the ability to have access to good paying jobs that offer equality for
wages~ benefits and safe working conditions. A CW A in Palm Springs is especially important as
we attempt to move forward from the devastating effects of the current COVID-19 crisis.
For these reasons, we urge the City Council to vote to approve Item 48 this evening, establishing
a Community Workforce Agreement as agreed by the San Bernardino/Riverside Counties
Building Trades Council with the conditions the Building Trades Council has agreed to and no
additional changes or exemptions as presented in the Staff Report.

SMART Sheet Metal Workers Local 105 is proud to support Item 4B, approval of a
Community Workforce Agreement with the City of Palm Springs.
A CWA allows the City of Palm Springs to set goals and standards for construction projects
in the city. A CWA will create equity in training, employment, wages, and career
opportunities for residents to include veterans, minorities, women, and LGBTQ. These
agreements keep municipal tax dollars local and help to grow the local economy by
supporting local small businesses and contractors. These inclusive agreements also help
to build trust in local government as well as a feeling of civic pride.
CWAs also ensure that quality projects are completed on time and on budget. This is
accomplished though Labor Management Agreements, Standardized Dispute Resolution
Procedures, Pre-job Conferences, and No-Strike/ No Lockout Provisions. These agreements
also reduce embarrassing news articles about the mistreatment of workers by
standardizing meal and rest periods, work hours, and work weeks.
Opponents to the CWA do not care about the city or residents of Palm Springs. Groups like
the ABC create huge profits for their contractors by lowering standards in training,
supervision, and the treatment of their workforce. They do not want requirements for local
hire opportunities for women, minorities, or LGBTQ residents. Their only goal is to maximize
profits and cutting costs by driving down standards for the quality or work, quality of
workers, and benefits to your community.

A Community Workforce Agreement is exactly what taxpayers and citizens want. They
want their tax dollars to be spent on quality projects, that hire local residents, and improve
the quality of life for the people of Palm Springs. If agree with this desire, then you will vote

Dear Mayor Holstege and Palm Springs City Council,
My name is Joe Whitcher, I am a 32 year Sheet Metal Worker, Riverside County Resident, and Current
Business Representative of the Sheet Metal Workers Local 105 for the past 11 years, serving Riverside
County. Local 105 Represents approximately 6000 Sheet Metal Workers and many of whom are too familiar
with living Inland and commuting towards LA to maintain steady employment.
I am in very enthusiastic support of the CWA (Community Workforce Agreement) for all workers and the
mutual benefit of the Palm Springs Community. I base my support on experience and expertise in the Building
and Construction Trades.
I am very pleased to say that we have moved in the right direction since I was elected by the Sheet Metal
Workers to Represent the Riverside County Area. I can explain by citing some example of where we were 10
years ago, what things look like today, and support for a continued positive direction for improved
construction practices.
10 years ago, we were in a construction recession resulting in increased unfair labor practices and poor quality
of construction from untrained and out of the area workforces. I will try not to be too specific but one project
I monitored was about a $100 million dollar project in Rancho Mirage and the HVAC Mechanical was awarded
by PSUSD to an out town contractor from Arizona who came in on a $10 million dollar sub contract against
local bidding contractors. Local applicants were actually denied the opportunity to even apply for work. Some
went to the jobsite to solicit and were told to wait outside the jobsite gate on the far end of the project with
nobody ever coming out to take an application. The end result was an entire work force from out of State and
a lesser quality of work than could have been. In California we have specific building codes and standards that
the out of town workforce is not trained in, seismic requirements for example because we have
earthquakes. Another project in the area was about a $5 million dollar HVAC Mechanical sub contract in
which case the employees were exploited under unacceptable conditions. These out of town employees were
paid 1-1/2 to 4 hours wages for 8 hours worked and reported that they felt forced to sign off that they were
paid correctly when receiving their paychecks. Up to 6 workers shared one hotel room with one bathroom for
the duration of the work. The workers also reported verbal abuse while working. The end result also included
very poor and unacceptable construction. This included dirty ductwork, leaking ductwork, improperly
installed all around, ductwork coming apart before even completed, a severely delayed schedule and another
lesser quality end product.
Today things have improved immensely. Increased work opportunities in conjunction with partnerships and
community relations have us in much better construction workforce climate in the Inland Empire. Today we
have new local contractors with a highly skilled workforce that specifically focus on bidding work in the Inland
Empire. We also have relationships with the non-represented workforce, co-existing and working together

where we have CWA's. Community Workforce Agreements have increased throughout the Inland Empire and
the result is clear that we have better working conditions, better quality construction, local work opportunities
with proven Apprenticeship programs.
I would be happy to meet with you in person to discuss Apprenticeship programs and construction labor
issues.

My name is Jim Rush, Business Manager ofIBEW Local Union 440. We
represent over 1400 electricians throughout Riverside County, many of which call the Coachella
Valley their home. I am writing in support of item 4B, the Community Workforce Agreement
that is before you this evening. These agreements are sound policy for any community to show
the constituents that you are putting the residents first when it comes to their tax dollars being
used to build projects. From the local area hire language, to the opportunities for at-risk youth, to
putting the trades back in the community, you will be increasing the return on investment when it
comes to these future construction projects. If residents are able to access opportunities in Palm
Springs, are able to work and build Palm Springs, they are going to spend their paychecks here in
Palm Springs and invest back in the community. This is a win-win for all in Palm Springs.

Dear Council Members:
The AGC is the largest contractor association in America and in California comprised of both union
and non-union contractors. Our apprenticeship program is the largest non-union program in the state
of California, and we are a subsidiary of the AGC San Diego Chapter, with active training centers in
Riverside, Orange County, and San Diego.
The formal AGC position is we strongly oppose any government mandate for CWA/PLA's. AGC is
committed to free and open competition for publicly funded work, and believes that the lawful labor
relations policies and practices of private construction contractors should not be a factor in a
government agency's selection process. AGC believes that neither a public project owner nor its
representative should compel any firm to change its lawful labor practices to compete for or perform
public work, as PLA's effectively do. AGC also believes that government mandates for PLA's can
restrain competition, drive up costs, cause delays, lead to jobsite disputes, and disrupt local collective
bargaining.
In addition, the terms of a PLA would prohibit the use of any non-union apprentices on PLA project,
which is highly discriminatory and contrary to public policy of promoting training and opportunity
for all.

Organized labor's arguments are completely misleading. A CW A is not about local hire, non-strike
provisions, prevailing wages, veteran preference, or any other reason they proffer. A CWA is about
two and only two things: 1. They want union workers to perfonn the work, and 2. They want all
fringe benefit money to go into their trust funds. Unions push CW A's to manipulate market share in
their favor, but if they sold it that way, they would have little or no political support.
PLA' s also raise the costs of construction projects by 10%-15%. This increase in costs is money that
will go to waste if you impose a CW A -money that was intended to be spent on actual construction
projects, not on excess costs associated with a union-only agreement.
Contrary to the presentation you have heard from labor representatives, supporting a CW A is not the
"right thing to do." They make it seem like a CW A will guarantee living wages, yet prevailing wages
are already mandated by California law. They make it seem like this is about veteran or local hire, yet
labor almost never hits their goals, and there are no penalty provisions for not reaching local hire
goals. Beyond the negative economic issues, this pretty much boils down to one point -
discrimination in any shape or form is always wrong! ALWAYS WRONG! It is never the right thing
to do, and passing a CW A will discriminate against non-union apprentices by barring them for
working on any city project. Many of those banned workers may live in Palm Springs.
It is poor business judgment to pass a CW A, and when you add in the discrimination factor, there is
no valid reason to impose a CW A on any work within your great city. We urge you to reconsider
your decision to implement a community workforce agreement.

work close to home, and not have to spend hours upon hours traveling to and from work. When members spend less

Mayor and Members of the City Council,
On behalf of the Painters & Allied Trades District Council 36, we are urging support of the
approval of the Community Workforce Agreement (CWA) for the city of Palm Springs.
This CWA will provide for thousands of high skilled, middle class construction career
opportunities for hard working men and women in Palm Springs and the region. It will also
provide veterans hire priorities allowing them to be rewarded for their service by earning good
wages and benefits.
These goals will be achieved through a Community Workforce Agreement with the Inland Empire
Building and Construction Trades Council.
We expect the CWA will also provide for increased Housing, including 15% of affordable units.
Furthermore, it also will provide the City with additional Park and Open Space for the local
residents.
We also expect the CWA will provide commercial space for retailers, restaurants, and hotels,
which shall provide revenue that will feed into the region's economy including revenue for the
City's General Fund.
Again, we urge the City Council to approve this Historic Community Workforce Agreement.

Dear Mayor and City Council:
I am writing on behalf of Brudvik, Inc. We are a local electrical contractor that has been located in the
City of Palm Springs for almost 40 years. Currently, we employ 18 people. We are writing to thank
the City for listening to our request and appreciate the City staff for specifically requesting to carve
out local contractors from the CWA.
First, we want to comment that we agree with the City Attorney's suggested definition of local
contractor in the staff report. This adequately addresses who we are as a long-time business in the
City and as a business that has partnered with the City to build many of your public works projects.
In addition, we don't feel the council was intending on us not using our local employees. We want to
restate that, in effect under the proposed CWA, we would be required to leave a local worker at
home in favor of a union worker, who may not be local. By exempting us, we could use all local
employees. Furthermore, our apprentices are enrolled in a State approved apprenticeship program.
The proposed CWA would shut out our apprentices because it only allows for apprentices from union
programs. We also don't think preventing local apprentices from working on City projects was the
Council's intent.
Lastly, as a local contractor we want to point out that we are exactly who you want working on City
projects. We live here, our employees live here and we pay taxes here. If you really want an
economic force multiplier, please continue to exempt us from the CWA or don't enter into one at all.
Thank you again for taking our thoughts into consideration and for attempting to put this language in
the agreement. We feel that you listened to our concerns and we truly hope you can keep local
workers, and businesses, working on Palm Springs projects.

My name is Vanessa Frias and my father is Joey Frias. He is currently working in Los Angeles and has been for quite some
time. My family and I live in Coachella, which is about two hours away from Los Angeles, not including traffic. Because of
this and the amount of gas spent, my father stays over there every week. He leaves Monday morning around four am
and comes home Friday around eight pm every week. The reason I am informing you about when my dad comes home is
that I want you to know that I rarely see him. When he does come home he is tired and drained from all the pressure
that is put on him at work. He tries his best to do things with his family but we know that we cannot do everything we
want to do all in one weekend. I want to see my father more and I want him to be able to see my softball games. I want
him to be able to be here every day like I know he wants to. If the Union spreads out into the desert, my father would be
able to be here for his family, and I know a lot of other people would be able to spend more time with their families as
well. Spreading the Union out into the desert would be a great idea because there are a lot of people looking for work
out here and they are able to deal with the heat as my father does. If this does happen, my father would be able to
come to my softball games and he will still have time to spend with my other two brothers and my mother. This would
be an enormous help. Thank you so much for taking the time to read my message.

At your meeting tonight you will be discussing the issue of PLAs once again. Your staff has done an excellent
job summarizing the issues specifically how a traditional PLA would exclude local workers, apprentices and
contractors. In attempting to meet the goals you have set out they are hitting resistance with local labor
leaders. This is unfortunate.
In the end you want an agreement that is good for Palm Springs and local residents, all local residents. State
certified apprentices should all be welcome. Local union-free workers should be able to maintain their current
benefit packages. Local contractors should be able to use all of their local workforce.

-Creation of a Joint Administrative Committee to Monitor and review any problems that may arise, and recommend
amendments to the CWA if necessary.
-Non Discrimination in Referrals, Employment, and Contracting regardless of race, color, gender, sex, national origin,
age, sexual orientation, political affiliation, or membership in a Labor organization.
-Equality for wages, benefits, working conditions, hiring, career advancement, training and Union Representation.
-Addresses Safety and protection of workers and Property, including a comprehensive Substance Abuse Policy

Community Workforce agreements are necessary now more than ever to help level the field for the most marginalized communities
including those households that are in desperate need of local work due to covid & other barriers. We need to keep our local dollars
in local households so that the region can become more self sustainable and_ keep the economy growing for working families. Please
as leaders, demonstrate the w isdom we need to make decisions that have the future in mind and keep our priorities focused on
equity for all workers not just profits. The payoff for this wise decision making is a win win for both the region & the community!
